In this instance, the applicant is purporting that the lot is a legal pre-existing non-conforming lot with respect to frontage and is therefore developable with the issuance of a special permit. �Q t Zoning History: This area of town was originally zoned Residential Limited in 1956. That designation limited the use of c� lots to residential development only. It did not specify any frontage or area requirement for a lot. On March 4, 1957, Article 58 rezoned the area to Residential D-2 requiring a lot area of 20,000 sq.ft. and 125 feet of lot width. It also specified that the lot must be "separately owned, or which is shown on a plan of lots approved by the Board of Survey and recorded in the Barnstable Registry of Deeds after March 7, 1950 and before the date this by-law is adopted." The area was rezoned to RD-3 in 1961 (Article 59&60)requiring 1-acre lots and 150 feet of width. It was later changed to Residential F in 1978 requiring the 1-acre minimum and 150 feet of frontage. A 1988 plan of land was submitted with the application. That plan documents an access easement/way. Procedural& Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on December 18, 2001. An extension of time for holding the hearing and for filing of the decision was executed between the applicant and the Board. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened February 20, 2002, at which time the Board found to grant the special permit with conditions. Board members deciding this appeal were, Gail Nightingale, Thomas A. DeRiemer, Jeremy Gilmore, Randolph Childs and Chairman Ron•S. Janson. r `, Attorney John R. Alger represented the applicant. Mr. Alger explained the request was to allow the 4.52- acre parcel to be buildable under zoning for one single-family dwelling. He stated that the access is by means of an easemendright-of-way created by deed in 1912, prior to the establishment of the.Board of Survey, and enactment of Subdivision Control and Zoning. He noted that the two lots are set forth in one deed. The division of the lot was done by the Assessor's Office for assessing purposes, for development purposes it remains one lot. They are one lot only for development purposes. Mr. Alger stated that the lot itself was created by deed in 1967, after the access easement was designated. Mr. Alger noted that he had a letter from the Fire Department that the access to the lot was adequate for their purposes and that the hydrant at the end of Turtleback Road was sufficient to service the lot. The public was invited to speak, and Charles Crocker spoke in favor to grant the relief, and discussed the past history of the site and its access. Chairman Janson read a letter from the direct abutter, Jon Halpert who expressed concern that the access easetent not be blocked during or after construction. Findings of Fact: At the hearing of February 20, 2002, a motion was duly made and seconded for the following findings of fact: 1. Appeal 2002— 17 is a request for a Special Permit under Section 4-4, Nonconfotmities. The applicant is Carol A. McCarthy. The lot is commonly addressed as 475&480 Turtleback Road, Marston Mills, MA, as shown on Assessor's Map 062, Parcels 001 and 004. It is in a Residential F Zoning District and the Groundwater Protection&Resource Protection Overlay Districts, 2. Locus consists of 4.52-acres composed of two Assessor's lots. However, it is one lot by deed. The site is accessed by an 18-foot way off of Turtleback Road in Marstons Mills. It is located approximately 575 feet from Turtleback Road. The site has approximately 32 feet of frontage on. Mystic Lake. There is a 1.1 acre cranberry bog and a small pump house on the property. 3. The applicant is seeking a Special Permit under Section 4-4, Nonconformities in terms of the lot to make the parcel developable under zoning for a single-family dwelling. 4. A portion of the lot is located more than 150 feet from wetlands. Development could be achieved without an Order of Conditions from the Conservation Commission. The entire site will support an on-site septic system for a four-bedroom home. No variance will be required from the Board of Heath. 5. The parcel is divided by an 18-foot right of way that provides access to the developed lots on each side of this one. The access easement was created in 1912, and has been used since that time for access and development. 6. The application falls within a category specifically accepted in the ordinance for a grant of a Special Permit. 7. After evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the Zoning Ordinance, and would not represent a substantial detriment to the public good or the neighborhood affected. To develop this oversized parcel would not have an adverse effect or impact on the neighborhood, in fact it would be an improvement. The vote was as follows: AYE: Gail Nightingale, Jeremy Gilmore, Thomas A. DeRiemer and Randolph Childs NAY: Ron S. Janson 2 �• The negative vote was cast citing that the lot,having been created in 1967, after zoning, was not a legal pre-existing non-conforming lot and therefore does not qualify for the grant of the special permit. The easement is not a public way and to allow such lots to be developed would be in derogation of the intent and spirit of the Zoning Ordinance and would intensify the use of a way that does not comply with Planning Board Rules and Regulations pertaining to construction of a way. A 1988 plan of land was submitted with the application. That plan shows an access by means of an easement/way. Procedural & Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on December 18, 2001. An extension of time for holding the hearing and for filing of the decision was executed between the applicant and the Board: A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened February'20, 2002, at which time a motion to grant the appeal did not pass by a vote of 3 affirmative votes and 2 negative,votes. 'The variance was not granted because it failed to receive the necessary 4 affirmative votes. Board Members deciding this appeal were, Gail Nightingale, Thomas A. DeRiemer, Jeremy Gilmore, Randolph Childs and Chairman Ron S. Janson. Attorney John R. Alger represented the applicant. Mr. Alger explained the request was to allow the4.52- acre parcel to be buildable for one single4amily dwelling. He stated that the access is by means of easement/right-of-way created by deed in 1912; prior to the establishment of the Board of Survey, and a enactment of Subdivision Control and Zoning. He noted that.the two lots are really one by deed. The division of the lots was done by the Assessor's Office for assessing purposes, for development purposes it remains one lot. Mr. Alger stated that the present lot was created by deed in 1967. Mr. Alger stated the variance conditions were created by the.fact that the lot does not have frontage, and the hardship is due to shape, with no access, or roadway. The access easement that was designated back in 1912 divides the lot into two parts. Mr. Alger noted that he had a letter from the Fire Department that the access to the lot was adequate for their purposes and that the hydrant at the end of Turtleback Road was sufficient to service the lot. The public was invited to speak, and Charles Crocker spoke in favor to grant a relief, and discussed the past history of the site and its access. Chairman Jansson read a letter from the direct abutter, Jon Halpert who expressed concern that the access easement not be blocked during or after construction. Findings of Fact: At the hearing of February 20, 2002, a motion was duly made and seconded to find the following findings of fact: 1. Appeal 2002 — 16 is a request for a Variance to Section 3-1.4(5) Bulk Regulations, Minimum Lot Frontage. The applicant is Carol A. McCarthy. The lot is currently addressed as 475 & 480 Turtleback Road, Marstons Mills, MA, as shown on Assessor's Map 062, Parcels 00l .and 004. It is in a Residential F Zoning.District with Groundwater Protection and Resource Protection Overlay Districts. 2. Locus consists of 4.52-acres composed of two Assessor's lots. However, it is one lot by deed. The site is accessed by an 18-foot way off of Turtleback Road in Marstons Mills. It is located approximately 575 feet from Turtleback Road. The site has approximately 32 feet of frontage on Mystic Lake. There is a 1.1 acre cranberry bog and a small pump house on the property. 3. The applicant is seeking a Variance to Section 3-1.4(5) Bulk Regulations, Minimum Lot Frontage. 4. A.sufficient area of the lot is located more that 150 feet from wetlands and development could be achieved without an Order of Condition from the Conservation Commission. The entire site will support an on-site septic system for a four-bedroom house. No variance will be required from the Board of Health. 5. The cranberry bog area of the site is at an elevation of 49 feet. The topography rises to a height of 76 feet on the easterly side of the lot. The applicant has identified that the dwelling will be located to the westerly side of the property. Variance conditions are established by the shape and topography of the lot and further complicated by the unique condition of the 18-foot right of way that segments the parcel into two. This division of the lot by the easement prohibits use of the parcel and also lends itself to the grant of the variance and development of the easterly side for a residence. The parcels on both sides of this one are developed, and use the easement for access. 6. Those conditions cited above make this a unique lot and justify the granting of the relief 7. A literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise to the petitioner and the relief may be granted.without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. 2 4 The vote was as follows: AYE: Gail Nightingale, Jeremy Gilmore and Randolph Childs NAY: Thomas A. DeRiemer and Ron S. Janson The negative votes were cast citing that they believe that no unique conditions exist. The shape of the lot is not unique and many lots of similar size with no roadway frontage exist across the Town. The easement does not create uniqueness in terms of shape. The granting of this Variance would be in derogation of the spirit and intent of the Zoning Ordinance in view of the fact that the lot has no frontage and the Town has most recently expressed concern over development by enacting two acre zoning for purposes of reducing density in this area. To allow a Variance to be granted under these circumstances opens up the possibility for the development of lots currently unbuildable. Decision: Based on the findings of fact, a motion was duly made and seconded to grant the appeal with the following condition: 1. Assessor's Parcel Number 001 and 004 are to be used as one for the purposes of this development. 2. Development of the single-family dwelling shall be substantially as presented to the Board in plans submitted for the dwelling. 3. The use of the property shall conform to all requirements of the Residential F Zoning.District. 4. The location of all buildings related to the single-family .use shall be without the need for an order'of conservation and without variance from the Board of Health. 5. It also specified that the lot must be 'separately owned, or which is shown on a plan of lots approved by the Board of Survey and recorded in the Barnstable Registry of Deeds after March 7, 1950 and before the date this by-law is adopted." The area,was rezoned to RD-3 in 1961 (Article 59 & 60) requiring 1-acre lots and 150 feet of width. It was later changed to Residential F in 1978 requiring the 1-acre minimum and 150 feet of frontage. A 1988 plan of land was submitted with the application. That plan documents an access easement/way. Procedural & Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on December 18, 2001. An extension of time for holding the hearing and for filing of the decision was executed between the applicant and the Board. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened February 20, 2002, at which time the Board found to grant the special permit with conditions. Board members deciding this appeal were, Gail Nightingale, Thomas A. DeRiemer, Jeremy Gilmore, Randolph Childs and Chairman Ron S. Jansson. Attorney John R. Alger represented the applicant. Mr. Alger explained the request was to allow the 4.52- acre parcel to be buildable under zoning for one single-family dwelling. He stated that the access is by means of an easement/right-of-way created by deed in 1912, prior to the establishment of the Board of Survey, and enactment of Subdivision Control and Zoning. He noted that the two lots are set forth in one deed. The division of the lot was done by the Assessor's Office for assessing purposes, for development purposes it remains one lot. They are one lot only for development.purposes. Mr. Alger stated that the lot itself was created by deed in 1967, after the access easement was designated. Mr. Alger noted that he had a letter from the Fire Department that the access to the lot was adequate for their purposes and that the hydrant at the end of Turtleback Road was sufficient to service the lot. The public was invited to speak, and Charles Crocker spoke in favor to grant the relief, and discussed the past history of the site and its access. Chairman Jansson read a letter from the direct abutter, Jon Halpert who expressed concern that the access easement not be blocked during or after construction. A portion of the lot is located more than 150 feet from wetlands. Development could be achieved without an Order of Conditions from the Conservation Commission. The entire site will support an on-site septic system for a four-bedroom home. No variance will be required from the Board of Heath. 5. The parcel is divided by an 18-foot right of way that provides access to the developed lots on each side of this one. The access easement was created in 1912, and has been used since that time for access and development. 6. The application falls within a category specifically accepted in the ordinance for a grant of a Special Permit. 7. After evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the Zoning Ordinance, and would not represent a'substantial detriment to the public good or the neighborhood affected. To develop this oversized parcel would not have an adverse effect or impact on the neighborhood, in fact it would be an improvement. Planning Division-Staff Report Staff Review: 'The bog area of the site is at an elevation of 49 feet. The topography rises to a height of elevation 76 feet on the easterly side. The applicant has presented plans for the development of a two-story,.4-bedroom' single-family dwelling measuring 63 feet by 49.5 feet overall, inclusive of a two-car garage, covered porch and open-air deck. The applicant has identified that the dwelling is to be located to the westerly side of the property. Ir appears that sufficient area of the lot is located more that 150 feet from wetlands and that development could be'achieved without an Order of Conservation. Given that the entire site has 4.52 acres, it also appears that an on-site septic system could be designed for a four-bedroom home that complies with the 330 Rule and Title V without variances for the Board of Heath. With respect to the special permit, the applicant must substantiate that the lot was legally established under zoning and that it pre-dates the inception of subdivision control; 1972. Zoning History: This area of town was originally zoned RL—Residential Limited in 1956. That designation limited the use of lots to residential development only. It did not specify any frontage or area requirement for a lot. On March 4, 1957, Article 58 rezoned the area to Residential D-2 requiring a lot area of 20,000.sq.ft. and 125 feet of lot width. It also specified that the lot must be "separately owned, or which is-shown on a . plan of lots approved by the Board of Survey and recorded in the Barnstable Registry of Deeds after March 7, 1950 and before the date this by-law is adopted."(See attached 1957 Bylaw page 11) .
