The current exemption for"homeowners"was extended to include owner-occupied dwellings of six units or
less and to allow homeowners to engage an individual for hire who does not possess a license,provided that
the owner acts as supervisor.
DEFINITION OF HOMEOWNER
Person(s)who owns a parcel of land on which he/she resides or intends to reside,on which there is, or is
intended to be,a one or two-family dwelling, attached or detached structures accessory to such use and/or
farm structures. A person who constructs more than one home in a two-year period shall not be considered
a homeowner. Such"homeowner"'shall submit to the Building Official on a form acceptable to the . .
Building Official,that he/she shall be responsible for all such work performed under the building permit.

with the State Building Code Section 127.0 Construction Control.
HOMEOWNER'S EXEMPTION
The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the
provisions of this section(Section 109.1.1-Licensing of construction Supervisors);provided that if the homeowner engages a
person(s)for hire to do such work,that such Homeowner shall act as supervisor."
Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see
Appendix Q,Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in
serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the \
unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible.
To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit
application,that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a
form currently used by several towns. You may caret amend and adopt such a form/certification for use in your community.

Dear Mr. Counsell:
Please be advised that the debris was removed from the
Ancient Way adjacent to 21 Wakeby Road, Marstons 'Mills,
prior to the issuance of an Occupancy Permit. Our records
indicate that the site was inspected and released by the
Engineering Department.
While I understand your concern re the Ancient Way I must
advise you that this office has no jurisdiction over Ancient
Ways. Section 2 of Article VIII of the Town of Barnstable
General Ordinances gives the control of Town Ways to the
Town Manager. For further information re Ancient Ways you
may find the 1980 Court decision in the case of Fenn vs.
Middleboro of interest. .. The decision "put to rest" the
concept of Ancient Ways.

Dear Mr. DaLuz:
On June 9th, we wrote you a letter regarding the "Ancient Way" running
from Wakeby Road to Kerry Drive. Since it is the only access to the
Barnstable Conservation Foundation's property (Map 60, Parcel 10), we
requested that you require the developer to reopen this way so that we may
reach and maintain our property.
To date we have not received a response.
This road first appeared- on the 1856 Map of Ways of the Town. It was part
of River Road which the. Town never discontinued. It now appears as a
continuation to Hi-River Road, which is a defined layout according the Town's
Engineering Department.
According to a memo from Frank Schlegel to Tom Mullen dated May 8, 1992,
the road has been determined to be a partially defined, Ancient-Private Way.
That letter also states that you would forward formal complaints to
Engineering so that proper action could be taken during the occupancy
inspection of Mr. Franco's property.
Our letter of June 9th was a "formal complaint".
Would you please advise us, in writing, of the action you have taken to
ensure that the "ancient way" will not be subject to any adjacent landowners'
attempts to close the way.

In early May ;the issue of. an .""Ands nt. Way' came.' to.. my
attention.. After lengthy, discussion I referred the.
builder to the Engineering Department since it would be
under their jurisdiction. See attached copy of a report to .
Tom Mullen from Frank Schlegel.
I have also spoken with Mrs. Riley and assured her that I
would work with the Engineering Department to attempt to
resolve this issue.
There are two (2) points I should clarify. First, this
office has no jurisdiction 'over "Ancient Private Ways" .and
second, the performance bond that is required prior to the
issuance of a building permit covers "erosion or damage
within passable street rights of way" .
Finally, I had a recent conversation with the owner of the"
dwelling under construction and he "assures" me that when• he"
completes the construction he will 'cle'ar all the debris and
"reopen" the way.

SUBJECT: Status of "Dirt Road" Running from Wakeby Road to
Kerry Drive in Marstons Mills
Research of Engineering records shown this way to be a "Partially Defined
Ancient Private Way. "
Concern regarding this dirt way has been brought to my attention in recent
weeks by phone calls and 'office visits. The abutters have complained that
Mr. Franco's Development of an abutting parcel, including blocking off this
way at various locations have been ekpressed.
Researching DPW Records, I have found extensive evidence of its 'existence. .
It first appeared on our 1856 Map of Ways of the Town. It apparently was
originally part' of "River Road" . The Town layout of River Road did not
discontinue this old portion. It now appears as a continuation to
Hi-River Road which is a defined layout. Land abutting to 'the West defined
by L.C. 35186B ( 1972) shows Kerry Drive ending at. "A Way" and gives a
Westerly side line definition to this way. Rights of Access by Kerry Drive
abutters is undetermined at this time. A plan in File Drawn in 1977 .(not
endorsed by the Planning Board) shows this way as sole access. to a parcel
which is now owned by Barnstable Conservation Foundation, Inc. A plan
drawn in 1987 for Bradgate Associates to the East of this way does not show
.a traveled way in this area. - However, this plan is an "approval not
required" plan and was mot approved . for elimination of ways as described in
the Town's Subdivision Control Laws.
Therefore after discussion with Arthur Marney, Town Surveyor, and Steve
Seymour, Senior Project Engineer, it was been determined that this is
partially defined, Ancient-Private Way.
In order for. Engineering to request the way to be opened by Mr. Franco, the
. abutters were requested, by me, to write/petition Joseph DaLuz to take
necessary action to insure Mr. Franco will re-open this way. Mr. DaLuz
agrees with this finding and will forward any formal complaints to '
Engineering so that proper action may be taken during occupancy inspection
of Mr. Franco's property.
Since this is a private ancient way that provides primary access to only
one identifiable parcel owned by the Barnstable Conservation Foundation,
Inc. , immediate action has not been taken since we have not received formal
complaint from the Foundation.
