Re: Lots 43-7-1 & 43-21, Wakeby Road, Marstons Mills
Dear Mr. Goldberg:
I have undertaken more research into the two lots you are inquiring about and can now
w
tell you much more about them.
1. Lot 43-21 (2) is just over 20,000 s.f and could be buildable; however, without all
deeds back to 1972 on this lot and all lots that touch it, I can't be sure.
2. Lot 43-7-1 is a half-acre parcel owned by Jane Lincoln. I notice she also owns the
main parcel you want to purchase(parcel 43-5-1).. Prior to the 1986 subdivision plan that
created the strip of open space between the two lots, it appears these two were
contiguously owned. Therefore, I would say that Lot 43-7-1 is not buildable. This
opinion is subject to challenge to the Zoning Board of Appeals at any time in the future, of
course.
Best of luck on your decision, but neither lot has an easy answer. Given your story,
though, I would recommend you consider buying them to protect your interests against
someone obtaining Zoning Board approval to build there.

Dear Mr. Crossin:
First, thank you for taking the time to meet with me today regarding the above-referenced lots. I
did go over to Planning, however, I am still not sure about the buildable nature of these two lots.
Before I purchase them, I would appreciate greatly if you would provide for me a written formal
opinion regarding these lots. Specifically, I would like to know if these two lots are buildable.
Lot 43-21(Builder's Lot 2) - the subdivision was endorsed on April 20, 1973. The plan is
"Goolishian#238."
Lot 43-7-1 is shown on a plan entitled"Winslow Woods "dated April 30; 1986.
If there is any further information that you may require, please do not hesitate to give me a call.
