The facts regarding the lot are as follows: 1. Lot 21 was originally legally established on a plan of land dated February 12, 1968. The plan is registered in the Land Court Division of the Barnstable County Registry of Deeds as Land Court Plan 22824-D. It is shown on said plan as Lot 21. A copy of the assessors recorded showing that the lot contains 0.62 acres is attached for your review. Also attached for your review are the Land Court plans referenced hereinabove. As can be seen from a review of these plans Lot 21 contains approximately 27,520 square feet(0.62 acres). At the time the lot was created the zoning requirement for the zoning district was a minimum lot area of 20,000 square feet. 2. Article B-1(D) passed on November 5, 1983 rezoned the lot from business C to residence F taking the minimum lot area requirement from 20,000 square feet to 1 acre. 3. The only zoning change after this, adopted in October of 2000, was a minimum lot area requirement of 2 acres however this affected only lots created after the year 2000, as this does not apply Lot 21 pre-dates this. 4. The current,owner of Lot 21 (44 Content Lane, (Cotuit) Barnstable, MA) is the Revocable Living Trust of Lawrence'Michael Nadeika. Attached for review is the deed i dated I1/17/2005 recorded with the Barnstable Land Court Registry, document number 1,019,048. 5. The owners of the abutting Lot 22 (28 Content Lane; (Cotuit) Barnstable MA) are Arthur A. Marcantonio and Gail C. Marcantonio. Attached for your review is the deed recorded with the Barnstable Land Court Registry, document number 881,478. The lots have never merged as can be concluded from the chain of title. Based on the foregoing it is my opinion that under Chapter 240, "The Zoning Ordinance" of "The Code of the Town of Barnstable"Article I1I, §240-14 this lot is not held in common ownership with any adjoining land, has a minimum of 20,000 square feet as required when legally created, and the lot was owned separate from its surrounding lots at the time of the zoning change which made it non-conforming. General • The second floor support beam is to be a 7 x 11 7/8 Parallam PSL. This beam may be made with two 3 '/2 in. wide Parallam PSL members, connected as shown in sheet 18, Assembly E. The beam is to be supported at each end with 3 %2 x 3 '/Z Parallam PSL columns connected to the beam with Simpson EPC 84 connectors. The support column near the stairs is to be connected to the main beam girt with a Simpson PC 64 connector with shims as required. • The main beam girt is to be a triple 2x 10 with four standard 3 '/2 in. dia. support lally columns, concrete filled and located as shown on the drawings. The columns are to be connected to the main beam girt with Simpson LCC4.5-3.5 connectors. Footings for the columns are to be 28 in. min. x 28 in. min. x 14 in. min. deep with no rebar. The columns are to rest on steel base plates on the footings, 8 in. x 8 in. x '/z in. thick, secured with 5/8 in. dia. 9 inch long Hilti bolts into the footings, one each centered on each side of the columns in the direction of the beam. The columns are to be welded to the base plates with 1/16 in. fillet welds, all around. The base plates may be embedded into the concrete for flush surfaces if desired. • Anchor bolt spacing is to be 44 in. max. and 6 to 12 in. from the ends of sill plates. Maximum horizontal wind load for this angle is 21.8 psf. This resolves to a vertical wind loading of 10.72 psf. Total vertical loading on the roof consists of snow plus %2 vertical wind and material weight. First floor live load is 40 psf. Second floor live load is 30 psf. All material weight is evaluated and combined in by the computer.
