As mentioned above, Lot B was conveyed on June 16, 1974 and a building permit for the present residence was granted without any zoning relief in 1981. Lot C was conveyed on January 30, 1973 and a permit granted in 1974. Lot D was conveyed on January 17, 1979 and a permit granted on February 28, 1979 without any zoning relief. Lot G was conveyed on September 5, 1973 and a permit granted in 1981 without any zoning relief. Since the protection of said subsection E must have been applied retroactively in order for the above lots B, D and G to have obtained permits without zoning relief, it is my opinion that the lot met the applicable requirements of the Bylaw on January 1, 1976, as required by section 240-91.B.1(d) of the current Bylaw. Since it is the stated intent of Section 240-90 to protect property rights of owners of preexisting legally created nonconforming lots and since the lot meets all of the requirements of section 240-91B, it is my opinion that the residential building rights protected under section 240-91B were vested in 1974 when the lot went into ownership separate from all adjoining land by virtue of the deed of TAT B to the Leonards as above reported; that the provisions of Section 240-91G protect the Lot from the area requirements of the RPOD District and that the Lot is entitled to a building permit for a single family residence.
