You are granted variances, on behalf of your client, Alice Fardy, Trustee for
Ocean View Motel, to construct and utilize an innovative/alternative (I/A) nitrogen
reduction system at 966 Craigville Beach Road, Centerville, Massachusetts.
The variances granted are as follows:
310 CMR 15.211: The soil absorption system will be located 0.6 feet away from the
property line, in lieu of the ten (10)feet minimum setback required.
310 CMR 15.211: The pump chamber will be located 0.5 feet away from the property
line, in lieu of the ten (10)feet minimum setback required.
310 CMR 15.211: The septic tank will be located 3.0 feet away from the property line,
in lieu of the ten (10)feet minimum setback required.
310 CMR 15.211: The soil absorption system will be located 5.1 feet away from
the foundation or crawl space, in lieu of the twenty (20)feet
minimum setback required.

Section 360-1 Town of Barnstable Code: To construct a sewage disposal system
55.8 feet away from a salt water marsh, in lieu of the minimum 100
feet separation distance required.
The variances are granted with the following conditions:
(1) No more than ten (10) bedrooms maximum are authorized at this
property. Dens, study rooms, offices, finished attics, sleeping lofts, and
similar-type rooms are considered "bedrooms" according to the MA
Department of Environmental Protection.
(2) The applicant shall record a properly worded deed restriction, signed by
the owner of the property, at the Barnstable County Registry of Deeds
restricting the property to ten (10) bedrooms maximum. A copy of the
recorded deed restriction shall be submitted to the Health Agent prior to
obtaining a disposal works construction permit.
(3) The system shall be installed in strict accordance with the engineered
plans dated December 21, 2007 and revised date of February 14, 2008.
(4) The designing engineer shall supervise the construction of the onsite
sewage disposal system and shall certify in writing to the Board of Health
that the system was installed in substantial compliance with the submitted
plans dated December 21, 2007 and revised date of February 14, 2008.
(5) The wastewater effluent shall be tested quarterly for the first two years of
operation. After the initial two years, the applicant may request a re-
evaluation of the monitoring testing needs.
(6) The effluent shall be tested for total suspended solids, BOD, Nitrate, TKN
and total Nitrogen.
(7) The applicant shall submit a copy of the signed two-year Operation and
Maintenance Agreement (O&M) between the contractor and the
homeowner to the Board of Health.
(8) Prior to the issuance of any permits, the applicant shall provide,verification
to the Board of Health that this decision letter dated February 27, 2008, in
its entirety, has been recorded at the Barnstable County Registry of
Deeds.
(9) You testified that this is a nine unit seasonal motel, with a year-round
manager'slowner's quarters (a one-bedroom unit). Any change of use
whether from seasonal to year-round use; or conversion from a motel to

Fardys are seeking to enhW the existing deck and exread it along the westerly edge of the property,

staircase as a second means of egt+ess in the northwestea'ly Corraear of the property.
5. The property is located in a Residence C Zoning Distract.It bits been the subject of three different
requests for zovbg relief.Two requests were granted and the third was withdrawn. Details of that past
zonifig history are aomained witbin the records of the Zoning Board of Appeals Wes and are briefly
explained in the mmmandin stibmittcd on behalf of the application.

abats wetland.By enclosing this portion of the existing deck it will allow the Fardys to h=ease the size
of the owner's bedroom and kitchens.These rooms as they exist are= all and very cramped.The

8. The extension of the deck along the westerly edge of the propeM will allow the Fardys au area to sat in
private.It will also inswre them benear access to the Spiral staircase ire case Of an er Mftcy.Although
the enlarged deck will increase the nonconformity ity in the side yard setback,it is over an existing
buBdtead that pteseatdy extends into said setback Also,the property located on the lot next door has
been built a significant distance from rho property liar. The.uet effect of the:locWoa of the benitliu.a on,
the Fardys property and the loeatloar of the building west of the Fardys property is that the distance
between the two buildings is appmximataly equal to or greater than the combination of the side yard
se fucks requind for both properties.That is to say that the buildings are approximately equal to or

12. A Regetesc for a Determination of Applicability was processed with the Conservation Commission. On
7astnaty 21.2W5 the Cottmissunt issued its Duration of Applicability anai approved the plans for
the enclosure and expansion as only having minor implication on the wetlands. Bicvadon of the
proposed deck,enclosure,and new deck vme submitted to the Commission and cries have been
. mporated into the Board's Me;. The plan approved by the Cwsnvatien Commission is identical to
float appmved by Site Plan Review and that submitted to the Boatel.

Following the review of the above-referenced Notice of Intent and based on the information provided
in this application and presented at the public hearing,this Commission finds that the areas in which
work is proposed is significant to the following interests of the Wetlands Protection Act.Check all that

C. General Conditions Under Massachusetts Wetlands Protection Act
(only applicable to approved projects)
1. Failure to comply with all conditions stated herein,and with all related statutes and other regulatory
measures,shall be deemed cause to revoke or modify this Order. j
2. The Order does not grant any property rights or any exclusive privileges;it does not authorize any
injury to private property or invasion of private rights.
3. This Order does not relieve the permittee or any other person of the necessity of complying with all
other applicable federal,state,or local statutes,ordinances,bylaws,or regulations.
4. The work authorized hereunder shall be completed within three years from the date of this Order
unless either of the following apply:
a. the work is a maintenance dredging project as provided for in the Act;or
b. the time for completion has been extended to a specified date more than three years,but less
than five years,from the date of issuance.If this Order is intended to be valid for more than three
years,the extension date and the special circumstances warranting the extended time period are
set forth as a special condition in this Order.
5. This Order may be extended by the issuing authority for one or more periods of up to three years each
upon application to the issuing authority at least 30 days prior to the expiration date of the Order.
i 6. Any fill used in connection with this project shall be clean fill.Any fill shall contain no trash,refuse,
rubbish,or debris,including but not limited to lumber,bricks,plaster,wire,lath,paper,cardboard,
j pipe,tires,ashes,refrigerators,motor vehicles,or parts of any of the foregoing.
i
7. This Order is not final until all administrative appeal periods from this Order have elapsed,or if such
an appeal has been taken,until all proceedings before the Department have been completed.
8. No work shall be undertaken until the Order has become final and then has been recorded in the
( Registry of Deeds or the Land Court for the district in which the land is located,within the chain of title
of the affected property.In the case of recorded land,the Final Order shall also be noted in the
{ Registry's Grantor Index under the name of the owner of the land upon which the proposed worts is to
be done. In the case of the registered land,the Final Order shall also be noted on the Land Court
Certificate of Title of the owner of the land upon which the proposed work is done,The recording
information shall be submitted to this Conservation Commission on the form at the end of this Order,

C. General Conditions Under Massachusetts Wetlands Protection Act
10. Where the Department of Environmental Protection is requested to issue a Superseding Order,the
Conservation Commission shall be a party to all agency proceedings and hearings before DEP.
i
11. Upon completion of the work described herein,the applicant shall Submit a Request for Certificate of
l
Compliance(WPA Form 8A)to the Conservation Commission.
12. The work shall conform to the plans and special conditions referenced in this order.
13. Any change to the plans identified in Condition#12 above shall require the applicant to inquire of the
Conservation Commission in writing whether the change is significant enough to require the filing of a
new Notice of Intent_
I14. The Agent or members of the Conservation Commission and the Department of Environmental
Protection shall have the right to enter and inspect the area subject to this Order at reasonable hours
to evaluate compliance with the conditions stated in this Order,and may require the submittal of any
' data deemed necessary by the Conservation Commission or Department for that evaluation.

15. This Order of Conditions shall apply to any successor in Interest or successor in control of the
property subject to this Order and to any contractor or other person performing work conditioned by
this Order.
16. Prior to the start of work,and if the project involves work adjacent to a Bordering Vegetated Wetland,
i the boundary of the wetland in the vicinity of the proposed work area shall be marked by wooden
stakes or flagging.Once in place,the wetland boundary markers shall be maintained until a Certificate
of Compliance has been issued by the Conservation Commission.
17. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully
stabilized with vegetation or other means.At no time shall sediments be deposited in a wetland or
water body.During construction,the applicant or his/her designee shall Inspect the erosion controls
i on a daily basis and shall remove accumulated sediments as needed.The applicant shall Immediately
control any erosion problems that occur at the site and shall also immediately notify the Conservation
i Commission,which reserves the right to require additional erosion and/or damage prevention controls
i it may deem necessary.Sedimentation barriers shall serve as the limit of work unless another limit of
work line has been approved by this Order.
18. All work associated with this Order is required to comply with the Massachusetts Stormwater Policy

H. Prior to the start of work,the following conditions shall be satisfied:
1. Within one month of receipt of this Order of Conditions and prior to the commencement of any work
approved herein,General Condition number 8(recording requirement)on page 3 shall be complied with.
2. It is the responsibility of the applicant,the owner and/or successor(s)and the project contractors to ensure
that all conditions of this Order are complied with The applicant shall provide copies of the Order of
Conditions and approved plans and an approved revisions thereof)to project contractors prior to the start

F. Appeals
The applicant,the owner,any person aggrieved-by this Order,any owner of land abutting the land subject
to this Order,or-any ten residents of the city or town in which such land is located,are hereby notified of
their right to request the appropriate DEP Regional Office to issue a Superseding Order of Conditions.
The request must be made by certified mail or hand delivery to the Department,with the appropriate filing
fee and's completed Request of Departmental Action Fee Transmittal Form,as provided in 310 CMR
10.03(7)within ten business days from the date of issuance of this Order.A copy of the request shall at
the same time be sent by certified mail or hand delivery to the Conservation Commission and to the
applicant,if he/she is not the appellant Any appellants seeking to appeal the Department's Superseding
Order associated with this appeal will be required to demonstrate prior participation in the review of this project.
Previous participation In the permit proceeding means the submission of written Information to the
Conservation Commission prior to the close of the public hearing,requesting a Superseding Order or
Determination,or providing written information to the Department prior to issuance of a Superseding Order
