DEFINITION OF HOMEOWNER: Persons) who owns a parcel of land on which he/she resides or intends to re- side, on which there is, or is intended to be, a one or two family dwelling, attached or detached structures accessory to such use and/or farm structures. A person who constructs more than one home in a two-year period shall not be considered a homeowner. Such "homeowner" shall submit to the Building Official on a form acceptable to the Building Official, that he/she shall be responsible for all such work performed under the building permit. (Section 109. 1. 1) The undersigned "homeowner" assumes :responsibility for compliance with the Stat Building Code -and other applicable codes, by-laws, rules and regulations. HOME OWNER'S EXEMPTION The code state that: "Any Home Owner performing work for which a building permit is required shall be exempt from the provisions of this section (Section 109. 1. 1 - Licensing of Construction Supervisors) ; provided that if Home Owner engages a person(s) for hire to do such work, that such Home Owner shall act as supervisor. " Many Home Owners who use this exemption are unaware that they are assuming the responsibilities of a supervisor (see Appendix Q, Rules and Regulations for:.'Lcensing Construction Supervisors, Section 2. 15,) . This lack of awarenes o%ften results in, serious problems, particularly when the` 1Home Owner hires unlicensed persons. In this case our Board cannot proceed against the inlicensed person as it would with licensed Supervisor. The Home "dwner' actin as supervisor is ultimately responsible. To ensure that the Home Owner is fully aware of his/her responsibilities, man communities require, as part of the permit application, that the Home Owner certify that he/she understands the responsibilities of a supervisor. On the last page of this issue is a form currently used by several towns. Wheeler, Trustee of Wheeler Realty Trust Our File No. 4677 Dear Mr. Crossen: You may recall that I spoke with you recently con ernin t-he application of Mr. Wheeler to build a replacement bathhouse qt 150 Wheeler-Road; a•rs ons Mills"on a parcel shown on Sheet 103 of the assessors map el 109-2, containing 7.80 acres. You want to make sure that this 7.80 acre parcel is in fact one parcel; that it has not been divided; and that the bathhouse would be accessory to the principal use of a single family dwelling. The 7.80 acre parcel is in fact one parcel. By deed dated April 9, 1953, recorded in Book 839 Page 149, Mr. Wheeler's father, Wilfrid Wheeler, Jr., the then trustee of Wheeler Realty Trust, took title to a 28.4 acre parcel- situated on the southerly side of Race Lane, the westerly side of Route 149 and the . easterly side of Wheeler Road shown as Lot A on plan recorded in Plan Book 109 Page 69. A copy of this plan is enclosed. Portions of this 28.4 acre parcel were sold off as shown on subsequent plans recorded in Plan Book 256 Page 97, Plan Book 348 Page 41, and Plan Book 348 Page 88. Copies of these plans are enclosed. What remained of the original 28.4 acre parcel is shown on a plan dated September 19, 1986 recorded in Plan Book 425 Page 80, a copy being enclosed. Our locus is Lot 3, containing 7.80 acres. In 1990, Mr. Wheeler contemplated the possibility of having much of his property assessed as horticultural land under G.L. c. 61A due to the existence of several groves of holly trees on the property. In 1990 Mr. Wheeler had a plan prepared showing the area which would have been covered by the horticultural assessment, and showing an area around the dwelling, which would not have been covered by the horticultural assessment. By letter dated November 6, 1990, the Board of Assessors denied Mr. Wheeler's request for assessment as horticultural land. The plan prepared in support of the. application for a horticultural assessment was never recorded; was never endorsed by the Planning Board; and was created only as a concept.
