As per our telephone conversation, th-is. is a confirmation of
the problem .that eXists by Mr. Short with his running his
Tractor Trailer operation from his home. As an Association
we have notified him that .he is i,n violation of not only the
Whistleberry Covenants (copy of which is attached) , but also
the Town .of . Barnstables Zoning. He has consistently ignored
our correspondence. Many of the residents have voiced their
concerns over the hazard of his vehicle in the development
as well as the . damage :he is causing .to the shoulder of the
road system (especially across from his residence..

DECLARATION OF PROTECTIVE COVENANTS OF WHISTLEBERRY
No building or structure shall be erected,placed or maintained on any lost except one dwelling house to be used for a single family only,
a.greenhouse, tennis court,platform tennis court, and swimming pool for private use, a garage for not more than three cars,and,with
respect to any lot located on the waterfront,a boathouse and bulkheads.
2. No structure, whether residence, accessory building, tennis court, plalforH tennis court. swimming pool, fence or other Improvement,
shall be erected,placed,maintained,altered,or us%d on any lot until the complete plans,including landscape plans,specifications,and
proposed location of any building or structure have been submitted to and approved In writing by Whislleberry Properties, or so
designated by them.
3. The exterior of any building erected on any lot and the landscaping and grading In connection therewith shall be flnl•dhed and completed
within six(6)months from the commencement of construction.
4. No house constructed on any lot Is to be occupied unlit the exterlor of the building Is complete.Also,no house trailers may be brought
onto or maintained on any lot at any time.
5. No newspaper box shall be erected or maintained on any lot or on any way adjacent thereto.
8. No crawler or cleated machine of any type shall be permitted to travel or park on any paved way, or on the common areas within the
subdivision.
7. The structures and grounds on any lot shall be maintained In a neat and attractive manner,and the entire lot shall be kept free of rubbish,
debris or material of any kind which render the same unsanitary,unsightly,offensive,or detrimental to any property within Whlstleberry
or to the owners or occupnnts of any properly within Whlslleberry.
In the event of a default In the performance of this provision and If such default shall not have.been cured within fourteen(14)days after
written notice thereof,The Grantors,their successors and assigns,shall h'ave the right to enter upon said lot to remove all weeds,rubbish,
debris or materials; to cut the press and vegetation; to remove dead trees, shrubs and plants; and to do all things necessary to place
sold property In a neat and orderly condition.The cost of any work so required shall become due and payable by the lot owner or owners
to the Grantors,their successors or assigns,Immediately upon the completion thereof. i
8. No parking of motor vehicles shall be permitted along the entire length of the ways within the Whlslleberry subdivision.
9. A breach of any of the foregoing restrictions shall give to the Grantors, their successors or assigns, the usual legal and equitable
remedies to recover damages and the right to enter upon any lot and abate and remove,at the expense of the party at fault,any erection
of work that may be thereon contrary to the Interest of these restrictions,without being deemed guilty of any manner of trespass therefor;'
however, If no action SHALL HAVE BEEN COMMENCED AND NOTICE THEREOF FILED WTH THE BARNSTABLE COUNTY REGISTRY
OF DEEDS WITHIN THREE(3)MONTHS AFTER COMPLETION OF ANY BUILDING, STRUCTURE,TENNIS COURT, PLATFORM TENNIS
COURT, SWIMMING POOL On OTHER IMPROVEMENT, ADDITION,OR LANDSCAPING,THE SAME SHALL THEN BE CONCLUSIVELY
DEEMED TO BE IN COMPLIANCE WITH THESE RESTRICTIONS.
10. The Grantors, their successors or assigns, may delegate or assign any or all of their rights, powers and obligations under these re-
strictions,said asslgnm9nl to be In writing and duly recorded In the Barnstable County Reglstry of Deeds.
The Grantors further Impose the following restrictions on sold Lots Inclusive, which restrictions shall run with and bind
the land and shall Inure to the benefit of and be enforceable by the sold Grantors or to the owner of any sold lots and their heirs,aucces-
sors and assigns as part of a common scheme,applicable to each of said tots and for the benefit of said lots,said restrictions to remain
In force until January 1,2030.
1. No business or trade,nor any mechanical,manufacturing or mercantile trade or business of any kind,not the practice of any profession
shall be conducted on any lot at any time.
2. Tanks or any other storage facility for propane or other types of gas supply are prohibited.All other tanks maintained on any lot shall
be burled or confined within the residence. _
3. No chickens or other fowl and no animals except household pets shall be kept or maintained on any lot. No pets shall be kept which
shall constitute a nuisance or which will be troublesome or objectionable to the occupants of adjoining or nearby lots.
4. No garbage or refuse shell be deposited on any lot except In suitable conlainere.so as not to be visible from the street or any adjacent lot.
5. All clotheslines and drying yards shall be enclosed'by fencing or shrubbery so as not to be visible from the street or any adjacent lot.
8. No building material of any kind or character shall be place upon any lot except for the Immediate purpose of construction of an approved
dwelling or accessory structure.
. 7. No detached or free standing antenna or serial of any kind or description shall be kept or maintained on any lot. No advertising signs
shall be placed or molniained on any lot at any time except one sign of not more than 100 square Inches In size denoting the name of the
resident living on said lot and one sign of not more than 100 square Inches In size denoting the residence located on said lot Is for sate.
This restriction shall not apply to any signs placed or maintained by Whlslleberry Partnership.

12. No excavation for stone,gravel,sand or earth shall be made on any lot except for the purpose of building basements or cellars of dwelling
houses and other structures accessory thereto including, but not limited ot, swimming pools, tennis courts, platform tennis courts,
and subterranean fuel oil tanks and septic systems, grading or laying underground utilities and performing Initial landscaping of
dwelling houses. This restriction shall not apply Jo repair or betterment programs undertaken by Whlstleberry Partnership or by a
Property Owners Association.
13. By the acceptance of a deed to any lot or lots shown on the aforementioned plans, the Grantee therein named, for himself, his heirs,
executors, administrators, successors and assigns, agrees to become a member of the Whlstleberry Resident Association, Inc. and to
pay an annual assessment to sold association,said assessment to be a proportion of the actual annual costs of the maintenance,repair,
taxes, Improvement assessments or expenses Incurred on any of the ways and on the recreation and common areas or Improvements ,
