Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor (see Appendix Q,Rules&Regulations for Licensing Construction Supervisors,Section 2-IS) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor.is ultimately responsible. , . To ensure that the homeowner is fully aware of his/her responsibilities,many commmi ies require,as part of the permit application,that the homeowner certify that he/she understands the responsibilities of a Supervisor. At this point in time, the ground has been dug up and a foundation has been poured. The property is located in an RF Residential F Zoning District which requires a minimum lot area of one acre. The applicant is seeking a Variance to Section 3-1.4(5)-Bulk Regulations in order to permit the construction of a single-family home on an undersized lot that merged due to common ownership. The subject lot(Lot 30)is part of Subdivision Plan#270, known as ul-andfall*. The preliminary plan for rd this subdivision was approved by the Planning Board on February 2, 1973. At that time, the area in S question was zoned RD-2,which required a minimum lot area of 20,000 sq.ft. In March of 1973, the property was rezoned from RD-2 to an RF Residential F Zoning District which requires a minimum lot area of I acre(ATM 3/29173,Art 159). In September 10, 1973,the Definitive Plan for this subdivision was approved by the Planning Board. There were changes in the street and lot layout between the preliminary and definitive plans, but the majority of the lots remained slightly over 20,000 sq.ft'in area. Section 4-4.2-Nonconforming Lots-does provide for protection of nonconforming lots that are held in common ownership with not more than 2 adjoining lots when there is an increase in the area, frontage, width,yard or depth requirement of the Zoning Ordinance. However, this protection applies for a period of O 5 years from the effective date of change. According to a letter from the Building Commissioner,dated April 1, 1998, Lots 29, 30 and 42 were held in common ownership for more than 5 years after the 1973 LL zoning change. Therefore, a variance is required in order for this lot to be buildable. Currently, Lots 29, 30 and 42 are all under separate ownership. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on April 15, 1998. A public hearing before the Zoning Board of Appeals was duly adverfised and notices sent to all abutters in accordance with MGL Chapter 40A The hearing was opened May 20, 1998, at which time the Board granted the request with conditions. Attorney Joseph T. Fleming,Jr.represented the applicants, Charles and Leigh Maccini,who were present along with Mr. Peterson, their builder. Attorney Fleming.explained that the applicants bought the property in April of 1997 for$55,900. They were told it was a buildable lot They had a percolation test done and septic system plans were drawn. When their builder went to the Building Department with the house plans, it was then that they were told the lot is not buildable because it was held in common ownership by predecessors in title with an adjoining parcel. The applicant is seeking a variance to allow this lot to be buildable for a single family residence. As to variance conditions,pursuant to Chapter 40A, Section 10,Attorney Fleming stated the lot is somewhat unique due to the fact that it is a comer lot and has frontage on two streets. Most of the lots in the development are of similar size and most have been built upon,and to allow this variance would not be a detriment to the public good or the neighborhood affected. All of the abutters have indicated they are in favor of granting the relief requested. Because the Maccini's paid full and fair market value($55,900)for the purchase, on the belief that it was buildable,a severe financial hardship would result for denial of the variance. Attorney Fleming reviewed the history of this lot and the adjoining lots. The lots in issue were held in common ownership for more than 5 years after the 1973 Zoning change. The lots were held in common ownership until 1979, and then sold out individually. It was noted that Lot 49,the vacant lot adjacent to this lot,will also have the same problem. Public Comments: John Egar,a direct abutter,spoke in support stating he had no objection. Robert B. Scales;President of Landfall Association, Inc. spoke in favor and submitted a letter of support No one else spoke in favor or in opposition to this appeal. Findings of Fact: At the Hearing of May 20, 1998,the Board unanimously found the following findings of fact as related to Appeal No. 1998-71: 1. The applicants are Charles A.and Leigh M. Maccini. The property address is 177 Captain Samadrus Road, Cotuit, MA as shown on Assessor's Map 038, Parcel 050. 2. The property consists of a vacant lot of approximately 20,081 sq.ft.or 0.46 acres. 3. They have submitted a copy of the Quitclaim Deed to show standing before the Board. Background: The property that is the subject of this appeal consists of a vacant lot of approximately 20,081 sq. ft. in the village of Cotuit and is commonly addressed as 177 Captain Samadrus Road. At this point in time, the ground has been dug up and a foundation has been poured. The property is located in an RF Residential F Zoning District which requires a minimum lot area of one acre. The applicant is seeking a Variance to Section 3-1.4(5)- Bulk Regulations in order to permit the construction of a single-family home on an undersized lot that merged due to common ownership. The subject lot(Lot 30) is part of Subdivision Plan#270, known as"Landfall". The preliminary plan for this subdivision was approved by the Planning Board on February 2, 1973. At that time, the area in question was zoned RD-2, which required a minimum lot area of 20,000 sq. ft. In March of 1973, the property was rezoned from RD-2 to an RF Residential F Zoning District,which requires a minimum lot area of 1 acre (ATM 3/29/73, Art. 159). In September 10, 1973, the Definitive Plan for this subdivision was approved by the Planning Board. There were changes in the street and lot layout between the preliminary and definitive plans, but the majority of the lots remained slightly over 20,000 sq. ft. in area. Section 4-4.2-Nonconforming Lots-does provide for protection of nonconforming lots that are held in common ownership with not more than 2 adjoining lots when there is an increase in the area, frontage, width, yard or depth requirement of the Zoning Ordinance. However, this protection applies for a period of 5 years from the effective date of change. According to a letter from the Building Commissioner, dated April 1, 1998, Lots 29, 30 and 42 were held in common ownership for more than 5 years after the 1973 zoning;change. Therefore, a variance is required in order for this lot to be buildable. Currently, Lots 29, 46 anc�42 are all under separate ownership. The subject lot was released on October 2, 1978. The lots within this subdivision range in size from 0.46 of an acre to over one acre. However, the majority of the lots are approximately a half acre in size. Most of the lots have been developed with single-family residences. There are a few scattered vacant lots in the area. Single-family dwellings are located immediately to the east, west and north of the applicant's parcel. The abutting lot to the south is vacant. A single-family residence on the subject property would not be out of character with the surrounding neighborhood. Many of the residences in this area are located on lots that are equivalent in size to that of the applicants' property. Variance Findings: In consideration for the Variance, the petitioner must substantiate those conditions unique to this lot that justify the granting of the relief being sought. In granting of the Variance the Board must find that: • unique conditions exist that affect the locus but not the zoning district in which it is located, • a literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise to the petitioner, and • the relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Box 81021 Wellesley Hills, MA 02181 (781) 237-3608 FACTS The property is located on Cap'n Samadrus Road in the Village of Cotuit and consists of .46 acres, more.or less and contains 102' frontage along Cap'n Carleton Road, 135' of frontage on Cap'n Samadrus Road and 39.27' at the curve, Cap'n Samadrus Road is a public way, having been taken under the Town's Betterment Assessment Program. The entire betterment for this lot has been paid in full to the Town. The lot is currently assessed as a buildable lot for a value of$25,400.00. The Maccini's, seeking to retire on Cape Cod, purchased the property in April of 1997'. Prior to the purchase of same they had a percolation test done on the lot to determine suitability of soils for the installation of an on-site septic system and were otherwise informed by all parties to the transaction'that the lot was buildable. The Maccini's paid the sum of$55,900.00, in cash, for the lot. (See deed attached hereto.) The Maccini's then proceeded, after the purchase, with their plans to construct a three bedroom, single family retirement home on the site. However, after receiving all other approvals, including plan approval from the Association (see attachment), the were informed by the Building Inspector's office that the lot, because it was held in common ownership by predecessors in title in common with adjoining land was unbuildable and did not qualify under either the State statute (C. 40A, Sec. 6)or the local grandfather clause for protection. The merger problem results due to common ownership of adjoining parcel numbers 49 and 62 shown on Assessor's Map 38.. (Lots 42 and 29 on the Land Court Plan attached hereto.) The lots are contiguous along one boundary and.have different means of access and frontage. The lot in question is somewhat unique in shape in that it is a corner lot and does not interfere with the use or access with the two contiguous lots, nor is it detrimental to the use of the contiguous lots. ARGUMENT Under the provisions of Massachusetts General Laws Chapter 40A, Section 10 and Section 5-3.2 of the Barnstable Zoning Ordinance, the Board of Appeals has the power to grant the petitioner the relief being sought provided that the Board finds: 1.. That owing to circumstances relating to shape or topography of such land or structures and especially affecting such land or structures but not affecting generally the zoning district in which it is located, a literal enforcement of the provisions of the ordinance or by-law would involve substantial hardship, financial or otherwise; and that 2. Desirable relief may be granted a) without substantial detriment to the public good; and b) without nullifying or substantially derogating from the intent or purpose of the Barnstable Ordinance. 1. UNIQUE CIRCUMSTANCES AND RESULTING HARDSHIP: In the instant case, the shape of the lot is unique to the general zoning district in which it is located. Specifically, the lot is a comer lot and does not interfere with the adjoining lots. But for the common ownership of locus with this adjoining lot prior to the conveyance to the Maccini's, the property would be buildable under the grandfather clause. As a direct result of the unique circumstances regarding shape, applying the by-law literally,•and the one acre requirement, creates a hardship in that the Maccini's cannot use the property for the purpose for which they purchased it, a single family retirement home. Because the Maccini's paid full and fair market value, $55,900.00 for the purchase, on the belief that it was buildable under the Barnstable Ordinance, a severe financial hardship would result from the denial of.this variance. 2(a). NO SUBSTANTIAL DETRIMENT TO THE PUBLIC GOOD The granting"of this variance petition will not cause a detriment to the public good, in that the lot is proportionate in size to all the other lots in the subdivision in which it is located. Further, the majority of the other lots in this subdivision are currently built upon, and the proposed plans of the petitioner fit in with the style and character of this residential neighborhood and they have been approved by the Neighborhood Association. 2(b). NO NULLIFICATION FROM THE INTENT OR PURPOSE OF THE ORDINANCE Virtually all the other lots which are similar in size within the subdivision are currently built upon with single family homes. Given the unique shape, a corner lot on this site, it actually presents to the Board a situation where theBoard can exercise its discretion to grant a variance. As a result, granting the relief is neither inconsistent with, nor contrary to, the intent or purpose of the Barnstable Ordinance. CONCLUSION The Petitioners are able to satisfy all the criteria for the granting of a variance under Chapter 40A, Section 10 and 5-3.2 of the Barnstable Ordinance and, therefore, the Petitioners would request this Board that the variance be granted and the Petitioners be allowed to construct a three bedroom home, all per the plans submitted with the Petition.
