TOWN OF BARNSTABLE ZONING BOARD OF APPEALS f � F COMPREHENSIVE PERMIT CHAPTER 40B ,S` DECISION AND NOTICE PETITION: 1988-68 PETITIONER: MARSTONS MILLS-WOODLAND ASSOCIATES At a regularly scheduled hearing, held on August 4, 1988 and continued on August 25 , 1988 , notice of which was duly published in the Barnstable Patriot, and notice of which was forwarded to all interested parties pursuant to Chapter 40B of the General Laws of Massachusetts, the petitioner, MARSTONS MILLS-WOODLAND ASSOCIATES , through attorney, Peter Freeman, requested a comprehensive permit for Low and Moderate Income Housing pursuant to the provisions of Chapter 40B Section 20 thru 23 of the General Laws of the Commonwealth of Massachusetts on the property located easterly off of Cammett Road Marstons Mills, at Map 99, Lots 53 thru 57 and Map 100, Lots 13 thru 32 containing approximately sixteen ( 16 ) .acres in an RF zoning district. In support of this petition, the Petitioner presented evidence that the following conditions applied which would warrant the grant of. a comprehensive permit. According to the plans submitted the applicant proposes to construct forty-eight ( 48 ) single family dwelling units, of which forty-five ( 45) units will contain two bedrooms and three ( 3 ) units will contain three bedrooms, all on individual lots within a grid-type subdivision. The subject lots include Map 099, Lots 53 thru 57 and Map 100, Lots 13 thru 32. All of the lots have been developed with single-family homes with the exception of Lot 16-3 which is a recreation lot. The property is located in an RF District which normally requires a minimum 30'front yard, 15' side yard and 15' rear yard setback. However, the Board granted waivers to the following sections of the Zoning Ordinance: Section 3-1.4(5) minimum lot area and frontage, Section 2-3.2 conformance to bulk and yard regulations, and Section 5-3.4 lot shape factor requirements. In granting a waiver from bulk and yard regulations, the Board never set specific building setbacks. Technically, residents can build lot line to lot line in this neighborhood.
