MGL Chapter 40A, section 6 provides for the merger of undersized lots held in common ownership. The applicant is seeking,a variance to allow the undersized lot to be considered buildable under zoning. Being a Resource Protection Overlay District, lots that were not buildable-as of October 2000, now require 2-acres minimum. Parcel 057, the lot to which the subject parcel-was!merged under zoning was develaaed in 1978 with a single-family dwelling. MGL Chapter 40A,Section 7,provides a. 10 year staff ue of limitations on enforcement due to errors in a building permit. Procedural & Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning B.: and of Appeals on May 24, 2002. An extension of time for holding the hearini;and for Fiblig of the decision was executed between the applicant and the Board. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance v pith MGL Chapter 40A. The hearing was opened July 10, 2002,and continued to September C4, 2002, at which time the Board found to grant the variance with conditions. Board members deciding this appeal were; Gail Nightingale,Richard L.Boy,Thomas A. DeRiemer, Ralph Copeland and Ron S.Janson. Attorney John R. Alger represented the applicant. He submitted a memorandum in support of the grant of the variance and.gave a brief history of zoning in the area. Mr. Alger noted that the applicant had purchased the. property as a buildable lot in 1984. It was not until recently when the applicant attempted to seci:re a building permit that the issue of build-ability arose. The lot was held in common ownership with an adjoining lot,Parcel 057 (98 Clamshell Cove,Road) in 1973 when the zoning changed to RF and required one acre. It is the shape and location of the lot that creates the unique conditions justifying the ;ranting of the variance. The lot is assessed at $128,000. Mr. Alger described the proposed dwelling as a two-story, three- bedroom (plus optional studio), 3,253 sq.ft.,dwelling inclusive of an attached three car garage. The total first floor area was given as 2,100 sq.ft. and the second floor (inclusive of r.he studio) is 1,153 sq.ft. He noted the lot coverage was 15.6%. The Board questioned the size of the proposed building and requested the applicant consider a smaller dwelling that would not be a detriment to the neighborhood. I'he Board continued the appeal to September 04, 2002,to allow the applicant to reconsider the size of the dwelling. At the continuance, Mr. Alger and the site Engineer, Stephen Wilson p..-esented re,:ised plans for the dwelling. They noted that the number of bedrooms was reduced tc three,the k)otprint and the total gross areas were reduced and the garage reduced to two-cars. The two-stoi✓structure was also reduced to a 1,1/2-story structure. The Board reviewed the plans. During the public hearing,Joseph A. Thibeault of 110 Clamshell Cove Lane expressed concern for the proposed size of the dwelling and road drainage problems at the lot. Richard Uber also noted the drainage issue along the roadway. Gaziano, and I own the residence at 86 Clamshell Point Lane in Cotuit,which is situated directly across from the above-referenced property. I have owned this property since May of 1992 and since that time have experienced, with each heavy rainfall, road flooding which rises into my driveway and onto my front lawn. On June 5, 2001, I wrote to Thomas J. Mullen, Director of the Department of Public Works Administration, outlining the flooding problem. (I have enclosed a copy of this letter for your review.) Consequently,the storm drain was partially repaired; however, due to the fact that there was no money in the town budget, the improvement has been marginal at best. Prior to commencement of the construction at 81 Clamshell Point Lane, there was a request by the.owners for a variance, since the lot did not meet current requirements. There was a public hearing where there was in-depth discussion by the abutters and the Board regarding the existing water problem and how the new construction might exacerbate the current situation. . The Chairman of the Board stated that he would not allow fill to be deposited onto the lot, and the grade would remain at street level as with all the other existing properties. Mr. Seymour informed me three years ago that the drainage pit or drainage area for the storm drain needed to be replaced, however, each year I am told only of additional budget restraints and the replacement has never been made. With each rainfall the problem continues. Our property is located at the bottom of two hills which, of course, in a heavy rain storm,water rushes towards the storm drain. Since the drain is unable to absorb the rain water, the road floods and becomes impassable. As a result the automobile traffic on the road uses my circular driveway as a "public road" in order to get around the flooded area. In addition the SUV's tend to drive through the flooded area sending a rush of water and debris onto my front law! I am continually raking the debris from my lawn and cleaning up the roadway. During this past rain storm the automobiles created quite a mess in my driveway area. I do believe three years is certainly enough time to wait for a repair.
