Atty. Richard C. Anderson represented the petitioner who is seeking a variance
from the requirements of Sec. J. , Appendix A. of the Barnstable zoning by-laws,
to allow a lot with insufficient area and frontage to be utilized as a buildable
lot at Cotuit Bay Drive, Cotuit, in a residence F zoned district. This area
now requires a one-acre minimum lot size and frontage of at least 150 ft. The
petitioner's lot contains 28,246 sq. ft. and about 140 ft. in frontage. Mr.
Anderson explained that the subdivision plan was filed with the Planning Board
on May 3, 1973 at a time when the zoning requirement called for 20,000 sq. ft.
minimum lot size. A public hearing was held on the subdivision plan on May 27, 1973.
On June 27, 1973, this subdivision plan was approved and two days later on June 29,
1973, a new zoning amendment went into effect which increased the minimum lot size
to one acre and the frontage to not less than 150 ft. This subdivision plan was not
recorded at the Registry of Deeds at the time the new zoning by-law went into effect
since the two day' interval between Planning Board approval and the upgrade in zoning
did not allow sufficient time to prepare covenants etc. The plans were not checker-
boarded or placed in separate ownership which would have given them unlimited pro-
tection as buildable 1ots .and they had the allowed seven year's protection afforded
under Sec. 7A. of Chapter .40A. This protection expired on June 27, 1980 and the lot
is now unbuildable. Due to difficulties with financing the construction of a dwelling,
Mr. Crowley was unable to 'build during the time period in which he was allowed to build
and he now wishes to sell the land as a buildable lot, There are abutting residences
on the lots adjoining" the property in question and therefore there is no possibility
that the petitioner can acquire additional land to bring this lot into conformity with
the current zoning requirements. Mr. Anderson said that size or lack of size must be
a consideration in granting this type of relief, otherwise, there would be no way for
a zoning board to allow a !variance for an undersized lot in this type of situation.
Sec. Q. 2 (r) of the zoning by-laws' refers only to the uniqueness of property to the
zoning district in which it is located and does not mention size, shape, topography,
etc. , as outlined. in Sec. [10 of Chapter 40A. , M.G.L. - The town's zoning definition
supercedes the State's 'definition. * No one spoke in favor of or in objection to the
petition and the Board took the matter under advisement.
The Board voted unanimously to grant the petitioner a variance to allow a buildable
lot and found that denying the petitioner's request would cause substantial hardship

surrounding lots are all of a comparable size to the lot in question and therefore
allowing the petitioner's request will not cause detriment to the neighborhood nor
