The variances are granted with the following conditions: (1) No more than ten (10) bedrooms maximum are authorized at this property. Dens, study rooms, offices, finished attics, sleeping lofts, and similar-type rooms are considered "bedrooms" according to the MA Department of Environmental Protection. (2) The applicant shall record a properly worded deed restriction, signed by the owner of the property, at the Barnstable County Registry of Deeds restricting the property to ten (10) bedrooms maximum. A copy of the recorded deed restriction shall be submitted to the Health Agent prior to obtaining a disposal works construction permit. (3) The system shall be installed in strict accordance with the engineered plans dated December 21, 2007 and revised date of February 14, 2008. (4) The designing engineer shall supervise the construction of the onsite sewage disposal system and shall certify in writing to the Board of Health that the system was installed in substantial compliance with the submitted plans dated December 21, 2007 and revised date of February 14, 2008. (5) The wastewater effluent shall be tested quarterly for the first two years of operation. After the initial two years, the applicant may request a re- evaluation of the monitoring testing needs. (7) The applicant shall submit a copy of the signed two-year Operation and Maintenance Agreement (O&M) between the contractor and the homeowner to the Board of Health.
