pavement to be granted to owners to the SE.TM Ells allowed for a gate to be installed with a key to be
provided to Police,fire& public works. His letter expressed that the request for the gate had the approval
of the abutting private owner but did not identify if any other private owners would be impacted nor did it
address what would occur in the event of a subsequent sale.The TM's letter does identify his approval as
a permit only and indicates that approval may be withdrawn should future circumstances dictate.

Notice of Building code Violation and Order to Cease, Desist and Abate:
Mr.Robert L.Perry,Jr.and all persons having notice of this order. As owner of the structure located at
0 Brittany Drive,Cotuit,MA,Assessor's Map 042 Parcel 012 C00,you are hereby notified in accordance
with Massachusetts State building code 780 CMR Article 1 Sections 121.1, 121.2& 121.3 and MGL 143.6
and are ORDERED this date May 15,2001 to:
1. CEASE AND DESIST IMMEDIATELY,all functions connected with this violation on or at the above
mentioned premises.
SUMMARY OF VIOLATION:
Structure at location noted above is open to weather and is an unsafe structure.
2. COMMENCE immediately,action to abate this violation.
SUMMARY OF ACTION TO ABATE:
By 12:00 noon of the day following receipt of this notice begin action to abate by:
1)contacting the Building Division to express your intention to comply,
2)apply for permits to either demolish structure,or to reconstruct or secure and make safe,
3)you or your contractor must obtain a permit to perform work necessary prior to commencing
work
And,if aggrieved by this notice and order,to show cause as to why you should not be required to do so,by
filing an appeal with the State Building Code Appeals Board(as specified in Article 1,Section 122 of 780
CMR State Building Code)within forty-five(45)days after the service of this notice.
