A person who constructs more than one home in a two-year period shall not be considered a homeowner. Signature of Homeowner i Approval of Building Official Note: Three-family dwellings containing 35,000 cubic feet or larger will be required to comply with the State Building Code Section 127.0 Construction Control HOMEOWNER'S EXEMPTION The Code states that "Any homeowner performing work for which a building permit is required shall be exempt from the provisions of this section(Section 109.1.1 -Licensing of construction Supervisors);provided that if the homeowner engages a person(s)for hire to do such work,'that such Homeowner shall act as supervisor. Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q, Rules&Regulations for Licensing Construction Supervisors,Section 2.15).This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application, that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently used by several towns. You may can t amend and adopt such a fonn/certification for use in your community. This plan is attached as a reference and marked "A". A. Issue: Can Lot F-2 be used as the site of a single`farnily residence, i.e., is it buildable of right? B. Answer: Lot F-2 is buildable by right. C. Background: The facts are that you succeeded to ownership of that lot which is unimproved when it was conveyed to you by John E. Barnard, Jr., along with Lot E as shown on a plan at Plan Book 240, Page 41 at that Registry, also attached and marked "B". The two lots are contiguous sharing a common boundary of 245.31 feet as shown on the 446/57 plan. Mr. Barnard was the owner of and developer of land'on the 446/57 and 240/41 plans. Lot F-2 has 212.6 feet of straight line frontage on Race Lane, a county way, area of 44,386 sq. ft. lot area with a shape factor shown on the plan of 15.91. Lot E has 151.94 feet Hof arc frontage and 24.56 feet of straight''line frontage on Wheeler Road, a subdivision way with lot area of f 89,600 sq. ft. The shape factor of Lot E is 20. Lot E is improved with a single family house. Section 240-7.D.of the Barnstable zoning bylaw says that to meet minimum lot size requirements in a residential district,the shape factor may not exceed 22. Briggs September 16, 2010 Page - 2 - Both lots are in the RF residential zone, the Groundwater Protection Overlay District ("GP") and the Resource Protection Overlay District (RPOD"). Overlay districts are requirements in excess of the basic zone and may overlay several different districts. The RF zone requires a lot area of 43,560 sq. ft. with frontage of 150 feet. The GP district imposes no dimensional requirements but forbids uses which might affect -groundwater-quality. It does not limit se,,vered.lots or those meeting state and loch! standards for septic systems. The Barnstable zoning bylaw, Chapter 240, is the source for the zoning requirements. The RPOD zone which was added on October 26, 2000 requires a minimum lot size of 87,120 sq. ft. (2 acres) for newly created and certain other lots. D. Analysis The RF zone allows single family residences by right. Lots E and F-2 readily meet the frontage area and the lot shape factors required within the RF zone. As noted above,the GP district does not impose significant limitations on the use for a single or two family residence. However, according to Section 240-36 of the bylaw, the RPOD district was created to protect water recharge for areas of the town deemed sensitive and, at subsection D, it imposed a minimum lot area requirement of 87,120 sq. ft. Lot E meets that threshold but Lot F-2 does not. The question is, since you own both Lots E and F-2, is there a merger of the two lots so that F-2 is not separately buildable. The answer is set forth in Section 240-91:G. which governs nonconforming lots in the RPOD district. At subsection (1). it states [a]ny increase in area frontage width or depth requirements of the Resource Protection Overlay District shall not apply to a lot for single- or two- family residential use which immediately prior to November 16, 2000 . . . (a)conformed to the applicable bulk requirements of this chapter immediately prior to November 16, 2000 Bylaw at Chapter 240-91 G(1)(a). The"applicable bulk requirements of this chapter"refer to the lot area, lot shape factor and frontage requirements for the underlying RF zone. The subject lot conforms to those requirements presently and is,therefore,presumed to have so conformed to those bulk requirements as of November 16, 2000.
