The subject property Is located off of Seapult Road in Osterville and fronts,on the waters of North Bay. It is a .56 acre undeveloped lot, consisting primarily of wetlands and a steeply-sloped vegetated coastal bank. The subject parcel is accessory to a one-acre lot at 275 Seapult Road Improved with a single family dwelling that dates to 1914. The subject and principal lots are separated by a private way that varies between approximately 30'and 16'feet in width. Although not appearing on the Assessor's map,the way is shown on the Land Court plans and provides frontage to a developed lot to the northwest. Procedural&Hearing Summary Special Permit No.2014-009, a request by Charles O.Wellington to construct a pier and boardwalk with stairs, ramp and float on a lot immediately opposite and across a road from the lot on which the principal use It serves was located was filed at the Town Clerk's Office and the office of the Zoning Board of Appeals on January 30,2014: A public hearlr?g before the Zoning Board.of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. .The hearing was opened March 26, 2014 at which time the Board found to grant the request subject to conditions. Board Members deciding this appeal were Craig G. Larson,Alex M. Rodolakls, Brian Florence, George T.Zevitas, and Herbert K. Bodensiek, Attorney Sarah Alger represented the Petitioner before the Board; Charles Wellington was also present, She provided a brief overview of the proposal and confirmed that the request met all requirements of the ordinance. Attorney Alger confirmed the pier had been approved by the Conservation Commission. The Board Chair requested public comment and no one spoke. Charles O.Wellington is seeking a special permit pursuant to Section 240-44(A)to install a boardwalk,pier, ramp and float on an accessory lot. 2. The lot at 0 Seapult Road,as shown on Assessor's Map 095 as Parcel 003,is located Immediately opposite and across a road from 275 Seapuit Road, the lot on which the principal use it serves is located. 3. The lot at 0 Seapult Road containing the proposed accessory use and the lot at 275 Seapult Road containing the principal single-family dwelling are held in identical ownership with respect to both fee and nonfee Interests. Charles O.Wellington and Louisa M. Guzzetti hold title to both the principal lot and the subject accessory lot under a single deed (Land Court Certificate No. 192268). 4. Site Plan Review Is not required uses accessory to single-family residential dwellings. 5. After an evaluation of all the evidence presented,the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. CCA-treated piling and structural timber(greater than three[3]inches thick)are allowed. Otherwise,no CCA-treated or creosote-treated materials shall be used. 11. The proposed elevated stairs shall be constructed a minirnurn of one foot above grade without solid risers. 12. Deck plank spacing shall be at least three-quarters'(3/,)of an inch,except for the over-marsh portion,which shall be grated decking providing a minimum 65%light penetration. 13. The seasonal float shall be stored at*a suitable upland site. Float shall not be stored on banks,beaches, marshes or dunes. 14. Float stops shall be installed to keep the float a minimum of one(1)foot above the substrate at low tide. i 15. Permanent piling shall be driven into place. Some initial pilot-hole jetting.is allowed. The following special conditions(in italics)shall govern boat use at the approved pier. These conditions shall continue over time. Note: for purposes of this Order of Conditions,the term"pier" shall refer not only to the linear pile-supported structure,but also to any of its components or appendages,such as the float(s), ell,tee,ramp,outhaul piling,etc. 16. At the completion of work, or by the expiration of this Order,the applicant shall request in writing a Certificate of Compliance for the work herein permitted.
