Several of the condominium owners who directly and overlook that property have notified the Condominium Association that fuel trucks bearing the name of your company have been regularly parking on the parking lot area, a portion of which is . owned by Holbrook R. Davis and a portion of which is owned by the Osterville Baptist Church. These trucks have been parking directly adjacent to and within 20 feet from several of the condominiums. The trucks regularly start their engines as early as 4:00 a.m. emitting noxious and offensive odors and fames as well as creating loud and disrupting noise for the condominium unit owners. The property in question is located within a Groundwater Protection Overlay District under Section 3-5.2 of the Town of Barnstable Zoning Ordinances. That Zoning Ordinance prohibits the storage for resale of heating fuels, including oil and gas, as well as the storage of liquid petroleum gas of any kind within the Overlay District. In addition, the noise, odor, fumes, light and vibration caused by these fuel trucks in early morning hours materially interferes with and impairs the condominium unit owners reasonable use of their property. As such, the fuel trucks create a common law nuisance and may be in violation of Section 2-6.1 of the Town of Barnstable Zoning Ordinances. In an attempt to rectify this situation as quickly and cordially as possible, we are requesting that you immediately cease and desist from such parking within the parking lot area.
