This appeal Is In accordance with Section 5-3.2 (1), Background information: The Applicant is seeking an Appeal of an Administrative Offlcial. On November 1. 1995,the Building Commissioner denied a building permit to the Applicant due to the fact that this lot was held In common ownership with an adjolning lot after the critical ordinance change to one acre lots In 1973 and therefore Is not grandfathered under MGL Chapter 40A. The Nonconformitles Section 4-4.2 (4) -Subdivision Plan Protection was applied In this appeal. Procedural Summary: This appeal was filed at the Town Cleric's Office and at the Office of the Zoning Board of Appeals on November 1, > 1995. A Public Hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters In accordance with MGL Chapter 40A. The Heating was opened on November 29, 199S, and continued to January 24. 1995 at whlch time the Board found to Overrule the Building Commisslonem Decision. Board Members hearing these 4 appea!s on November 29, 1995 were Emmett Glynn. Ron Jansson. Gene Burman,Tom DeRiemer, and Chairman Gail Nightingale. At the hearing of January 24, 19915, Alternate Member Etlzabeth Nilsson,who was present for the Initial hearing replaced Ron Jansson who was not present at the opening of the continuance. t Hearing summary: Attorney Albert Schulz represented the applicant In this appeal. He presented the history of the lot, citing that on February 19, 1958 a subdivision of the land for Robert Haden(known as"Cotult Commons')was approved by the Planning Board. At that time the property was zoned RD-2 which required 20,000 sq. R. of upland per lot. In March 1973,the zoning was changed to RF and a 43,580 sq.ft. minimum lot area was required. Philip Gogan and William Butler purchased most of the lots In 1973. Mr. Gogan transferred half of the lots to himself and half of the lots to Mr. Butler, which was within the 7 year protoolon peMod afforded a Subdivision Plan under MGL Chapter 40A. On ? October 27, 1977.the bank foreclosed on all the lots. The locus has been In separate ownership since 1977. In 1979, a decision by then Town Attorney Gilmore, stated the lots were buildable and notified the Building Commissioner Otnce to issue building permits to all the lots. Approximately 48 tots were sold and the building permits issued. Attorney Schutz stated that his lot Is grandfathemd as a developable non-con'orming undersized lot due to the recently passed Zoning Ordinance amendment"Nonconfonnitles', specifically Section 4.4.2(4) "Subdivision Plan Protection'. This amendment states that any change In the Zoning Ordinance shall not apply to env land submitted and endorsed within 8 years from the slate of endorsement and shall not lose Its status as a single buildable lot under zoning. In the case Of lows, the covenant was not released until 1979, but the subdivision was completed in 1973 and the Planning Board files document this completion of the Subdivision and release of all securities authorized. Ralph Crosson is in agreement that the early checkerboarding was sufflcient to protect the lots: however, he feels the foreclosure reunited the lot Into common ownership which Is the reason why he denied a building permit. Attorney Schutz stated that this was an Involuntary merger and not voluntary because of the foreclosure and should be distinguished as such. The Board was concemed with the Implication of the new zoning Ordinance text with regards to the recent'Tsagronis Supreme Court Decision"and requested the opinion from Town Attorney Robert Smith as to the legality of the text. He reiterated that It was an involuntary merger and that the new ordinance(Section 44.2(4)j was assed for just such lots-to eliveate the hardship resulting from the Tsagronis decision. he public was asked to comment. Speaking In favor was Bob Holzman, an abutter,who owes the vacant lot north of ocus and Madeline Holzman,who owns an abutting lot In Cotult Commons. The Board Members asked the Building Commissioner to discuss his reasoning In this appeal. Mr.Crosson stated that the question of buildablllty under zoning rests with the lot going Into separate ownership within the S year freeze. If so, then the lot Is grandfathered under the new ordinance. In this case,the lots(the entire subdivision) In question were sold to two developers and it needs to be decided whether or not there was separate or common control by the two developers in this subdivision. If there was separate ownership then It was protected even though the bank took it through foreclosure. If It did go into separate control then it Is grandfathered. According to Attorney Schulz. in 1673,when the Town went to one acre zoning, the lot in Issue was in separate ownership as both Mr, Gogan and Mr.Butler had separated both ownership and control. The applicant, the Apogs, are the owner today of a single lot In this development. Other vacant tots In Cotult Commons,the subdivision,will have to be handled Individually. Lots were sold separately from the bank and each lot will continue to be treated individually as now separate people own the remaining lots. Finding of Facts: Based upcn the testimony given during the public hearing on this appeal.the Board unanimously found the following findings of fact: 1. The petitioner:s appealing an Administrative Official's Decision,dated November 1. 1095 that denied a Building Permit for Lot 57 Penelope Lane, Cotult, MA.The lot is located as Assessor's Map 39, Parcel 42 In an RF Residential F Zoning District and a GP Groundwater Pralection District. 2. The undersized lot was put Into separate ownership during the 8 year subdivision protection period provided for in MGL Ch. 40A, Section 6. 3. There has been no evidence presented to this Board that this lot was under voluntary common control or ownership with any abutting lots after the 3 year period afforded the subdivision. 4. Similar lots in the area have been built upon during this$year freeze period and built upon after such time and this has estaolished a precedent. Decision: Rased on the findings a motion was duly made and seconded to Overrule the Building Commissioner In Appeal Number 1995.160. The vote was as follows: AYE: Tom DeRiemer. Prestige Properties, Inc. for the purposes of this letter. It is my understanding that you have in your possession evidence of the ownership of the abutting lots to Lot 74 as of February. 1975 (i.e. within the "plan freeze" period) . I understand that Lot 74 was owned by Messrs. Butler and Gogan as Tenants in- Common, Lot 67 was owned by Mr. Gogan individually, Lots 68 and 73 were individually owned by Mr. Butler, and Lot 70 was owned by a Mr. Hart. I understand that you have some concerns with regard to the "control" of these lots subsequent to the checkerboarding. I believe that this fact pattern is easily distinguishable from the case of the Planning Board of Norwell vs. Serena, 5642 V.E. 2nd, 314, ( 1989) . In the Serena case the two abutting lots in question were . owned as follows: 1. The first lot was owned by a husband and a wife as tenants by the entirety (maintaining a right of survivorship) ; and 2. The second lot was owned by them in a trust in which they were the sole beneficiaries and trustees. There was therefore a totality of identity of the true owners and actual control. In the facts as presented to you in this case, only Lot 74 in the abutting group was owned by "two" people. As I am sure you are aware, in order for any agreement to be - Ralph Crossen May 29, 1996 Page 2 enforceable against land (pursuant to the statute of frauds) , the agreement (control) must be in writing, executed by the parties to be charged. I find no partnership agreement or other writing of record to put the subsequent owners of this lot on notice as to any such agreement. Mr. Butler was free to deal with his lots as he wished and Mr. Gogan was free to deal with his lots as he wished. As to the lot that they owned together, any decisions to be made regarding the same would have had to have been mutually agreed upon, or they would have been forced to go to the probate court for a petition. to partition their rights. Notably (Serena) a tenancy . by the entirety cannbt by petitioned in a partition. Therefore ' I would respectfully suggest that there is a valid distinction between the Serena case and the case at hand. As you know, Mr. Butler is now dead and I am sure Mr. Gogan's memories of this subdivision are distasteful at best. I would remind you that the statute of frauds is applicable to the purchase of land and that Attorney Galvani, in good faith, bought this lot from the Bass River Savings Bank in April of 1979 and for seventeen years has religiously paid his taxes as if the same were a separate buildable lot. I am sure he would consider denial of a building permit under the facts and circumstances of this case to be tantamount to a taking by the town of his property.
