The variances granted are: • 310 CMR 15.02.(7) To remove five feet of impervious soils around the system in lieu of the required ten (10) feet. • Section 1.18 To install a leaching facility which is 19 feet wide in lieu of maximum limit of 12 feet. (1) The septic system shall be installed in strict accordance with the submitted plans dated September 28, 1995. (2) The designing engineer shall supervise the installation of the onsite sewage disposal system and shall certify in writing to the Board of Health that the system was installed in strict accordance with the submitted plans dated September 28, 1.995. (3) The applicant shall receive the approval of the Town of Barnstable Conservation Commission. Sewing rooms, dens, ( ) office rooms, sleeping lofts, and similar-type rooms are considered bedrooms according to the Massachusetts Department of Environmental Protection. (6) The reconstructed dwelling shall not contain any more rooms than there are presently. (7) The dwelling shall be connected to public water. (8) The dwelling shall be connected to town sewer when the Board determines it's availability. (9) This variance expires October 1, 1996. The variances are granted because the existing cesspools are located significantly closer to the watercourse and are in all probability sitting in the groundwater table.
