The existing system was installed based on an incorrect property line location resulting in the leach filed extending into the Right-of-Way for Craigville Beach Road. A variance request from the setback to a property line, 310 CMR 15.211 is being requested. This regulation requires a 10 foot setback from a property line to a leaching facility. A 7 foot variance is being requested; a minimum 3 foot setback to the property line will be maintained. This variance request is for a physical setback only. The variance request procedures are detailed in the Town of Barnstable Code (which is available on-line), including: - Filing of a variance request form, four copies of the revised plans, including details regarding design data, etc. - Notification to abutter's at least ten days before the hearing -The variance application form must include the reason for the variance request. The next scheduled Board of Health meeting will be held on Tuesday November 13th at 3:00, at Town Hall in the Second Floor Hearing Room, 367 Main Street Hyannis. I am not advocating a variance as I do not have enough information regarding this case. (i.e. Why was it installed improperly?What will the capacity of the revised system now proposed?
