James Veara Violation by email: ejvkzisson-veara.com 1456 Falmouth Rd, Centerville NOTICE OF VIOLATION OF CODE OF MASSACHUSETTS REGULATIONS The Cumberland Farms property at 1456 Falmouth Road, Centerville,MA has been used as a staging area for soil fill since August 2016. There are two large piles of fill that are continuously exposed to the elements. Attempts to keep the piles covered with vinyl sheeting have occurred but the covers do not last for extended periods of time. The following violation of the Code of Massachusetts Regulations, Chapter 310, Section 7.09 Dust, Odor, Construction,Demolition was observed: 310 CMR 7.09(3)and (4) Storage of soil fill with no provisions for dust control. You have been issued a warning notice to cover and keep covered all potential sources of dust emissions at 1456 Falmouth Rd, Centerville,MA. Any future violations will result in a fine of$100.00 per violation. James Veara' Subject: RE: Cumberland Farms Good Morning Attorney Veara, I am writing again concerning the storage of fill on the property located at 1456 Falmouth Rd in Centerville. The West Main St project is now complete and is fully operational yet I am still receiving complaints and.inquiries regarding the use of the Falmouth Rd property. While I am aware that you indicated the soil would be removed this Jan. (pending approval from Bourne regarding a proposal there), I am now hearing that the soil deposits on Falmouth Rd have recently grown in scope. This is difficult to understand as the West Main St project is completed. No additional activity should be occurring on the Falmouth Rd site. Importing soil from other sites and staging equipment here is not allowed. I am now concerned that the soil that was once covered with tarps is now completely exposed to the elements. Fortunately,we have had some wet weather of late preventing dangerous sandstorm conditions but in the event that NE weather changes again,those conditions may change as well. As Jan.is quickly coming to a close,the removal of the soil at 1456 Falmouth Road should commence ASAP and be completed no later than Feb 1,2017 (weather permitting of course). Please know that the soil currently in Centerville is soil that does not exceed reportable or risk standards as outlined by the Mass DEP. Moreover, the soil is covered with poly sheeting to prevent the soil from getting wet-freezing for reuse and for erosion control.. This soil is intended for reuse at an upcoming Bourne raze and rebuild project that Cumberland will be undertaking. That project will require a large amount of fill material and this soil will be utilized in that regard. Cumberland is presently in the process of seeking approvals for its Bourne project and upon receipt of those approvals, will then close on the acquisition of the parcel. An exact timetable is unknown.and more will be known following a meeting in Bourne in mid-January 2017. 3/16/2017 i ' Message Page 2 of 3 Please know that this soil is there temporarily and.the soil.will.be immediately removed to Bourne once Cumberland closes on the real estate transaction. During the tank removals no contaminated soil was found, so we did not make any notifications. When the contractor removed the pumps and piping a leak was discovered by the LSP. They notified us of the spill and had already received approval from DEP. I received notification from the DEP on 12/16/08 of the planned clean-up. The TOB and Board of Health were also copied from DEP on that letter. If you need any additional information please let me know. ASSOCIATES SEPTEMBER 30, 1994 SUMMARY: To control the stormwater runoff from the site and to allow for the on-site recharge of the collected stormwater, the enclosed calculations were prepared in order to determine the quantity of runoff as well as the size of the in-ground stormwater disposal system. The system is designed to accommodate all the runoff from a 25 -Year return rainfall event. The Rational Method was used to determine the runoff to the two collection points. Catch basins with LeBaron Traps will be provided to collect sediment and any oil drops, etc. prior to delivery to the in-ground disposal system. The method for evaluating the size of the in-ground system is currently used in the Town of Marshfield and on Cape Cod. The method assumes that only half of the system's infiltration capabilities are available until the system is full. The calculations indicate that a leaching gallery system consisting of 5 sections with 4 Ft. of stone surrounding the structures will not fill during the 25 - Year event. A handwash sink shall be provided per the State Sanitary.Code,Article X. (2)The same inspection report revealed that only a double compartment sink was provided. A triple compartment sink is required per the State Sanitary Code, Article X. (3) The same inspection report revealed that there were several doors left open and many flies were observed in the food areas. Electronic air curtains shall be provided or screen doors shall be provided per the State Sanitary Code, Article X. (4) Only one employee restroom was provided. Figure 1 is a locus map showing the location of the site. The potential traffic impacts will be quantified and evaluated. Mitigation measures will be recommended as ' appropriate. Route 28 is a state highway with strip commercial development directly adjacent to the roadway. ' Away from Route 28, the area is primarily residential. Traffic is highly seasonal with summer volumes much higher than winter volumes. The existing Gulf gas station has two access driveways to Route 28. The west access driveway is immediately across from northbound Phinney's Lane, and the east access driveway is located on the corner of Route 28 and southbound Phinney's Lane. ' The proposed gas station and convenience store will occupy approximately 2400 square feet. The site will be served by twelve parking spaces, including one space for handicap vehicles. A site location map is shown in Figure 2. Existing traffic volumes at the intersection of Phinney's Lane and Route 28 were obtained through the Town of Barnstable Engineering Office from 1990 PM peak period counts done by ' the Cape Cod Commission. These volumes used as they reflect peak summer volumes and were adjusted to 1994 volumes using a growth rate from the Cape Cod Traffic Counting Report 1992, published by the Cape Cod Commission. Accident data was also acquired from the Town ' Engineering Office. An extract from the Cape Cod Traffic Counting Report 1993, dated November 1993 was also available for reference. Traffic analysis contained in this report is based on the data available through the Town of Barnstable and our own turning movement counts at a Cumberland Farms store similar to the project site. Trip generation rates were developed form information provided by Cumberland Farms, our counts, and Trip Generation, ' 5th Edition, published by the Institute of Transportation Engineers (ITE). Existing Traffic Volumes The existing traffic and turning movement volumes at the intersection of Phinney's Lane and Route 28 were acquired from 1990 Summer PM peak hour counts performed by the Cape Cod Commission and are shown in Figure 3. The summer PM peak hour represents the highest hourly volume in the calendar year. PM peak hour turning movements into and out of the Gulf ' gas station were based on counts performed by Vollmer on March 8, 1994. The majority of trips entering this site (86%) are pass by trips which are taken out of the existing traffic stream. This information was adjusted for seasonal traffic levels. The existing turning movements are ' shown in Figure 3. Approximately 86% of these trips are pass-by trips. This information is based on Cumberland Farms average ' transaction records and has been seasonally adjusted. Existing Level of Service Analysis ' Level of Service is a qualitative measure describing operational conditions within a traffic stream. Six levels of service are used to describe the quality of traffic flow for any type of facility, with level of service A representing the best operating conditions and level of service ' F representing the worst. For unsignalized intersections, the measure of effectiveness used to determine the level of service is reserve capacity. The reserve capacity of a conflicting movement in an unsignalized intersection is defined as the capacity of the movement less the ' vehicular demand of that movement. Level of service F for unsignalized intersections represents a situation when demand exceeds capacity. Level of service F is characterized by long delays and heavy queuing. Table 1, below, shows the reserve capacity limits for each level of service. The Phinney's Lane/Route 28 intersection was analyzed as two separate intersections because of the offset on Route 28 between the north and south approaches of Phinney's Lane. The ' access drives to the Gulf station were analyzed each with one intersection. Table 2 summarizes the level of service analysis and the reserve capacity for each conflicting traffic movement. The analysis indicates that the intersections operate at level of service F under the existing conditions. ' Field observations confirm the capacity problems at this location. Left turn movements at these intersections incurred long delays while a continuous stream of traffic traveled on Route 28. Accident data ' obtained from the Town of Barnstable for the four years prior to 1991, however, indicate that this intersection is a high accident location. July reported the most frequent number of ' accidents, coinciding with its being the highest traffic volume month. Less than ten percent of accidents (six) were directly related to vehicles entering or exiting the Gulf station and, of those, four were caused by vehicles turning left from the station's east exit to Route 28 eastbound. ' Tables 3 and 4 detail the accident data. The site is located at the intersection of Falmouth Street (Route 28) and Phinney's Lane in Centerville, Massachusetts. The proposed convenience store will occupy approximately 2400 square feet and the entire site occupies 28,882 square feet (0.66 acres). The site plan was prepared by the Cumberland Farms Engineering Office and a copy of the plan is included with this report. The site will be served by twelve parking spaces, ' including one space for handicap vehicles. The proposed site plan does not change any of the access driveways. Trip Generation ' The trip generation potential of the proposed site was determined through several steps using traffic count data from an existing Cumberland Farms store, ITE Trip Generation, and monthly traffic volume adjustment factors developed by the Cape Cod Commission. Trip generation was evaluated using turning movement counts conducted on February 10, 1994 ' at an existing Cumberland Farms store/gas station on Route 28 in Waquoit, Massachusetts. The proposed site and the store in Waquoit are both located west of the central commercial area of Barnstable, Massachusetts. This store is equivalent to the proposed store, but slightly smaller (2064 square feet compared to 2400 square feet). The count volumes were then adjusted for seasonal traffic patterns based on data published by the Cape Cod Commission. These volumes were compared with the ITE Trip Generation rates for a convenience store/gas station of similar size. The seasonally adjusted count data was determined to be usable in its current form because it fell within the range of trip generation rates for a store/gas station of the same size. The trip generation rates for the Cumberland Farms in Waquoit were then adjusted to account ' for the increase in store size using the average trip generation rate used in the ITE Trip Generation. Due to the consistency between AM and PM volumes, the directional distribution of Route 28 traffic, pass-by trips, and the side of the road on which the site is located, the AM ' volumes will be used with the major flow direction heading east instead of west. The total number of PM peak hour trip ends at the proposed site will be 147 trip ends with 74 trips entering the site and 73 trips exiting the site. Not all of the trips, however, represent new trips to the site. Currently 88 vehicles enter or exit the site during the PM peak hour. In addition, the convenience nature of the site attracts impulse trips. Based on information provided in ITE Trip Generation and observed operating conditions, approximately 70 percent of all trips will be pass-by impulse trips. Therefore, there will be an additional 29 trips entering and exiting the site. Of these additional trips, 13 trips will be impulse trips, and 16 trips will be newly generated by the site. A comparison of existing and future trips is shown in Table 5. ' 94202 9407373-S.NAH 8 Driveway assignment at the proposed site was based on the driveway use at the existing Gulf gas station. The PM peak hour turning movement volumes generated by the site are shown in ' Figure 4. Traffic generated by the site for future conditions was determined as described above. Future turning ' movement volumes are shown in Figure 5. ' There will be 800 daily trips to the site for the future condition. Seventy percent (70%) of these trips will be pass-by trips. There will be approximately 210 newly generated site specific trips each day during the summer peak. This information is based on Cumberland Farms forecasted customers and has been seasonally adjusted. ' Future Level of Service Analysis Capacity analysis was completed for the future build condition with the existing site access ' layout and for a future build condition with recommended mitigation for safety improvements. The results of the level of service analysis are shown in Table 2. There is no significant change in the level of service from the existing condition to the build condition. The following ' highlights the changes between the existing condition and the future build condition. At the west intersection of Phinney's Lane and Route 28, there is a minimal decrease in reserve ' capacity for any of the turning movements (21 vehicle reduction maximum decrease). Other turning movements remain at level of service F. At the east intersection of Phinney's Lane and Route 28, all movements remain at level of ' service F, with a minimal decrease in reserve capacity (17 vehicle reduction maximum decrease). Overall, the impact of the proposed development will not be noticeable to the average ' driver, as the level of service at both intersections is F under both existing and future conditions, and delays do not increase significantly. Mitigation ' The impacts of the redevelopment of the site do not necessitate mitigative measures from a traffic operations standpoint, but measures can be implemented to improve safety at this location and decrease accident risks. The recommended mitigation for the site would involve converting ' the east driveway to an entrance for westbound traffic only. At least four accidents have occurred as a result of vehicles exiting from this driveway. This measure will require all vehicles to exit the site at the west intersection with Phinney's Lane, as well as require all ' eastbound vehicles to use the west driveway. Under the proposed mitigative measure, vehicles turning right from Phinney's Lane to Route 28 westbound will be able to concern themselves with finding an acceptable gap in the traffic stream without conflicting with other vehicles exiting the east driveway or vehicles turning left into the site. The turning movement volumes for the build with/mitigation condition are shown in Figure 6. The traffic operations at this intersection will improve at the east intersection of Phinney's Lane, while there will be slightly more impact at the west intersection. The results of this analysis is shown in Table 2. ' Conclusions There will be no significant impact to the surrounding street network as a result of redeveloping the existing Gulf gas station to a Cumberland Farms convenience store/gas station. The expanded use of the site is expected to generate a net increase of 33 vehicle trips during the ' critical PM peak hour. The traffic operations at this location during the summer PM peak hour is currently at levels of service F and will require major changes to achieve improvements in operating conditions. These types of improvements are beyond the scope of what is necessary as mitigation for this development. The Town of Barnstable in association with the Massachusetts Highway Department has issued a Request for Proposals (RFP) for improvements at two locations on Route 28, including the intersection at Phinney's Lane (Old Stage Road is ' the other location). The only mitigation necessary is to make the east driveway of the site an entrance only. This will improve the safety of the area and help to reduce accident risks. The MCP, which took effect in October 1988, is a set of regulations which spells out specific site cleanup requirements. Of the 22 sites, 9 were given "priority" designations; and 10 were given "non-priority" status. The remaining three sites were reclassified due to additional information received by the department. DEP' s Southeast regional office has classified 407 sites to date: 159 priority and 248 non-priority. Other confirmed hazardous waste disposal sites will be classified after further Department review. Priority sites pose the greatest potential threat to public health or the environment and are the focus of agency resources. Non-priority sites may qualify for waivers from DEP -approvals, required throughout the cleanup process, allow ing.. .work to ;move forward and may be subject to Department audit upon completion. Amendments to the State Superfund law, approved by voters in 1986 , gave DEP specific timetables for locating, assessing and cleaning up hazardous waste sites. During September 1988 , IEP, Inc. , provided environmental guidance in the removal of three (3) abandoned underground storage tanks discovered beneath a pump island. Approximately one-hundred (100) cubic yards of gasoline contaminated soil was excavated, and photoionization detector levels in the stockpiled contaminated soil measured one-hundred (100) ppm. The excavation depth was approximately ten (10) feet below grade, and ground water was not encountered. According to information available at this time, it is believed that additional gasoline contaminated soil still remains in the excavated area. These conditions constitute a release of oil or hazardous material at or from the site. The prevention and/or mitigation of such a release is governed by M.G.L. , Chapter 21E, the "Massachusetts Oil and Hazardous Material Release, Prevention and Response Act, " and 310 CMR 40.000, "Massachusetts Contingency Plan" (MCP) . On February 7 , .1989, at approximately 2:00 P.M. , a Department representative verbally notified Donald Beck of Cumberland Farms, Inc. 's, responsibility for the release. He accepted responsibility on behalf .of Cumberland Farms at that time. Y a 2 - This letter is to inform you that: 1.
