Information and Instructions
Massachusetts General Laws chapter 152 section 25 requires all employers to provide workers' compensation for their
employees. As quoted from the "law", an employee is defined as every person in the service of another under any contract

of hire, express or implied, oral or written.

of a license or permit to operate a business or to construct.buildings in the commonwealth for any applicant who has
not produced acceptable evidence of compliance with the insurance coverage required. Additionally,neither the
commonwealth nor any of its political subdivisions shall enter into any contract for the performance of public work until
acceptable evidence of compliance with the fimw nce requirements of this chapter have been presented to the contracting

The current exemption for"homeowners"was extended to include owner-occ�ied dwellims of six units or less and
to allow homeowners to engage an individual.for hire who does not possess a license,provided that the owner acts as
supervisor.
DEFINITION OF HOMEOWNER
Person(s)who owns a parcel of land on which he/she resides or intends to reside,on which there is,or is intended to
be,a one or two-family dwelling,attached or detached structures accessory to such use and/or farm structures. A
person who constructs more than one home in a two-year period shall not be considered a homeowner. Such
"homeowner"shall submit to the Building Official on a form acceptable to the Building Official,that he/she shall be
responsible for all such work performed under'the building permit. (Section 109.1.1)

applicable codes,bylaws,rules and regulations.

HOMEOWNER'S EXEMPTION
The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions
of this section(Section 109.1.1-Licensing of construction Supervisors);provided that if the homeowner engages a person(s)for hire to do such
work,that such Homeowner shall act as supervisor."
Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q,
Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly
when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed
Supervisor. The homeowner acting as Supervisor is ultimately responsible.
To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application,
that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently used by
several towns. You may care t amend and adopt such a form/certification for use.in your community.

Barnstable Patrlot, and notice of which was forwarded to all

Massachusetts, the petitioner Robert R. Churchrlll , represented by
Richard Baxter, of Baxter 8 Nye Engineering, requested a Special
Permit pursuant to Section 3- 1 .6 'Open Space Residential District" of
the Town of Barnstable Zoning Bylaw In order to construct an Open
Space Residential Development on land located on Assessor's Map 42 ,
Parcel 10-1 (part) , off Wakeby Road In Marstons Mills, In an RF
Residential District and a WP Zone 8 Protection Overlay District, and
as shown on a Definitive Subdivision Plan entitled "Plan of Land In

In support of this petition the petitioner presented evidence that the
following condit Ions . appl led which would warrant the granting of a
special permltt
FINDINGS OF FACT
based on the evidence submitted, the Planning Board made the following
findings of fact:
'I ) . . .That the impact of the proposed Open Space Residential
Development wlII - be .no more adverse than a conventional development
and, may have less of an impact on adjacent well fields due to the

residential lots.

2) . . .Tl)at the area of land, 4.98 acres, all of wh I ch Is upland, 1 .9
sufficient to accommodate at least four detached single-faMlly
dwelling units at the minimum one acre lot size requirement for the RF
Zoning District.
3) . . .That the total number of proposed four (4) lots does not
exceed.85% of the total 4. 98 acres of upland divided by the one acre
minimum lot requirement of the zoning district.
4) . . .That the Open Space Residential Development will have less
detrimental effects upon the surrounding property than a conventional
grid subdivision.
5) . . .That 2.76 acres, or .56% of the land area In the development, has
been set aside as common open space, said open space to be conveyed to
Stowe Woods Residents. Association, Inc.
6) . . .That Common Open Space, Lot ##5, consisting of 2. 76 acres
,.( Incluslve of perimeter buffer strip) has been planned as large
contiguous unit.
7) . . .That only one ( 1 ) curb cut have been created on Wakeby Road, an
existing public way, which Is sufficient to accommodate foul, (4) new
residential units without resulting In traffic hazards or congestion.
8) . . .That the development will not cause unreasonable traffic
congestion or, unsafe conditions and will comply with town standards
for parking and, road design and construction standard for Stowe Road
are sufficient For today's access needs to the four (4) lot
subdivision.
911 —That the development will provide for convenient and safe
emergency vehicle access to all buildings at all tImee provided that
regular private malntenance of Stowe Road is adhered to.
10) . .That the proposed site design preserves naturat features and
minimizes Boll removal , tree cutting and the disturbance of landscape
and surrounding properties .
Il ) . .Tl)at the nature of soils and subsoils are suited for the Intended

Will be mane in the one hundred ( 100) year flood plain.
DECISION
Based on the evidence submitted and the findings of fact, at a meeting
of. the Planning Board held on January 08, 1990, by a motlon duly rnade
,and seconded the Planning Board, voted to grant a special Permit For
an Open Space Residential Development pursuant to Section 3- 1 . 6 of the
Zoning Bylaw of the Town of Barnstable and subject to the following:
1 ) . .That execution and recording of Town of barnstable Open Space
Residential District Form I and evidence of Its recording submitted to
the Planning Board office within 90 days;
Z) Upon transfer of Stowe Woods Residential Association. Inc. from t1iP
control of the applicant/developer to Its residents (association
members) , the applicant/developer shall cause the Planning Board
Office to be notified of this transfer, the names of association
members, Its officers and the current mailing address of the
association; The Plenning Board grant a reduction, In accordance with
Section 3-1 .6 (6) Bulk Regulations, permitting:
A perlmeter• open space strip of twenty (20) feet east of lots #1
and #2 and west of lots #3 and #4; and
A reduction of the side and rear Yard setbacks to seven and one-
