Lot 31 on Plan Book 134, Page 41 was created by a plan dated November 1955,and endorsed by the Board of Survey on March 15, 1957, and recorded in the Registry of Deeds on March 29, 1957. The title history of 10 Cotuit Cove Road and the two adjoining properties are attached as exhibits to this letter. The history of the zoning in this section of the Town as it relates to 10 Cotuit Cove Road is simple. The plan that created this lot was endorsed in 1957. The plan,for the easterly abutting lot, was endorsed by the Planning Board in 1968. Both plan had the,same"bulk requirements". Lot 31 has stood alone since 1962. TITLE DEED Said Premises is to be conveyed by deed running to the BUYER,or to the nominee designated by the BUYER by written notice to the SELLER at least seven(7)days before the deed is to be delivered as herein provided,and said deed shall convey title thereto,free from encumbrances,except: (a) Provisions of existing zoning laws; (b) Such taxes for the then current fiscal year as are not due and payable on the .date of the delivery of such deed; (c) r,""Any liens for municipal betterments assessed after the date of this Agreement; (d) Easements,restrictions and reservations of record,if any,so long as the same do not prohibit or materially interfere with the intended use of the Premises as a three bedroom home.. 5. DEPOSIT All deposits made hereunder shall be held in an FDIC insured non-interest bearing escrow account by the Sotheby's Intsmabonal Realty as escrow agent subject to the terns of this Agreement and shall be duly accounted for at the time for performance of this Agreement. BUYER warrants and represents to SELLER and SELLER represents and warrants to BUYER that neither has dealt with any broker or other person entitled to a broker's commission in connection with the negotiation or execution of this Agreement or the consummation of the transaction contemplated hereby, except the Broker(s) listed herein, and each agrees to hold the other harmless and indemnify tKe other against all damages,claims, losses and liabilities, including legal fees, incurred by the other, arising out of or resulting from the failure of,its representation and warranty. The Parties acknowledge and agree that SELLER has no adequate remedy in the event of BUYER's default under this Agreement because it is impossible to compute exactly the damages which would accrue to SELLER in such event.
