PowerGuide is a proprietary monitoring system designed and installed by SolarCity that captures and displays historical energy generation data over an Internet connection and consists of hardware located on site and software hosted by SolarCity. If your System is not operating within normal ranges,PowerGuide will alert us and we will remedy any material issues promptly. (d) Maintenance and Operation (i) General When the System is installed,SolarCity will provide you with a link to its Solar Operation Guide.This Guide provides you with System operation instructions,answers to frequently asked questions,troubleshooting tips and service information. SolarCity will perform all required System maintenance. (ii) PowerGuide PowerGuide requires a high speed Internet line to operate.Therefore,during the Power Purchase Agreement Term,you agree to maintain the communication link between PowerGuide and the System and between PowerGuide and the Intemet. You agree to maintain and make available,at your cost,a functioning indoor intemet connection with a router,one DHCP enabled Ethernet port with intemet access and standard AC power outlet close enough and free of interference to enable an intemet-connected gateway provided by SolarCity to communicate wirelessly with the system's inverter(typically this is 80 feet,but may depend on site conditions). This communication link must be a 10/100 Mbps Ethernet connection that supports common Internet protocols(TCP/IP and DHCP). If you do not have and maintain a working high speed Internet line we will not be able to monitor the System and provide you with a performance guarantee or provide PowerGuide. SOLARCITY'S STANDARDS For the purpose of this Limited Warranty the standards for our performance will be(i)normal professional standards of performance within the solar photovoltaic power generation industry in the relevant market;and(ii)Prudent Electrical Practices. 'Prudent Electrical Practices"means those practices,as changed from time to time,that are engaged in or approved by a significant portion of the solar power electrical generation industry operating in the United States to operate electric equipment lawfully and with reasonable safety,dependability,efficiency and economy. 4. SYSTEM REPAIR,RELOCATION OR REMOVAL (a) Repair. You agree that if(i)the System needs any repairs that are not the responsibility of SolarCity under this Limited Warranty,(ii)the system needs to be removed and reinstalled to facilitate remodeling of your Home or(iii)the system is being relocated to another home you own pursuant to the Power Purchase Agreement,you will have SolarCity,or another similarly qualified service provider,at your expense, perform such repairs,removal and reinstallation,or relocation. (b) Removal/Moving. SolarCity will'remove and replace the System from your roof while roof repairs are being made for a payment of$499. You will need to provide storage space for the System during such time.Where permitted under the PPA,SolarCity will work with you to move the System to your new home as follows:(i)SolarCity will conduct an audit of your existing Home and new home to determine if a move is commercially feasible. This audit will cost$499. If SolarCity determines that a move is commercially feasible,it will then move the System for an additional payment of$499. (c) Return.If at the end of the Term you want to return the System to SolarCity under Section 17 of the PPA then SolarCity will remove the System at no cost to you. SolarCity will remove the posts,waterproof the post area and return the roof as close as is reasonably possible to its original condition before the System was installed(e.g.ordinary wear and tear and color variances due to manufacturing changes are excepted). SolarCity will warrant the waterproofing for one(1)year after it removes the System. You agree to reasonably cooperate with SolarCity in removing the System including providing necessary space;access and storage,and we will reasonably cooperate with you to schedule removal in a time and manner that minimizes inconvenience to you. 5. The family apartment unit is existing and is occupied by the owners' daughter, Mariellen Coy and granddaughter, Brittany Coy. The family apartment is located in an existing 24' by 40' ranch house. The apartment is a two bedroom one bathroom unit with a kitchen and living room. The property is served by public water and private septic. According to the Assessor's Records,the gross floor area of the existing single-family dwelling is 960 sq.ft. Based on a sketch plan submitted by the applicant, an area in the basement of approximately 850 sq. ft. is used for the Family Apartment. The Family Apartment represents approximately 47% of the total inhabited area of the house. The existing house meets all of the requirements for front, side and rear setbacks for the RF Zoning District as documented on a surveyed plan,titled "Mortgage Inspection Plan" and scaled 1;;=30'. submitted with the application. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on March 7, 1996. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened on April 10, 1996, at which time the Board found to grant the appeal with conditions. Board members hearing this appeal were Gene Burman, Richard Boy, Emmett Glynn, Robert Thorne, and Acting Chairman Ron Jansson. Hearing Summary: The applicant, Albert B. Baker, represented himself during the hearing. Also present was his daughter. who will be occupying the family apartment. Mr. Baker noted that the apartment exists in the lower level of the home already and was developed approximately 4 years ago. It is a two bedroom unit; however, at the present time,the second, smaller bedroom is.used as a play room. In the main house were three bedrooms, but one has been converted into a utility room. Including the principal residence and the apartment unit, the total number of bedrooms on the property is four. Zoning Board of Appeals-Decision and Notice - Appeal No. 1996-31 -Baker-Special Permit-Family Apartment Mr. Baker cited that the apartment unit is to be occupied by his daughter and her young child. He expressed his desires to have them living in the unit because he was concerned for her well-being and safety. He has owned the home for 25 years and it is the family's permanent residence. He cited that he would be upgrading the septic to a Title V Septic System and would be visiting the heath department for this. 'It was noted that this would be required when the building permit is applied for that would be required by the Building Commissioner for final approval and occupancy of the unit. The public was requested to testify. No one spoke in opposition and no one spoke in favor of this appeal. Finding of Facts: Based upon the testimony given during the public hearing on this appeal, the Board unanimously found the following findings of fact: 1. The family apartment is located in an existing 24' by 40' ranch house. The apartment is a two bedroom one bathroom unit with a kitchen and living room. 2. The gross floor area of the existing single-family dwelling is 960 sq.ft. and the area used for the Family Apartment located in the basement is approximately 850 sq. ft. The Family Apartment represents approximately 47% of the total inhabited area of the house. 3. The entire structure has a total of 4 bedrooms including the principal dwelling and the apartment unit. 4. The applicant is in compliance with Section 3-1.1(3)(D) Family Apartments of the Zoning Ordinance. 5. Granting of the special permit for the.family apartment would not be in derogation of the Zoning Ordinance nor detrimental to the neighborhood. Decision: Based upon the positive findings a motion was duly made and seconded to grant a Special Permit in accordance with Section 3-1.1(3)(D) with the following conditions: 1. The applicant shall apply for a building permit from the building department for the construction and occupancy of the apartment unit to assure that all town records are updated and that the apartment is in compliance with applicable regulations. 2. The applicants have owned the home for 25 years and according to the Town of Barnstable List of Persons the home is their permanent address. Assessor's records however reflect a finished basement of 576 sq. ft. rather than an apartment. These should be updated to reflect the actual square footage and the existence of the apartment. The lot is .47 acres and is located within the WP -Wellhead Protection Overlay District. This district contains land in an area directly influencing the quality of groundwater drawn for public drinking water. Thee is a requirement that no more than 15% of the lot, or approximately 3,060 sq. ft., be impervious material. Allowing for the house, this would leave approximately 2,100 sq. ft. for driveways, walkways etc. It is also required that 30%of the lot or 6,140 sq. ft., be left in its natural state. The property is subject to the Board of Health General Ordinance Article XLVII "Regulation of Wastewater Discharge" commonly termed "the 330 gal/day/acre rule"The present home is identified as a 3 bedroom dwelling (with the basement a finished rec room) on Assessor's Records and the family apartment is 2 bedrooms. The 5 bedrooms represents an estimated 550 gal/day. This exceeds the 330 Rule which would allow 155 gal/day due to the size of the lot. Appeal No. 1996-29-.Baker Special Permit-Family Apartment The Board may wish to ask the Applicant to obtain a variance from-the Board of Health which may grant a ' variance to the 330 rule. The applicant owns an adjacent vacant lot, Assessor's Map/Parcel 43/14, which if combined with this lot would reduce the nonconformity due to the additional acreage. Staff Recommendation: Since the applicant's property is in the WP -Wellhead Protection District, and appears not to be in compliance with the 330 Rule, the Board may wish to request the applicant to obtain approval of the Board of Health before approving the Special Permit for the Family Apartment.
