It was demonstrated that this parcel floods during storm events. tt is recommended that the septic system should be redesigned to minimize or eliminate the infiltration of flood waters into the system and discharges from the system into flood waters in accordance with the Board of Health Regulation PART Vlli SECTION 3.00, adopted on November 8, 1977. This extension is granted because the applicant was delayed due to an abutter's protracted appeal of the Barnstable Conservat(on Commission's jurisdiction. The case was heard by the Honorable Gary Nickerson in Barnstable in Barnstable Superior Court on November 6, 2001. The applicant stated that he has been diligently permitting process during the past thirty-two months. ge tly pursuing the Last year,the variances were granted because the designing engineer was able to re- design the septic system plan to locate the system more than one-hundred (100)feet away from the extreme high water mark. In addition, the plan incorporates the use of innovative/alternative technology. I inspected the site on several occasions (from May—July 2002) for: 1) inspection of the initial excavation, 2) inspection of the construction of the concrete retaining wall and associated footings and waterproofing, 3) inspection of the placement of the Elgen "in-drain" bio-mat leaching units, and 4) inspection for final backfill of the systems. The final inspection was conducted on July 16, 2002. All workmanship and construction has been completed satisfactorily. Additionally, the septic system was installed in accordance with the approved design plan, as per the latest revision dated March 24, 2001. I inspected the site on several occasions (from May—July 2002) for: 1) inspection of the initial excavation, 2) inspection of the construction of the concrete retaining wall and associated footings and waterproofing, 3) inspection of the placement of the Elgen "in-drain" bio-mat leaching units, and 4) inspection for final backfill of the systems. The final inspection was conducted on July 16, 2002. All workmanship and construction has been completed satisfactorily. Additionally, the septic system was installed in accordance with the approved design plan, as per the latest revision dated March 24, 2001. The variances granted are as follows: • Part VIII, SECTION 9:00: To construct an onsite sewage disposal system leaching facility in an area where there are not four (4) feet of naturally occurring pervious soils above the maximum adjusted groundwater table. • 310 CMR 15.255 (2) (g): To install a leaching facility only seven (7) feet away from a retaining wall, in lieu of the ten (10) feet setback required. • 310 CMR 15.211: To install a retaining wall seven (7) feet away from the property line in lieu of the ten (10) feet minimum setback required. These variances were granted with the following conditions: (1) The proposed septic system with an "elgen in-drain" bio-mat leaching facility shall be installed in strict accordance with the submitted plans dated revised June 14, 2000. (2) The designing engineer shall supervise the construction of the onsite sewage disposal system and shall certify in writing to the Board of Health drake a I that the system was installed in accordance with the revised plans dated June 14, 2000. (3) No more than four (4) bedrooms are authorized at this property. Dens, study rooms, finished attics, sleeping lofts, and similar type rooms are considered bedrooms according to MA Department of Environmental Protection. (4) The applicant shall record a properly worded deed restriction document at the Barnstable County Registry of Deeds limiting the number of bedrooms to four (4) at this property. A copy of the recorded deed restriction shall be submitted to the Board of Health prior to obtaining a disposal works construction permit. (5) The dwelling shall be connected to public water supply. (6) This variance expires in one year on July 1, 2001. These variances are granted because the designing engineer was able to re- design the septic system plan to locate the system one-hundred (100) feet away from the extreme high water mark. In addition, the plan incorporates the use of innovative alternative technology. These revisions to the original plan has improved the effectiveness of the system and has eliminated the need for two previously requested variances in an attempt to provide more protection to the wetlands and groundwater in this area.
