HOMEOWNER'S EXEMPTION The Code states that: "Any homeowner performing work for which a building permit is required . shall be exempt from the-provisions of this section(Section 109.1.1-Licensing of construction Supervisors); provided that if the homeowner engages a person(s)for hire to do such work,that such Homeowner shall act as supervisor." Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q,Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require, as part of the permit application,that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently used by several towns. You may care to amend and adopt such a form/certification for use in your community. In approving this subdivision, the Planning Board Minutes of November 24, 1986 and those of February 10, 1986 discuss and acknowledge that Farmersville Road was being utilized as frontage for three of the subdivision lots. The minutes of February 10, 1986 state"using frontage on Farmersville Road for lots 15, 16& 17[with]access from a cul-de-sac and new internal road[[Shammas Lane]." In January of 1988 the subject lot(Lot 16)was released from covenant As of April 1990,all the lots in this subdivision have been released. On June 5, 1995, the Planning Board voted to release the remaining security held for the completion of Subdivision#621 after it was determined this subdivision was complete(see attached June 5, 1995 letter from DPW and June 6, 1995 letter from Planning Board). At the time Subdivision#621 was approved,the property was located in a RF Residential F Zoning District which had a minimum lot frontage requirement of 150 feet, as it does today. The subject lot is the only lot in this subdivision that has not been developed with a single-family residence. Lots 15 and 17, similarly situated as the subject lot, both have only 50 feet of frontage on Shammas Lane but have the required frontage on the unimproved Farmersville Road. A review of Zoning Board of Appeals records indicate that no Variances were approved for Lots 15 and 17. Variance Findings: In consideration for the Variance, the petitioner must substantiate those conditions unique to this lot that justify the granting of the relief being sought. Three lots obtain their frontage from Farmersville Road. Lots 15, 16,17 . All the lots have access from the new road Shammas Lane. The Planning Board discuses frontage and access. The minutes show they believe this is a better Plan . The Board also believe that legal frontage was obtained from Farmersville Road. The Definitive Plan Endorsement was a statement of Zoning. The Plan was not appealed ' , and all the covenants have been released. Shammas Lane was built and is in great shape. 5. 1986-1995: A total of four Building Permits have been issued to lots using Farmersville Road as their frontage and other Roads as their access. Two using Shammas Lane as access and Two using Deborah Drive as access. See Town Map Attached. Also the Zoning Board of Appeals issued a Family Apartment to Lot 17 Shammas Lane ,twice. They made 4 borings and found course grain soils, which will provide adequate drainage--these are well drained soils. There is 1 well north of the site, and the site is partially in a zone of contribution. A water table map has been prepared showing that Little Pond drains into Mystic Lake--the figures are in the report with regard to vegetation and wild life--no rare species--they saw squirrels skunks and rabbits--no deer were sited. They will have no problem meeting title 5 of the sanitary code and will not effect Little Porn with the septic systems. Calculations shown in the table on page 15 show that nitrogen loading will -.be less from a cluster than a standard grid subdivision. The site is not in the flood plain, and the site is a good example of how clustering can preserve the natural features. %commendations at erns of report show preservation of existing trees, open space for allowance of passage of wild life, minimun fencing, septic system maintenance and inspection & prohibition of underground storage. It is an open space plan, with the bulk of the open space being provided -on the southerly end of the property, and a buffer around the perimiter. There has been provision made for the preservation of natural features--a large holly tree on the property and a grove of white pine. There are 26 lots, one has been eliminated since the preliminary. George Littlefield abutter, his only concern is that Flint Street is curvy and the traffic is dangerous already, and there are school busses that travel this road. Mr. Vail 83 Sandy Valley, he feels that there are too many things already on this narrow road, and be does not think that Flint Street can take the added traffic. There is no other access contemplated other than onto Flint Street.. Dan Laney 379 Flint Street asked where the jogging paths were to be located and wbat type of surface they mould have. Florence Kelly asked if the waste water would effect Sheubel Pond. The wader slows to the south so there would be no chance for that. Farmersville Road has long been gated off near its intersection with Race Lane, so that the 1100 acre West Barnstable Conservation Area can be properly managed. The Conservation Commission finds that improving this road will harm the effectiveness of its long-term management efforts for the area. The minutes show they believe this is a better Plan . The Board also believe that legal frontage was obtained from Farmersville Road. The Definitive Plan Endorsement was a statement of Zoning. The Plan was not appealed , and all the covenants have been released. Shammas Lane was built and is in great shape. 5 . 1986-1995: A total of four Building Permits have been issued to lots using Farmersville Road as their frontage and other Roads as their access. Two using Shammas Lane as access and Two using Deborah Drive as access . See Town Map Attached. Also the Zoning Board of Appeals issued a Family Apartment to Lot 17 Shammas Lane ,twice. Two separate Building Commissioners have issued permits on four separate occasions, The Definitive Plan, and the Family Apartment Decision. When you add it all up, isn' t it a statement of Zoning. They made 4 borings and found course grain soils, which will provide adequate drainage--these are well drained soils. There is 1 well north of the site, and the site is partially in a zone of contribution. A water table map has been prepared showing that Little Pond drains into Mystic Lake--the figures are in the report with regard to vegetation and wild life--no rare species--they saw squirrels skunks and rabbits--no deer vere sited. They will have no problem Greeting title 5 of the sanitary code and will not effect Little Pond with the septic systems. Calculations shown in the table on page 15 show that nitrogen loading will %be less from a cluster than a standard grid subdivision. The site is not in the flood plain, and the site is a good example of how clustering can preserve the natural features. Recommendations at end of report show preservation of existing trees, open space for allowance of passage of wild life, minimum fencing, septic system maintenance and inspection & prohibition of underground storage. Rohrbach opposed. SUBDIVISION #633 FAIR ACRES OPEN SPACE FLINT ST. MARSOTNS MILLS Chris Clark, Atty. for the petitioner. Baxter & Nye drew the plan which was approved as a preliminary. The plan is essentially the same as the preliminary, with one less lot. It is an open space plan, with the bulk of the open space being provided on the southerly end of the property, and a buffer around the perimiter. There has been provision made for the preservation of natural features--a large holly tree on the property and a grove of white pine. There are 26 lots , one has been eliminated since the preliminary. The sight view from the entrance will be cleared and an easement granted. Letters read by the Chairman from the Water Co. Town water will be provided with a 12" main. Board of Health, standard letter--title 5 etc. Steve Saymour, he has no objection to the plan. No comments by the Board. C. George Littlefield abutter, his only concern is that Flint Street is curvy and the traffic is dangerous already, and there are school busses that travel this road. Mr. Vail 83 Sandy Valley, he feels that there are too many things already on this narrcw road, and he does not think that Flint Street can take the added traffic. ire is no other access contemplated other than onto Flint Street.. Dan Lahey 379 Flint Street asked where the jogging paths were to be located and what type of surface they would have. Floreme Kelly asked if the waste water would effect Sheubel Pond. Farmersville Road has not been constructed or paved in this area. Lot 16 Shammas Lane is a lot with 50' of frontage on Shammas and over 200' on the paper street Farmersville Road. 2. Apparently,the Planning Board in the late 1980's allowed this subdivision with several lots with less than 150' of frontage on Shammas because they had 150' on Farmersville. 3. Approval under the subdivision control law does not alleviate the need for zoning relief such as this. 4. There are two choices in order for this lot to be a buildable lot: A) Obtain a variance from the Zoning Board of Appeals for a lot with less than 150' frontage B) Provide acceptable frontage on Farmersville after appropriate Town approvals 5. In order to use Farmersville,the road would have to: A) Have a sub-base of 12"gravel or 6"dense graded stone meeting Town specifications placed and compacted onto non-frost susceptible material.
