Dear Members of the Board of Health:
In advance of our hearing scheduled for June 12, 2000 and acting as agent(see enclosure#1)for the
owners of the property, I wish to submit the following information to update the file for the Barnstable
Board of Health. I have numbered all referenced enclosures and bound them in chronological order to ease
+ ';your review.
Background
At our March 13,2000,BOH hearing for initial review of the project,it was decided that a site visit would
be required. The site visit was scheduled for April 7,2000. The hearing was continued to April 10,2000.
At the April 7, site visit Ed Pesce P.E. and I detailed the relevant characteristics of the site,proposed septic
location and resource boundaries.
The April 10,BOH Hearing was continued to June 12,2000,based on the relevance of the Barnstable
Conservation Commission's review of the project at their April 11,2000 hearing and the importance of an
r anticipated delineation of the parcel by the Coastal Zone Management Coastal Geologist,Rebecca Haney.
At the April 11 meeting with Conservation,the Commission expressed their appreciation for the extreme
detail of the on-site investigation, as well as the magnitude and high quality of the information which I have
assembled. They expressed an intention to accept the project as proposed and closed the hearing pending
the receipt and admission of a favorable CZM review and delineation.
On April 27,1 received a copy of the(see enclosure#2)letter dated April 25,from Thomas A. McKean
which stated the file was incomplete.From speaking with Mr.McKean,I learned the letter had been"sent
on advice from legal council"and that there was a concern over a perceived lack of activity on the file as
well as the number of bedrooms. In my letter dated May 10(see enclosure#3),I was able to properly
respond to the issues of Mr.McKean's letter. I delivered that letter to the Board of Health office and it was
accepted on May 17.
On May 22,I received a copy(see enclosure#4)of the CZM letter concerning the State Geologist's
investigation and determination of the parcel.
On May 23,I was informed by Conservation that my final hearing, originally scheduled for that evening,
would be postponed until June 6, due to lack of the required number of Board members for a quorum.

Relevant Changes
Ed Pesce and I have been working to identify and satisfy the concerns of the Board's members. In light of
this information,we have made further improvements to the proposed plan. We believe these
improvements meet all the requirements necessary to allow the construction of a four bedroom single
family home on this location(See plan dated 5/24/00 full size[attached] and small size[see enclosure#5]).
A relocated and vaulted Title 5 sewage disposal system(plan dated 5/24/00)has been designed to
maximize the separation from the resource area.
The proposed design achieves the required 100' separation from wetlands for the entire primary leaching
system and increases the separation from wetlands for the reserve system from 78.5' as shown on the
previous configuration(plan dated 4/8/00) to 95.1' a net increase of over 16 feet of protection.
Specific variances from the Board of Health will still be required and they have been listed on the plan
dated 5/24/2000. They are detailed below:
• Barnstable Bylaw Part VIII, Section 9.00,Installation of onsite sewage disposal system on marginal
lots.
• Barnstable Bylaw Part VIII Section 1.00,Installation of S.A.S within 100'of a salt marsh(95.1' from a
reserve area).
The vaulted system, engineered in a linear configuration along the Southerly edge of the lot,allows us to
achieve the 100' separation from wetlands required to provide the maximum degree of environmental
protection under the Title 5 guidelines.

• Title 5 variance 310 CMR 15.211 (1)Distance from garage slab to edge of leaching(equal to 7.0 feet).
The foundation footprint and configuration of the proposed dwelling were changed to lower construction
cost, and compensate for the costs associated with installation of 104 linear feet of a reinforced poured
concrete retaining wall required by the vaulted septic system. These changes also comply with all Building
Department and Zoning setbacks.
Conclusion
As agent for the owner of this parcel.I have worked diligently to identify and satisfy the concern's of the
members of the respective Boards. I have received continuous help and support from the members of each
Board,their respective chair persons, agents,office personnel, and Mr. Ed Pesce. They have each proven to
be invaluable resources in this permitting process.
I believe that there is overwhelming evidence to support Coastal Geologist Rebecca Haney's findings. I
agree that the proposed project will not have and adverse effect on the resource area and"... the addition of
clean compatible fill to this area and the removal of debris found during construction should have a net
benefit...".

As the applicant, I believe that not allowing the requested variances would constitute a manifest injustice
against the current owners by limiting the land's potential use and severely decreasing it's perceived value.
Thereby,causing the current owners considerable financial hardship.
Furthermore,having made full disclosure that my wife and I intend to purchase and build our primary
home on this property once the project is permitted, I believe that not allowing the requested variances
would constitute a manifest injustice against the future owners by limiting the land's potential use.
1 have endeavored to produce the most protective plan possible for construction of a single family home
and installation of a Title 5 septic system on this property. I believe that the plan dated 5/24/00,and the
detailed research on which it is based offer a degree of protection to the environment which meets or
exceeds the requirements and intent of the Title 5 regulations.
After having spoken with Conservation Agent Rob Gatewood,I anticipate that on June 6, 2000,the
Barnstable Conservation Commission will admit the letter from State Geologist Rebecca Haney into the
record, close the hearing,and vote to approve the project with an order of conditions concerning the areas
outside the proposed work limits.
310 CMR regulation 15.401 of Title 5 states that: Variances may be granted only when, in the opinion of
the Board of Health, 1)Enforcement thereof,would do manifest injustice. 2)The applicant has proved that
the same degree of environmental protection required under this title can be achieved without strict
application of this particular provision.
During this painstaking investigation into the specific characteristics of this project. I have enlisted the full
services and consultative efforts of the all the available state and local town resources. Based on these
documented findings,I believe that not granting these variances would be in direct violation of the true
spirit and intent of the Environmental Code,as provided by Title 5 and the town of Barnstable Health
Regulations.
I hope this review and compilation of the relevant information regarding this project is helpful to the
members of the board in preparation for the June 12, 2000 Board of Health hearing and I thank you once
again for your continued support in this matter.

25,2000 -"RE: Variances Requested/1112 Craigville Beach Road".
During our 8:30 A.M phone conversation on April 27, 2000 concerning the status of this
file, you had stated that your legal counsel had expressed a concern over the lack of
activity on the file.
I wish to assure the Board of Health that the file was reviewed by the Conservation
Commission during their hearing on April 11,2000. At that hearing the application was
• closed pending a written review by CZM Geologist,Ms. Rebecca Haney.
Ms. Haney has informed me that her written review will be submitted on May 19,2000. I
anticipate that the Conservation Commission will close the case at their May 25 h hearing
and render a favorable decision shortly there after.
Furthermore, Mr. Pesce and I have been working diligently to identify and satisfy the
concerns of the Board's members. We have reviewed the relevant case files which you
were kind enough to share with me.
In light of this information, I believe we will be able to propose a Title V system which
• the board will feel meets all the acceptable criteria in order to allow construction of a four
bedroom single family home on this location.

I am responding to a request from the Conservation Commission to provide technical
assistance regarding resource delineations for the above-referenced project.
I participated in a site visit on March 13, 2000 with yourself; Steve McKenna, MCZM
Assistant Regional Coordinator for Cape Cod and the Islands; David Drake, the applicant;
representatives for the applicant, Megan Raymond and Paul Lelito from LEC Environmental
Consultants Inc.; and Andy Walsh from ENSR representing an abutter. As a result of this site visit,
additional information was requested regarding subsurface sediments at this site. Two additional
site visits were conducted on April 10,2000 with yourself,David Drake and Andy Walsh at the first
and yourself,David Drake and Megan Raymond at the second.
• As I explained at the site visits,MCZM's role is to provide the Commission with an
opinion regarding the resource delineations and functions in accordance with the definitions and
functions described in the Wetlands Protection Act Regulations @310 CMR 10.00, specifically,
beaches, coastal dunes,coastal banks, and floodplains. We can also provide suggestions
regarding alternatives that may reduce the impact of the proposed project on the beneficial
functions of the resources at this site and suggestions that may improve the ability of the project
to meet the applicants goals while protecting the resources. These recommendations are
provided for the proponent's and the Commission's consideration; they are not requirements.
The regulatory decisions regarding permittability of the project under the Wetlands Protection
Act are up to the Commission and the Department of Environmental Protection.

Resource Delineation
At the site visits I examined subsurface sediments in over 30 shallow holes located both near
the coastal dune boundary determined at my second site visit and in areas on both sides of the
. proposed line, with a focus on the sediments within the proposed limit of work. In addition to
information gathered at the site visit, I have reviewed the following documents:
• Notice of Intent for the proposed project, received by the Commission January 24,2000
• Site Plan "D" accompanying the Notice of Intent dated'January 22, 2000 and subsequent
revised versions dated February 14, 2000,March 20,2000, and April 8,2000.

The site is currently very well vegetated, with varying types of vegetation ranging from
beach grass to woody shrubs and trees. The subsurface investigations revealed two primary types of
• sediments present within the work area; wind or wave deposited sediments and artificial fill.
Although it was suggested that the artificial fill might fit the definition of a coastal dune, it does not
have the typical characteristics of a coastal dune as described in the Wetlands Protection Act
Regulations @310 CMR 10.28. These important characteristics include the following functions:
continual two-way exchange of sediment between the coastal beach and back to the landform (i.e.
• aeolian processes), conforming and reshaping to natural wind and water flow patterns, and
migration of the landform(dune)landward or laterally. The artificial fill does not show any signs of
migrating, moving, continual exchange of sediment in multiple directions, or conforming and
reshaping to natural wind and water patterns in a manner consistent with dune behavior. Therefore,
I do not believe the artificial fill at this should be delineated as a coastal dune under the Wetlands
Protection Act Regulations.
The second type of sediments observed at this site were well-sorted sediments with a
relatively high percentage of quartz grains. Based on these characteristics and the site morphology,
I determined these sediments to be wind or wave deposited sediments that met the definition of a
coastal dune. Subsurface investigations within the coastal dune sediments ranged from 6 to 52
• inches. There was generally a vegetative mat and organic layer present at the surface of each hole
ranging from 2 to 4 inches in thickness. Observation of the subsurface sediments also revealed the
development of a soil profile in several areas. Evidence of some human alteration was noted within
the coastal dune, such as the presence of cement blocks and chunks of pavement. I participated in
the delineation of the boundary between the coastal dunes and the artificial fill on April 10, 2000,

which was added to the plan dated April 8, 2000. The ability of the coastal dunes at this site to
function in providing storm damage protection and flood control to landward areas is limited due to
the dense vegetation, thick vegetative and organic mat, and its location in the A zone as mapped by
• FEMA. The presence of a developed soil profile indicates that this dune area has been relatively
stable for quite a while; I estimate that its been relatively stable since the houses located southwest
of the lot were constructed.
Based on the limited function and stability of the coastal dunes at this site, I do not believe
the proposed project will have an adverse effect on the coastal dune resource area. Furthermore, the
addition of clean compatible fill to this area and the removal of debris found during construction
should have a net benefit to the dunes at this site.

Furthermore,Mr.Pesce and I have been working diligently to identify and satisfy the

Dear Mr. McKean:
On behalf of Mr. Edward Pesce, P.E., I am submitting the accompanying amended"Plan D"for
1112 Craigville Beach Road, Centerville. The improvements we have made to our sewage
disposal system after meeting with and receiving approval by the Board members at our June 12
hearing are as follows:
• We have changed the leaching system to incorporate an I/A leaching system—Elgen
In-Drain Bio-Matt leaching system using the Type`B"module in two 3'x 40'
trenches with 2' of crushed stone in between.
(This technology allows us over 100' of separation from the wetlands and eliminates the.need for
a variance on this item. This design also utilizes the 25%credit(reduction) in leaching area, as
allowed in Title 5.)
• We relocated the leaching system 10.3' away from the garage.
(The revised leaching system and configuration allows us over 10' of separation from the garage
and 20'of separation from the main house thereby eliminating the need for a variance on this
item.)
• We were able to increase separation between the retaining wall and the lot line from
the previous 5' to a distance of 7' of separation.
• Also,we were able to increase separation between the retaining wail and the leaching
system from the previous 5' to a distance of 7' of separation.
As you can clearly see.from the amended plan dated 6/14/00,based on the June 12, Board of
Health approval of our overall plan, we have implemented the Board's requests, improved the
effectiveness of the system and eliminated the need for two of the previously required variances.
Again, I would like to thank you,your staff and the board members for the help and support you
have given throughout this process. I look forward to working with you again.
