On ...... 6_ __..._.._..._..._._...._......_.......... 19$A......._..., The Board of Appeals found Mr. Scanzillo presented his petition before the Board and explained that his situation was similar to other property owners at Cotuit Bay Shores who are asking that the Board allow undersized lots to be utilized as buildable lots. Mr. Scanzillo's property comprised 36,172 sq. ft. in area and is on a cul-de-sac with frontage of about 85 ft. The petitioner stated that his building commitments in Florida prevented him from building on this property within the 7-year allowed time span and he now wishes to go forward with the construction of his residence. No one spoke in favor or or in objection to the petition and the Board took the matter under advisement. The Board voted unanimously to grant the petitioner a variance to allow the construction of a single-family residence on the lot in question. The Board found that the prior zoning in this area was for an area of 20,000 sq. ft. and a width requirement of 125 ft. Due to the lack of a frontage requirement under the prior .zoning, many of the lots in the subdivision in which this property is located, are on cul-de-sacs which makes it impossible for them to ever meet the current zoning requirement of 150 ft. frontage. The Board found this a unique circumstance which creates a financial hardship for the petitioner and since the abutting lots are on a cul-de-sac, allowing the variance will not cause detriment to the neighborhood nor derogate from the spirit and intent of the zoning by-laws. Mr. Scanzillo seeks modification by way of an extension of time so that he may utilize the variance relief which had expired after one year of the date -of the previous decision. Contract work in Florida prevented the petitioner from going forward with his plans to construct a single-family dwelling at the locus and application for time extension is made under Section 14 of Chapter 40A. , Mass. Gen. Laws which allows the Board to modify or amend by way of extension of time, variance relief which was not utilized in the one-year permitted time frame. No one spoke in favor of or in objection to the petition and the Board took the matter under advisement. The Board voted unanimously to grant the petitioner a modification of variance relief under decision 1980-71 to allow the construction of a single-family dwelling on a lot with insufficient frontage and area at 33 Amanda Court Cotuit in a residence F zoning district. This modification of variance no. 1980-71 allows the petitioner one-year from the expiration of the appeal period in which to construct a single-family dwelling at• 33 Amanda Court, -Cotuit. The. Mr. Scanzillo's property comprised 36,172 sq. ft. in area and is on a cul-de-sac with frontage of about 85 ft. The petitioner stated that his building commitments in Florida prevented him from building on this property within the 7-year allowed time span and he now wishes to go forward with the construction of his residence. No one spoke in favor or or in objection to the petition and the Board took the matter under advisement. The Board voted unanimously to grant the petitioner a variance to allow the construction of a single-family residence on the lot in question. The Board found that the prior zoning in this area was for an area of 20,000 sq. ft. and a width requirement of 125 ft. Due to the lack of a frontage requirement under the prior zoning, many of the lots in the subdivision in which this property is located, are on cul-de-sacs which makes_ it impossible for them to ever meet the current zoning requirement of 150 ft. frontage. The Board found this a unique circumstance which creates a financial hardship foi the petitioner and since the abutting lots are on a cul-de-sac, allowing the ice will not cause detriment to the neighborhood nor derogate from the spirit and intent of the zoning by-laws.
