The subject locus was taken by the town in 1991 as the result of failure by the Association to redeem a tax lien. Reported to caller's property located at 40 Viola, MM at approximately 11:15 AM with Bob McKechnie. According to Ellen the caller stated that heavy equipment and clearing was occurring place this morning. Found property owner burning wood in rear yard. No heavy equipment or clearing was found; asked property owner to show us the clearing. 1 noted that this property owner was cleaning, clearing and burning natural debris collected from open space area directly abutting his rear property line. The owner pointed out the path to us and stated that a bull dozer created it. He added that one tree had been removed in the process. I found the path to be a typical foot path still covered in organic material contrary to what a bulldozer would do. The path is apparently used by riders from the horse farm to connect to a nearby ancient fire road. It is logical to assume this path was created with the intent to exercise the horses as this newly created path combined with the fire road would be a considerable distance and likely adequate for exercising the horses. The property owner stated he did not object to the horses using this path—he stated that they are quiet. At no time did he mention any motorized vehicles accessing the path. Documents available to us reveal that permission is required for use of the open space area but there are provisions for agricultural and horticultural uses. Horse farms and associated uses fall under the agricultural use.
