Summary: Granted with Conditions Petitioner: The Wianno Club Property Address: 107 Sea View Avenue,Osterville,MA Assessor's Map/Parcel: Map 162 as parcel 024 Zoning: Residence F-1 Zoning District Relief Requested & Background: In Appeals 2006-83 and 84 the Applicant is The Wianno Club seeking to expand and improve the existing clubhouse, more specifically;the—restaurant kitchen facilities. The Wianno Club clubhouse is a 39,196 sq.ft. three-story structure located on a 4.23 acre lot situated on Nantucket Sound. Ca 0 According to the Assessor's record, the structure dates back to1887. The parcel is part of the estimated 0; 165-acre non-profit private club. According to the Zoning Board of Appeals record, the use of the r. property dates back to 1916. Given the use, which predates the 1929 inception of zoning for use in Barnstable, it is a pre-existing, legally created,nonconforming use. The proposal is to expand the existing structure with a one-story addition consisting of a 3,223 sq.ft. basement, a 2,903 sq.ft. first floor main level and a 320 sq.ft. covered porch also on the main level. The Cd addition is located to the easterly end of the existing structure. The largest portion of the addition is a proposed"Casual Dining"room. The Casual Dining room includes a new separate entrance,restrooms, o server stations, and bar. It also includes a new open-air terrace and a small covered porch for outdoor dining overlooking Nantucket Sound. c Two small additions, estimated at 300 sq.ft., are also being proposed for the existing kitchen. The okitchen is to service the existing"Formal Dining" and proposed"Casual Dining"rooms as well as the a outdoor eating area. Procedural &Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on August 02, 2006. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened September 13, 2006, at which time the Board found to grant both special permits subject to conditions herein. Board members deciding this appeal were, Ron S. Jansson, James R.Hatfield, John T. Norman, Kelly Kevin Lydon, and Chairman, Gail C. Nightingale. Attorney John R. Alger represented the applicant. He gave a brief history of the property noting that the club dates back some 100 years. He noted that the Board had issued several permits to various aspects of the Wianno Club from 1955 to present. He noted that the club is a private not-for-profit club limited to members only. Mr. Alger introduced Peter Sullivan, the project engineer, and David Stuhlsatz, the building architect. They presented the site plans for the development and architectural plans for the building additions. It was noted that the addition would conform to the setbacks for the districts and the height limitation of the Zoning Ordinance. Mr. Alger then addressed the requirements of Section 240-94.13 for the expansion of a pre-existing nonconforming use citing that the plans and proposal satisfies all of the requirements. He noted that the proposal was for the existing membership of the club and was not intended to provide for an expansion of that membership. He summarized that the grant of the special permits for the expansion would not be an intensification with respect to the overall use as the membership would not be increasing and, therefore, would not be more detrimental to the neighborhood. Mr. Alger noted that the proposal has been fully reviewed and approvals issued. It has been reviewed and approved by the Cape Cod Commission and the Barnstable Historic Commission as the structure is listed on the National Register of Historic Buildings. The Site Plan Review Committee issued its approval on July 27, 2006. The Board of Health has reviewed and approved changes and improvements to the septic system. Also, on September 1, 2006, the Conservation Commission issued its Order of Conditions. The Board asked several questions concerning parking,membership numbers and types, and clarification of the nature of the nonconformity in the existing structure's setback. Public comment was requested and no-one spoke in favor or in opposition to the request. Findings of Fact: At the hearing of September 13, 2006, the Board unanimously made the following findings of fact: 1. Appeal 2006-083 seeks a Special Permit pursuant to Section 240-94.13 of the Town of Barnstable Zoning Oidinance for the Expansion of a Pre-existing Nonconforming Use. The Applicant is The Wianno Club. The property is addressed as 107 Sea View Avenue, Osterville, MA, and is shown on Assessor's Map 162 as parcel 024. It is in a Residence F-1 Zoning District. 2. The locus is a 4.23-acre lot developed with a 39,196 sq.ft. three-story clubhouse structure known as The Wianno Club. According to the Assessor's record, the structure dates back to 1887. The parcel is part of 165-acres that makes up the non-profit private club. 3. The Assessor's record dates the structure back to 1887. The Zoning Board of Appeal's records document that the use dates back to 1916. Given those records, the use is a pre-existing,legally created, nonconforming use. It, therefore, qualifies for the relief being sought on the special permit requested. 2 4. The applicant seeks to expand the existing clubhouse with a one-story addition. That addition consists of a 3,223 sq.ft.basement, with a 2,903 sq.ft. Casual Dinning room and a 320 sq.ft. covered porch above. The Historic Commission cited their desire with respect to the aesthetics of the building to include true divided windows with exterior muntin and 12"light sash. 7. An Order of Conditions has been issued by the Conservation Commission for the proposed expansion. 8. In accordance with Section 240-94.B for an expansion of a pre-existing nonconforming use, this Board finds that all of the requirements of that section have been met and that the proposed expansion and intensification will not be more detrimental to the neighborhood. Decision: Based on the findings of fact, a motion was duly made and seconded to grant a special permit pursuant to Section 240-94.13, Expansion of a Pre-existing Nonconforming Use subject to all of the following conditions: 1. Development shall be as presented to the Board and as shown on plans submitted. The Site Plan is entitled"Proposed Improvement Plan of The Wianno Club Barnstable, (Osterville)Mass." drawn by Sullivan Engineering, Inc., Sheet 2 of 2, dated July 14, 2006,last revised 8/24/2006. The proposed Architectural Plans (elevations and floor layouts)of the proposed addition are entitled"Renovations to the Wianno Club Osterville,MA" as drawn by Royal Barry Wills Associates, Inc., dated 1-26-06, last revised date of 7-11-06. 2. Construction shall comply with all applicable municipal Building rules and regulations,Health Division requirements and all applicable fire codes. 3. The construction of the building and all site improvements shall comply with the Order of Conditions issued by the Conservation Commission, all requirements of the Cape Cod Commission historic review, and including the requirements and recommendations of Barnstable Historic Commission for the proposed addition. 4. During all stages of construction, all vehicles, equipment,^and materials associated with the construction shall be located on property of the Wianno Club and not located within the right- of-way of any street. 3 e 5. Any on-site outdoor lighting shall not exceed 18 feet in height and shall only be directed onto the site. A plan for the outdoor lighting shall be prepared and submitted for administrative review and approval by staff prior to the issuance of any building permit. 6. Use of the clubhouse is restricted to Wianno Club members and their guests only. Memberships shall be limited to not exceed 500 regular members and there shall be no significant increase in other memberships (non-residence, seasonal, temporary, guest residence and honorary membership). The Wianno Club clubhouse is a 39,196 sq.ft. three-story structure located on a 4.23 acre lot situated on Nantucket Sound. According to the Assessor's record the structure dates to 1887. The parcel is part of the estimated 165-acre non-profit private club. According to the Zoning Board of Appeals record, the use of the property dates to 1916. Given the use predated the 1929 inception of zoning for use in Barnstable it is a pre-existing, legally created, W nonconforming use. 4 o The proposal is to expand the existing structure with a one-story addition consisting of a 3,223 sq ft. basement,a 2,903 sq. ft. first floor main level and a 320 sq.ft. covered porch also on the main level. The addition is located to the easterly end of the existing structure. The largest portion of the addition is a proposed"Casual Dining"room. The Casual Dining room includes a new separate entrance,restrooms, server stations and bar. Also added would be a new open-air terrace and a small covered porch for outdoor a3, dining overlooking Nantucket Sound. Two small additions,estimated at 300 sq.ft. are also being proposed for the existing kitchen. That kitchen v is to service the existing"Formal Dining"and proposed`.`Casual Dining"rooms as well as the outdoor eating r, area. 0 �n Procedural &Hearing Summary: aThis appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on August 02, 2006. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened September 13, 2006, at which time the Board found to grant both special permits subject to conditions herein. Board Members deciding this appeal were,Ron S. Jansson,James R. Hatfield,John T. Norman,Kelly Kevin Lydon and Chairman, Gail C. Nightingale. Attorney John R. Alger represented the Applicant. He gave a brief history of the property noting that the club dates back some 100 years. He noted that the Board had issued several permits to various aspects of the Wianno Club from 1955 to present. He noted that the club is a private not-for-profit club limited to members only. Mr. Alger introduced Peter Sullivan, the project engineer and David Stuhlsatz, the building architect. They presented the site plans for the development and architectural plans for the building additions. Mr. Sullivan cited that the existing structure does not conform to the required setbacks. However,the proposed addition would conform to the setbacks for the districts and the height limitation of the Zoning Ordinance. Mr. Alger then addressed the requirements of Section 240-94.13 for the expansion of a pre-existing nonconforming use citing that the plans and proposal satisfies all of the requirements. He noted that the proposal was for the existing membership of the club and was not intended to provide for an expansion of that membership. He summarized that the grant of the special permits for the expansion would not be an intensification with respect to the overall use as the membership would not be increasing and,therefore, would not be more detrimental to the neighborhood. He also cited that the proposed addition, unlike the existing structure, would conform to the district's required setbacks. Mr. Alger noted that the proposal has been fully reviewed and approvals issued. It has been reviewed and approved by the Cape Cod Commission along with the Barnstable Historic Commission as the structure is listed on the National Register of Historic Buildings. The Site Plan Review Committee issued its approval on July 27, 2006. The Board of Health has reviewed and approved changes and improvements to the septic system. Also, on September 1,2006,the Conservation Commission issued its Order of Conditions. The Board asked several question concerning parking,membership numbers and types, and clarification of the nature of the nonconformity in the existing structure's setback. Public comment was requested and no-one spoke in favor or in opposition to the request. Findings of Fact: At the hearing of September 13,2006,the Board unanimously made the following findings of fact: 1. Appeal 2006-084 seeks a Special Permit pursuant to Section 240-93.B of the Town of Barnstable Zoning Ordinance for the alterations or expansions in a pre-existing nonconforming building or structure. The Applicant is The Wianno Club. The property is addressed as 107 Sea View Avenue, Osterville,MA, and is shown on Assessor's Map 162 as parcel 024. It is in a Residence F-1 Zoning District. 2. The locus is a 4.23-acre lot developed with a 39,196 sq.ft. three-story clubhouse structure known as The Wianno Club. Part of the existing structure does not conform to the required setbacks. According to the Assessor's record,the structure dates back to 1887. The parcel is part of 165- acres that make up the non-profit private club. 3. The Assessor's record dates the structure back to 1887. The Zoning Board of Appeals record documents that the use dates back to 1916. Given those records.,the building is a pre-existing, legally created,nonconforming structure. It,therefore,qualifies to seek the relief of the Special Permit requested. 4. The Applicant seeks to expand the existing clubhouse with a one-story addition. That addition consists of a 3,223 sq. ft. basement, with a 2,903 sq.ft. In accordance with Section 240-94.B for an expansion of a pre-existing nonconforming use, this Board finds that all of the requirements of that section have been met and the proposed expansion and intensification will not be more detrimental to the neighborhood.
