I also understand that in some cases the home can be framed per the WFCM too mph Guide, if it meets certain requirements including but not limited to aspect ratio, roof height, number of stories, and exposure category (B).-I have heard that Massachusetts has a "modified" checklist that can be used instead of the checklist at the end of the Guide. Is this true and what can you tell me about this "modified" checklist? Answer: You are correct on the items that you have noted. MA has modified the checklist in several important ways. The MA version allows a roof with a pitch up to and including 8 in 12 to not be "counted" as a story. Further it does not require steel hold downs and straps in many locations if full height sheathing is used as defined in the MA checklist. Further, if the building will have furring strips installed in the ceiling abutting the gable wall then 2 x 4s installed on top of the ceiling joists are not required.There are other changes as well that were not noted here. I noted evidence of tree cutting/clearing on the site (a number of stumps remained visible). I returned to the site at 4:45 PM on March 2 and found the exact same conditions (2 vans - only 1 lettered and 1 SUV), no other vehicles and no one outside. On this date (3/6/17) the caller contacted me once again to complain about the truck in the driveway. He stated that it's a commercial plate, therefore it's a commercial truck and as such I should be fining the property owner. I attempted to explain that the commercial plate is not a violation by itself otherwise I would have to go after every contractor in town. The caller was getting agitated and louder and he told me he cares only about this property and didn't care what I do or didn't do in other areas. Roma, Paul Cc: Scali, Richard Subject: 50 Tupelo Rd I am compelled to provide you with this head's up on a situation that I fear may escalate similar to the Warrick matter. I spoke to an angry neighbor who is complaining about Luiz Fernando Cia of Cia Painting. Mr. Cia resides at 50 Tupelo Rd, Marstons Mills off of Putnam Rd on the Cotuit/MM line. The subject property is contains a modest house situated in very close proximity to larger and more manicured properties. Upon receipt of the initial complaint, I contacted Lt McNeely of COMM FD to advise me regarding the number of vehicles as I was aware-of his location nearby. I then dispatched an inspector to the site as well. I tried to call the owner right away but Mr Cia's phone ,had a message that he was away.for 3 weeks and due back in a couple of days. In the meantime, I sent a cease & desist order to the property owner on 2/13/17. Mr. Cia contacted me immediately upon his return. We talked about the fact that he did not have a home occupation registration on file as well as tthe limitations imposed by that registration agreement and the cease and desist order. Mr. Cia came in later that week and registered per the ordinance requirement. I explained Ao him that he'is allowed one van and one trailer for the business (on site) and that the "approval" is for an administrative office use. There are no employees or signs allowed on the site, and no employee parking or clients are allowed either. Mr. Cia advised me that his employees take the vans home. He agreed that they can be dispatched by phone to the job sites or meet elsewhere in the morning. Mr Cia did request that he be able to retain one extra van for a short time as he has purchased a new one for himself and intends to sell the older one in spring when he he could potentially get more money for it. Without , the business name on the subject vehicle - this did not seem to be an unreasonable request so I agreed. I recommended it be stored in the garage but this may not always be possible. The caller contacted me again on at least two more occasions. I updated him about the cease & desist order I sent and later the caller left me a message to let me know that commercial vehicles remain on site. I went with Bob McKechnie on 2/24/17 and found one work van (lettered), one van (same size - not lettered) and an SUV, all in the circular driveway. I noted evidence of tree cutting/clearing on the site (a number of stumps remained visible). I returned to the site at 4:45 PM on March 2 and found the exact same conditions (2 vans - only 1 lettered and 1 SUV), no other vehicles and no one outside. On this date (3/6/17) the caller contacted me once again to complain about the truck in,the ::driveway. He stated that it's a commercial plate, therefore it's a commercial truck and as such I should be fining the property owner. I attempted to explain that the commercial palate is not a violation by itself otherwise I would have to go after every contractor in town. The caller was getting agitated and louder and he told me he cares only about this property and didn't care what I do or didn't do in other areas. 3/6/2017 Message Page 2 of 2 Subsequently, the caller accused me of not knowing what my job is or how to do it. He insisted he knows what my job is and offered to prove to me that this vehicle is commercial because he has a way to do so. The caller also stated that he will embarrass the town (and me) by going to the next TC meeting and telling everyone publicly that I don't how to do my job or I won't do my job. He added that he will say he knows its a commercial plate and therefore the vehicle is commercial - a violation that I am refusing to address. Before the conclusion of our conversation he stated he will seek an abatement with Assessing because his property is obviously devalued by this property. He continued talking over me and told me that he will not tolerate looking at this ***** of a property and he won't be quiet about it either. I attempted to inform or remind him (as we had spoken about this previously) about the. pending ordinance change that may assist in dealing with these types of complaints but he dismissed the.notion and continued to reiterate that I do not know my job or I refuse to do it.
