My visit was prompted by an anonymous complaint received by this office the afternoon of Jan. 10, 2012. Investigation is allowed under the Massachusetts State Building Code, 780 CMR R104, as amended, and the Massachusetts General Laws Chapter 143. The following violations were observed: 1.) Some windows were replaced in the dwelling without a permit. See 780 CMR R105 "PERMITS" and 780 CMR R113 "VIOLATIONS" for explanations. 2.) My observation is that some windows were replaced in areas of the dwelling where bedrooms are normally located in similar structures. If this has been done,then a dangerous condition exists because an emergency escape window has been modified in violation of 780 CMR R310, "EMERGENCY ESCAPE AND RESCUE OPENINGS", as amended. 3.)A Stop Work Order was issued on Jan. 11, 2012 and affixed to the front window of the dwelling near the front door. See 780 CMR R114 "STOP WORK"as amended for the code explanation. A building permit is required for the work that has been done. Also, some windows may have to be changed to comply with 780 CMR R310 (number 2 above) or those rooms must not be used for sleeping. One or more inspections must be performed to insure compliance with the terms of the permit. r -2- As a homeowner, I would not expect you to be aware or knowledgeable of the Massachusetts State Building Code or it's requirements. My wife Patricia has spoken to Mr.Martin of your office on a few occasions to express our concerns.Although he has always been helpful and informative,we fear what is taking plaore in our neighborhood and feel it is time to speak out directly. We of Cotuit Commons and surrounding areas are extremely displeased with the approval already given to this construction;however, we realize that the current zoning laws allow for such an establishment as Quik Mart Landing.Because of my wife's previous discussions with Mr.Martin,we had come to beleive that we could rely on your office to protect the best interests of the surrounding area.Unfortunately, the devlopments of the past week on this site have made us question this faith in your Judgement.Therefore,this letter to you to express our concerns about and reccomendations for this business. The following areas are of major concern to our Association. We urge your consideration and implementation of these items before approving the opening of this business.What is permitted with Quik Mart Landing will most assuredly set precedent for construction in similarly zoned neighborhoods. 1.We are appalled that this entire lot has been razed.It is truly an eyesore.We suggest that the owner be instructed to purchase mature trees to replace those he so callously bulldozed. 2.We are concerned about the size and type of business sign which will be erected.We beleive anything other than a small,non-neon sign would be garish and distracting in this residential neighborhood. 3.We request that you issue guidelines about window advertisements,that the use of large paper signs or any lighted sign should not be allowed.Again,such devices cheapen the residential atmosphere of this area. 4.We would like to point out that there already exists a potentially hazardous traffic situation at the entrance/exit to Cotuit Commons.This serious situation should be considered when the owner designs his own entrance to Quik Mart Landing so that a bad situation is not made worse. 5.We are finally concerned about the establishment of reasonable business hours.We are aware that Quik Mart Landing currently opens from 6:30 A.M.to 11:00 P.M. We maintain that these business hours would not be acceptable in a neighborhood of families and children. V/e suggest that 8 A.M.to 8 P.M.would be more reasonable in this new location. We understand that Mr.Bent has sue cess fill ly operated his business for a year without complaint,however,this current establishment does not affect a residential area.We certainly realize that we must live with this business.On the other hand,Mr.Bent elected to build his establishment in our residential area and therefore must live with us also in order to keep the neighborhood/business environment balanced. Your issue concerns Cotuit Landing Quik ^^art.In your letter you state y^r displeasure with the approval although you are aware that the current zoning law permits such an establishnent.You also question nr^judgement re the de velopment of the site after having spoken with Mr.Martin. First of all,,as I have stated before,I spend a great deal of time in reviewing any project in this area.I have a feeling for the area.The zoning permits a small retail business coiBnon to a residential area.Please note that each of the structures are similar in character to the residential units.I have been explicit in ray explanation that the residential character be mamtained as nearly as possible.I have made that a condition for a permit.You will not see a building out of character with the area if I have anything to do with it, I would like to address the concerns as listed in your letter. 1.There are no controls in the Town of Bamstable as to the razing of trees.As you know,there is a lot in Cotuit Ccinmcxis that has been razed.To my knowledge Mr. Bent is planning to landscape ^i^hn the weather permits. 2. Signs are regulated by Section U.of the CSwn of Bamstable Zcning By-law.Lights that could be offensive to the neighborhood will not be permitted. 3.Window advertisements are also governed by Section U.of the Zoning By-law. 4*Although the owner designs his own driveway he must obtain approval for same from the CcmnKxiwealth of Massachusetts since ingress and egress is on a State Highway.If a Town road is involved approval must be obtained from t£e Town of Bamstable Engineering Department.
