Dr.Mark Oldham. Property Address: 362 Wakeby Road,Marstons Mills,MA Assessor's Map/Parcel: Map 028,Parcel 051 Zoning: Residential F,Wellhead Protection&Resource Protection Overlay Districts Background&Relief Requested: The locus of this variance request is shown on Assessor's Map 028,Parcel 051 addressed as 362 Wakeby Road,Marston Mills. It is a vacant 0.49-acre lot.The applicant is Dr.Mark Oldham,who purchased the property on June 17,2002 as recorded in Registry of Deeds,Book 15272,Page 317. Applicant seeks a variance to Bulk Regulations for minimum lot area and frontage in order to construct a single-family residence with three bedrooms. The minimum required lot area of the Resource Protection Overlay District is 87,120 sq.ft. The subject_ lot contains an area of 21,359 sq.ft. The minimum frontage requirement is 150 feet and the subject lot has 98 feet of frontage on Wakeby Road. Procedural&Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on May 08,2003. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened July 09,2003,and continued to August 20,2003,at which time the Board found to grant the appeal. Board Members deciding this appeal were;Richard L.Boy,Ralph Copeland,Sheila-Geiler,Gail Nightingale,and Chairman Daniel K Creedon III. Attorney Robert J.Galibois,II represented the applicant Dr.Mark Oldham,who was present in the audience. Attorney Galibois described the lot and history of it;362 Wakeby Rd.is known as Lot A of about 21,000 sq.ft.with 98 ft.of frontage, The subject parcel was owned in 1973 by the Souza family who conveyed lot A and B (348 Wakeby Rd) to John King Jr. He then conveyed lot B to his mother Christine King in 1976 but the deed was not recorded until March 17, 1987. Mr.King deeded 362 Wakeby Road to Dr.Oldham last year. Zoning was changed in 1978 to Residence F,requiring one-acre minimum lot area and 150 feet of frontage. However in 1997,a building permit was issued for the neighboring Lot- B (348 Wakeby Rd.). A permit has also been sought for the subject lot,but it was voided and only an on-site septic system was installed. It was shortly thereafter determined by the Building Division that the subject lot was undersized and that the two lots had merged under zoning. f ' 6< The Board asked several questions regarding the issuance of the Building permits and why one was rescinded. They also asked if anyone had checked into the zoning and buildablity of the lot? Mr.Galibois stated that Dr.Oldham purchased the land for$110,000 and it was assumed to be developable under zoning given that the earlier permit had been issued and that a septic system did get installed. Concerns were expressed with regards to the roadway and traffic in the area. It was noted that this is a Resource Protection Area that now requires two acres. _The question was raised if the lots had merged or not. Other questions raised concerned when the conveyance occurred,when the deed was delivered and why the deed was not recorded until 11 years after it was signed?It was noted that delivery and acceptance makes the conveyance. Mr.Galibois stated that the merger is not the issue before the Board. A variance has been requested. He cited the variance conditions as one of hardship that is financial in nature,in that a bank mortgage is on the land. He stated that to grant the variance would not be in derogation of the Ordinance in that there are many other lots of the same size in the neighborhood and that the uniqueness is in fact that an on-site septic system was permitted. The public was invited to comment and no one spoke for or against this appeal. The Board determined that it needed more information and requested information from the legal department as to the timing of a conveyance,and information from Building and Health Divisions with regards to past permits. The hearing was continued to August 20,2003. At that continuance,the responses were read. The Building Commissioner also attended and noted that the lots had merged immediately after the 5-year protection. Attorney Galibois agreed that the lot had merged. He again sum_manzpd the variance conditions and requested that the Board act on that request. The applicant Dr.Mark Oldham spoke and noted the history of events and stated that he and others all assumed the lot to be build able. Findings of..-Fact At the.hearing of August 20,2003,the Board made the following findings of fact: 1. Mark Oldham has applied for a Variance to Section 3-1.4(5) Bulk Regulations,Minimum Lot Area and Frontage to permit the construction of a 3 bedroom,single-family residence on a 21,359 sq.ft.lot with 98 feet of frontage. The subject property is located as shown on Assessor's Map 28,Parcel 51 addressed as 362 Wakeby Road,Marston Mills,MA in a Residential F Zoning District. 2. The propertywas recently purchased for$110,000 and has been assessed as build able. 3. A literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise to the petitioner. 4. The relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Decision: Based on the findings of fact,a motion was duly made and seconded to grant the variance with the following conditions: 1. Development of the lot shall be limited to a 3-bedroom dwelling without variance or waiver from any other applicable regulations of Zoning,Health,Conservation and Building. i 2. Compliance with all Board of Health,Fire Dept.and Building Codes and regulations. From what I can gather from the building department's files is that on April 15, 1997 permit#22399 was issued to Breen Construction to construct a 3 bedroom,2 bath home on the property known as lot B,348 Wakeby Rd.,Marston Mills. Then,on July 10, 1997 the applicant provided this department with a handwritten letter requesting to rescind the permit because Atty.King could not convey the lot'at that time. His mother had recently died and the estate was in probate. On March 26, 1998 a letter was addressed to Breen Construction returning the road bond for both 348 and 362 Wakeby Rd. This is one of our bond return form letters stating that we are returning the bond because a certificate of occupancy has been issued. Obviously the wrong form letter was sent since no house was built on either lot at that time. On August 10, 1999 a permit was issued to Ridgewood Custom Homes to construct a 3 bedroom home on Lot B,#348. Previous to the issuance of this permit a letter with the relevant deeds was submitted to Ralph Crossen stating the ownership history. The letter states that the parcel was conveyed to Christine King on August 18, 1976 for the sum of$2000.00.The deed that was submitted for the issuance of the permit to Ridgewood Custom Homes did not show a recorded date. This is why,I suspect,that this was never an issue and building permits were subsequently issued. The more recent copies of the deed submitted to this office show the recording date of March 17,1987,some 11 years after the conveyance of the lot. Lot A,#362 has a similar permitting history in that on April 15, 1997 building permit#22397 was issued for a 3 bedroom home to Breen Construction. On July 10, 1997 the applicant requested,for the same reasons given for the cancellation of construction on lot B,that the permit be rescinded. This was done voluntarily by the applicant and not instigated by any action of the building department. The road bond was returned on March 26, 1998. King, Jr... , the current owner of Lot A, at 362 .Wakebey Road in Marstons Mills, " Massachusetts. I write to you at.;this - time because of concern about the Town' s refusal to make an indication that the above noted Lot is buildable. This failure by the Town seriously impacts the current pending sale of said Lot by my client and therefore requires your immediate attention. I little history is in order. My client purchased both- Lots A and B on February 24, 1973. While there has been a single conveyance for the property since then, the Building Inspector for the Town of. Barnstable indicated to my client in March of 1995 that both Lots were buildable because they were owned by different parties as of 1976 (my client had transferred one of .the Lots to his mother, prior to that date) . The Lots were surveyed and plans were drawn for septic disposal systems in compliance with Title V and those plans were approved by the Board of Health. Septic permits were issued on April 30, 1995 and renewed on April 22, 1998. .. In July, .1999, . Lot B was sold and the purchasors of that Lot used the original septic permit and plans to obtain a building permit in September of 1999. They built their home and received a Certificate of Occupancy in February, 2000. a Robert D. Smith, Esquire January 29, 2002 Page 2 In February, 2001, Mr. King was advised by Gerry Dunning of the Board of Health to install a septic system in Lot A before the permit expired on April 22, 2001. His instructions were that my client could build a house later. A new septic system was installed at a cost of over $6, 000. 00. Under the present procedure, I believe that 10 building permits are given per month by lottery. However, here is where the problem starts: my client was informed that he could not seek approval to join the Building Permit Lottery for Lot A, despite the fact that Lot B had already been provided a building permit, my client had installed a town approved septic system and he was prepared to proceed with' the Purchase and Sale Agreement for that property based upon the fact that it was buildable. The excuse given was that Lot A could not be given a building permit because of the date. of recording of the deed. This refusal by the Town becomes very difficult to comprehend in light of the fact that the same date of recording Lot B was the same time as that of Lot A and yet a building permit issued and, in fact, a house had been built on said Lot B. My client and I would greatly appreciate your making inquires into this particular matter in order to assure that my client' s rights are not delayed or denied any further as I believe the`Town is estopped from denying my client the ability to enter the building permit lottery. Your expeditious attention to this matter is greatly appreciated. This failure by the Town seriously impacts the current pending sale of said Lot by my client and therefore requires your immediate attention. t I little history is in order. My client purchased both Lots A and B on February 24, . 1973. While there has been a single conveyance for the property since then, the Building Inspector for the Town of Barnstable indicated to my client in March of 1995 that both Lots were buildable because they were owned by different parties as of 1976 (my client had transferred one of the Lots to his mother, prior to that date) . The Lots were surveyed and plans were drawn for septic disposal systems in compliance with Title V and those plans were approved by the Board of Health. Septic permits were issued on April 30, 1995 and renewed on April 22, 1998 . , In July, 1999, . Lot B was sold and the purchasors of that Lot used the original septic permit and plans to obtain a building permit in September of '1999. They built their home and received a Certificate of Occupancy in February, 2000. Robert D. Smith, Esquire January 29, 2002 Page 2 In February, 2001, Mr. King was advised by Gerry Dunning of the Board of Health to install a septic system in Lot A before the permit expired on April 22, 2001. His instructions were that my client could build a house later. A new septic system was installed at a cost of over $6, 000. 00. Under the present procedure, I believe that 10 building permits are given per month by lottery. However, here is where the problem starts: my client was informed that he could not seek approval to join the Building Permit Lottery for Lot A, despite the fact that Lot B had already been provided a building permit, my client had installed a town approved septic system and he was prepared to proceed with the Purchase and Sale Agreement far that property based upon the fact that it was buildable. The excuse given was that Lot A could not be given a building permit because of the date of recording of the deed. This refusal by the Town becomes very .difficult to comprehend in light of the fact that the same date of recording Lot B was the same time as that of Lot A and yet a building permit issued and, in fact, a house had been built on said Lot B. My client and I would greatly appreciate your making inquires into this particular matter in order to assure that my client' s rights are not delayed or denied any further as I believe the`Town is estopped from denying my client the ability to enter the building permit lottery. Your expeditious attention to this matter is greatly appreciated.
