The lots are in identical ownership and for the purposes of zoning have merged into one developable lot. The first lot-.Appeal 2000-88 is Lot 178, a 0.73 acre lot(0.57 acres upland)fronting on Cap'n Crosby Road. The second lot-Appeal 2000-89 is Lot 050. a 0.48 acre lot(0.40 acres upland) fronting on Three Ponds Drive. The lot lines were drawn over the water and the two share a common boundary of 54 feet in the middle of a pond. \ �� The applicant is seeking a bulk variance for each of the undersized lots so that each will be buildable under . ' zoning. --1- C_: G Procedural Summary: e-I J These appeals were filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on July 27, 2000. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearings were opened October 11, 2000. At that \� -S hearing the Board determined that both appeals would be heard together and that one decision would be rendered for both appeals. At the conclusion the Board granted the variances with conditions. Board Members hearing this appeal were Gail Nightingale, Richard Boy, Dan Creedon, Ralph Copeland and Chairman Ron Jansson. Attorney Stan Nowack represented the applicant before the Board. Chris Kelly and -'- Diana Dupont spoke in opposition to the petition. 1 Findings of Fact: At the hearing of October 11, 2000, the Board found the following findings of fact in Appeal 2000-88 and 89: 1. In Appeal 2000-88 and 89, the applicants, John and Ruth Kalakowski, have requested a Variance to Section 3-1.3 RC Bulk Regulations, Minimum Lot Area. 2. The properties are located as 255 Cap'n Crosby Rd &62 Three Ponds Dr., Centerville, MA, Assessor's Map 193/Parcel 178 & Map 173/Parcel 050. They are both located in an Residential C Zoning District and an Aquifer Protection Overlay District 3. The properties at issue in Appeals 88 & 89 are two vacant lots located on either side of a pond,.each fronting on its own way. '4. Lot 178 is a 0.73 acre lot, 0.57 acres of which is upland. The lot has 40 feet of frontage on Cap'n Crosby r Road. Lot 050 is a 0.48 acre lot, 0.40 acres of which is upland. The lot has 106 feet of frontage on Three Ponds Drive. 5. The topography, with a pond between the two lots creates unique conditions that affect this locus only. 6. A literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise to the petitioner. 7. The relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. The Vote was as follows: AYE: Gail Nightingale, Richard Boy, Dan Creedon, and Chairman Ron Jansson NAY: Ralph Copeland Decision: Based on the findings of fact, a motion was duly made and seconded to grant variances to both lots subject to the following terms and conditions: 1. The variance is issued only to lot area. All other bulk requirements shall be met. 2. Development of the lots as permitted in the RC Zoning District shall conform to all requirements of the Conservation Commission, Board of Health and Building division. 3. The septic system shall be located as directed by the Board of Health and shall be as far away from the pond as possible. The Vote was as follows: AYE: Gail Nightingale, Richard Boy, Dan Creedon, and Chairman Ron Jansson NAY: Ralph Copeland Ordered: Variances to the minimum lot area has been granted to the lots with conditions. This decision must be recorded at the Registry of Deeds for it to be in effect. The relief authorized by this decision must be exercised in one year. Appeals of this decision, if any, shall be made pursuant to MGL Chapter 40A, Section 17, within twenty (20) days after the date of the filing of this decision.
