I have reviewed both the Planning Board and Zoning Board of
Appeals files pertaining to the Marstons Mills Woodlands
Chapter 40B Comprehensive Permit # 1988-68 and Subdivision
#704 . To the best of my knowledge and interpretation of the
facts , the intent of the Comprehensive Permit to grant a
Variance for compliance with the setbacks requirements for
the district was to permit wood buildings and structures to
be located in -the range of 6 to 3 feet from the property
line .
I base this interpretation of the following facts :
1 ) The Zoning Board of Appeals in its Decision to
issue the Comprehensive Permit ( recorded September
29 , 1988 ) granted an unspecified Variance to the
setbacks .
2 ) The Zoning Board of Appeals on October 20 , 1988
( recorded October 25 , 1988 ) , delegated the
location of the homes as "agreed to .. . . [ by] . . . the
Department of Planning & Development " .
3 ) This was followed by a plan dated November 08 ,
" 1988 , and t-Ttled "Building Location Plan Marstons
Mills Woodlands" and it is this plan upon which
the Building Permits were i.ssued by the Building
Department .
4 ) The Variance still requires conformance with State
Building Code , specifically Section. 303 . 2 which
requires that wood frame construction -with
exterior wall located between 6 to 3 feet from the
adjacent lot line shall be of one hour ( 1hr . )
fireresistance rated construction .
