Mr. Bruce presented his petition before the Board and said that he is the
owner of lot #/21 as shown on the subdivision plan submitted with the filing.
This parcel is shown as lot f#43 on town map #/55 and has a total square foot-
area of approximately 43 ,300 ft. and is.,, less than 300 ft. short of the zoning
requirement of one-acre for the residence F zone in which this property is
located. This lot is in Cotuit Bay Shores and has access to it from Cotuit
Bay Drive. The two abutting lots contain dwellings and there is no possibility
of acquiring additional land to bring this property into conformity with the
one-acre requirement. This lot is "pork-chopped" and does not comply with the
since the. subdivision , at the time it was laid
frontage requirement of 150 ft.

This property is now under a purchase and sales agreement contingent upon the
variance being granted. This property is assessed by the town as having 1 .01 acres
however, a survey showed only 43,300 ft. and this lot is land-courted. The
petitioner purchased this lot in Sept. of 1979 and said that he would suffer financial
hardship if the lot cannot be used for a dwelling. No one spoke in favor of or in
objection to the petition and the Board took the matter under advisement.

The Board voted to allow the petitioner a variance for lot #'43 on town map 1#55
at Cotuit Bay Drive, Cotuit Bay Shores. The Board found that at the time of the
original subdivision of this land, this lot complied with the requirement of width
and therefore, there is no possibility of complying with the present frontage re-
quirement of 150 ft due to the layout of the subdivision. The petitioner lacks
minimal square footage to bring this lot into compliance with the one-acre area
requirement and allowing the variance would not cause detriment to the neighborhood
since the surrounding lots have equal or smaller square foot areas. The shape of
this lot fulfills the requirements of Sec. 10, Chapter 40A. , M.G.L. necessary to
the granting of a variance and the Board found that allowing this petition would be
in keeping with the spirit and intent of the Barnstable zoning by-laws.
