As I indicated, I represent Susan E. Morrison, George D. Jones, James B. Jones and Jean Chen with reference to the construction of a proposed set of stairs between their respective properties by Joseph H. Burke, Jr. I enclose a copy of the plan submitted to the Barnstable Conservation Commission dated February 15, 2005 which depicts a proposed stairway to be constructed on a 12 foot strip of land owned by Mr. Burke. In addition, I enclose a copy of Barnstable Assessor's Map 138. My client, Mrs. Morrison, is the owner Parcel 18 as shown on the Assessor's map which I have highlighted in blue. The Jones family are the owners of the properties highlighted in yellow and green. The applicant, Mr. Burke, owns the property denoted as Parcel 11 on the Assessor's map together with a 12 foot strip across Sea View Avenue located directly between my clients' respective properties. The Barnstable Conservation Commission has issued an Order of Conditions to allow for construction of the proposed stairway, which we have appealed on behalf of our clients to the Department of Environmental Protection for a superceding order. To date, a superceding order has not been issued. In conjunction with the proposed construction, we have reviewed the applicable provisions of the Barnstable Zoning Ordinance. Specifically, we believe that the applicant must obtain a variance because the proposed construction would violate the minimum yard set backs on both sides of the structure. Further, we believe that the proposed stairway is an accessory structure on a lot immediately opposite and across the road from the applicant's principal lot, and therefore, the applicant must obtain a special permit to construct the i Tom Perry, Building Commissioner January 12, 2006 Page 2 stairway. The Barnstable Zoning Code defines a structure as "any production or piece of work, artificially built up or composed of parts and joined together in some definite manner, not including poles, fences and such minor incidental improvements." (See Section 240-128). The proposed stairway will span more than 40 feet in length and will include over thirty stairs as well as railings and support posts. The stairway will be a new permanent fixture. As I indicated during our meeting, if the stairway were placed on level land, it would comprise a structure in excess of 20 feet in height. This is a similar proposed construction plan to that in the case Jacquet v. Planning Board of Edgartown, 789 NE2d 1093 (Mass.App.Ct. 2003). In Jacque , as here, a proposed stairway was to be used to provide access to the water. The stairway fell within the Town's definition of a "structure" and the applicant therefore needed to obtain a special permit. Additionally, the Town of Chatham not only interprets the term structure to include stairways, but its definition of "structure" specifically calls for stairways in conservancy districts. See Davis v. Zoning Board of Chatham, 745 NE2d 101 (Mass.App.Ct. 2001) and Grenier v. Zoning Board of Chatham, 814 NE2d 1154 (Mass.App.Ct. 2004). The applicant has provided us with a copy of the decision in Bonnie Brook Realty Trust v. Ron Jansson et al. In that Superior Court decision, the plaintiffs installed three air conditioning units and a generator which the court ruled did not violate the set back requirements not falling within the meaning of "building" under Section 2-3.2 of the Zoning Code. Our clients assert that the stairway is in fact a structure governed by set back requirements and that it is shaped, sized, and constructed and used much differently than an air conditioner or generator. Further, the stairway will be the sole use and structure on its lot, as opposed to the accessory nature of the air conditioning units in the Bonnie Brook case. Barnstable Zoning Code Section 240-13(E) requires all permitted use of land (buildings and structures) in an RF-1 Zoning District to have a minimum yard set back of 15 feet from each side of the lot. Accordingly, we believe a variance to that requirement is necessary for the applicant to proceed with the construction of the proposed stairway. In addition, Barnstable Zoning Code Section 240-44 permits accessory use of lots, "adjoining or immediately opposite and across a road from the lot on which the principal use it serves is located." The proposed stairway is proposed to be built on the plot of land owned by the applicant immediately across the road from the applicant's home and will be used by the applicant for water access from the home. Burke, Jr., owner of the above-referenced property I�t�`� enclose a copy of the plan submitted to the Barnstable Conservation Commission dated February 15, 2005 which depicts a proposed stairway to be constructed on a 12 foot strip of land owned by Mr. Burke. In addition, I enclose a copy of Barnstable Assessor's Map 138. My client, Mrs. Morrison, is the owner Parcel 18 as shown on the Assessor's map which I have highlighted in blue. The Jones family are the owners of the properties highlighted in yellow and green. The applicant, Mr. Burke, owns the property denoted as Parcel 11 on the Assessor's map together with a 12 foot strip across Sea View Avenue located directly between my clients' respective properties. The Barnstable Conservation Commission has issued an Order of Conditions to allow for construction of the proposed stairway, which we have appealed on behalf of our clients to the Department of Environmental Protection for a superceding order. To date, a superceding order has not been issued. In conjunction with the proposed construction, we have reviewed the applicable provisions of the Barnstable Zoning Code. Specifically, we believe that the applicant must obtain a variance because the proposed construction would violate the minimum yard set backs on both sides of the structure. Further, we believe that the proposed stairway is an accessory structure on a lot immediately opposite and across the road from the applicant's principal lot, and therefore, the applicant must obtain a special permit to construct the stairway. (See Section 240-128). The proposed stairway will span more than 40 feet in length and will include over thirty stairs as well as railings and support posts. The stairway will be a new permanent fixture. As I indicated when we met on this project earlier this year, if the stairway were placed on level land, it would be a structure in excess of 20 feet in height. i This is a similar proposed construction plan to that in the case Jacquet v. Planning Board of Edgartown, 789 NE2d 1093 (Mass.App.Ct. 2003). In Jac uet, as here, a proposed stairway was to be used to provide access to the water. The stairway fell within the Town's definition of a "structure" and the applicant therefore needed to obtain a special permit. Additionally, the Town of Chatham not only interprets the term structure to include stairways, but its definition of "structure" specifically calls for stairways in conservancy districts. See Davis v. Zoning Board of Chatham, 745 NE2d 101 (Mass.App.Ct. 2001) and Grenier v. Zoning Board of Chatham, 814 NE2d 1154 (Mass.App.Ct. 2004). The applicant has provided us with a copy of the decision in Bonnie Brook Realty Trust v. Ron Jansson et al. In that Superior Court decision, the plaintiffs installed three air conditioning units and a generator which the court ruled did not violate the set back requirements not falling within the meaning of "building" under Section 2-3.2 of the Zoning Code. Our clients assert that the stairway is in fact a structure governed by set back requirements and that it is shaped, sized, and constructed and used much differently than an air conditioner or generator. Further, the stairway will be the sole use and structure.on its lot, as opposed to the accessory nature of the air conditioning units in the Bonnie Brook case. Barnstable Zoning Code Section 240-13(E) requires all permitted use of land (buildings and structures) in an RF-1 Zoning District to have a minimum yard set back of 15 feet from each side of the lot. Accordingly, we believe a variance to that requirement is necessary for the applicant to proceed with the construction of the proposed stairway. In addition, Barnstable Zoning Code Section 240-44 permits accessory use of lots, "adjoining or immediately opposite and across a road from the lot on which the principal use it serves is located." The proposed stairway is proposed to be built on the plot of land owned by the applicant immediately across the road from the applicant's home and will be used by the applicant for water access from the home. Based upon the foregoing, we believe the applicant should be required to obtain a special permit from the Zoning Board of Appeals to allow for such use. The project is undergoing review pursuant to Section 11.03 (3)(b)(1)(a) of the MEPA regulations, because the project requires a Superseding Order of Conditions from the Department of Environmental Protection (DEP)and involves construction on a coastal bank. MEPA jurisdiction exists over issues related to the required state permit (land alteration and wetlands issues). The project will greatly improve safe access to the beach. The proponent has also designed the project in a manner that generally minimizes impacts.
