DEED RESTRICTION
WHEREAS, Michelle J. Kozin of 162 Cottonwood Lane, Centerville, Massachusetts
("Kozin") is the owner of the property known as and numbered 154 Cottonwood Lane in
Barnstable (Centerville), Barnstable County, Massachusetts, shown as Lot 158 on Land Court
Plan 20239C filed with the Barnstable County District of the Land Court (the"Lot");
WHEREAS, Kozin as the owner of the Lot has agreed with the Town of Barnstable
Board of Health to a restriction as to the number of bedrooms which can be ingluded in any home
built on the Lot as a pre-condition to obtaining a variance from the 310 CMR 15.214 State
Environmental Code, Title V, Minimum Requirements for the Subsurface Disposal of Sanit
Sewage and to ary_obtaining a building permit for the Lot;
WHEREAS, the Town of Barnstable Board of Health, as a pre-condition to granting the
variance from 310 CMR 15.214, State Environmental Code, Title V, Minimum Requirements for
the Subsurface Disposal of Sanitary Sewage, and authorizing the issuance of a building permit
for the construction of a single family home on the Lot is requiring that the agreement for the
restriction on the number of bedrooms in any house constructed on the Lot be put on record with
the Barnstable County Registry District of the Land Court by filing this document.
NOW, THEREFORE, Kozin does hereby place the following restriction on the Lot in
accordance with her agreement with the Town of Barnstable Board of Health, which restriction
shall run with the land and be binding upon all successors in title:
1. Kozin may have constructed upon the Lot a house containing no more than two
(2) bedrooms.
2. Kozin agrees that this shall be a permanent deed restriction affecting the Lot.
For Kozin's title, see Certificate of Title No. 155036.

Dear Mr. Aucoin:
You are granted a variance on behalf of your client, Daniel Kozin, to construct an
onsite sewage disposal system at 154 Cottonwood Lane, Centerville,
Massachusetts.
The variance is granted from 310 CMR 15.214.of the State Environmental Code,
Title V. The applicant proposes to construct an onsite sewage disposal system
capable of handling 220 gallons per day on a lot which is only 10,941 square feet
in size. This exceeds the regulation which restricts the daily flow to a maximum
of 440 gallons per acre per day within a Zone II.
This variance is granted with the following conditions:
(1) A certified soil evaluator shall conduct soil evaluations and percolation
tests in the area of the proposed soil absorption system and reserve area.
(2) The engineered plan shall be revised to show the certified soil evaluations
and percolation tests.
(3) The applicant shall submit floor plans of the proposed dwelling to the
Board of Health. The letter dated August 8, 1999 was not approved by
the Board of Health. Also, the floor plan submitted to the Board on
August 24, 1999 showing a proposed "tri-level" home with two bedrooms,
plus a "den", plus a "living room", plus a "family room", was not approved
by the Board of Health. Dens, study rooms, finished attics, sleeping I
ofts, and similar-type rooms are considered bedrooms according to MA
Department of Environmental Protection.
(4) The applicant shall record a deed restriction at the Barnstable County
Registry of Deeds in regards to the maximum number of bedrooms
allowed at this property - two (2).

This variance is granted because it is the Board's policy, at this time, to allow the
construction of two bedroom homes on lots of less than 18,000 square feet in
size. This lot is only 10,941 square feet. The applicant has the legal right to
dwelling on this property without an variance. It is the

We would like to build a year round 2 family home at 154 Cottonwood Lane
(the last remaining build-able lot in that neighborhood). We are planning to
design a 2 story cape style house with a 2 car garage. Because of the sloping
landscape we will also have to include a walk-out basement in the design.
We would expect the design to include 2 bedrooms, 2 full bathrooms, living
room,•dining room, family room, and den at approximately 2200 sq ft of
living space. We hope to also have a deck overlooking the back yard.
