Background: The locus of this appeal is an 18,904 sq.ft. lot located at the intersection of Tower Hill Road and Pond Street in Osterville. The lot is developed with an existing one story single-family dwelling of 1,184 sq.ft. According to the Assessors Records, the existing structure was built in 1955. According to plans submitted, and titled "Plan of Land in Osterville, Mass. as prepared for Damon Getman"dated February 21, 1995, the applicant is proposing to add an addition of 980 sq.ft. consisting of a car and "specialized"handicapped van garage, and a family room. The proposed addition is to be located 16.67 ft from the lot as it fronts on to Pond Streetand is 8.69 ft from the lot's side line. The district requires a 20 foot front yard setback and a 10 foot side yard setback. The proposal will infringe on the required front yard setback by 3.30 and on the side yard setback requirement by 1.31 feet. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on March 14, 1995. A public hearing before the Zoning Board of Appeals was duly advertised and notices were sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened on May 17, 1994 at which time the Board granted the appeal with conditions. Board members hearing the appeal were: Ron Jansson, Richard Boy, Emmett Glynn, Robert Thorne and Chairman Gail Nightingale. Paul Sweetser,the Land Surveyor represented the petitioners. He explained the needed variance was to provide a handicapped access garage and a family room addition to the home. The architectural plans were presented. Paul Sweetser cited the odd shape and irregular configuration of the lot, especially noting the frontage along Pond Street and Tower Hill Road. He noted that there is 140 feet to the edge of the water on Sam's Pond. That distance has an extreme slope from the home to the pond's edge. This dwelling is a pre existing non-conforming house built in 1955 with two bedrooms and two and a half.baths. The septic system was upgraded in the last year and a half. The garage is needed to accommodate a handicapped designed and equipped van that is very long so the one story garage needs to be 35 feet deep. Brenda Getman said that the van was 21 feet long itself and it is used for overnight trips. It has specialized equipment and is designed for the visually impaired. Mr. Getman is visually handicapped and is accompanied by his seeing eye dog on trips when lecturing to high school students on motivation. The van helps keep costs down and provides accommodations for the Getmans and their dog. Zoning Board of Appeals Decision and Notice Appeal Number 1995-54—Getman There was no public comment either opposed or in favor. Finding of Facts: Based upon the testimony given during the public hearing on this appeal,the Board unanimously found the following findings of fact: 1. The property is located in an RC Residential Zoning District that currently requires one acre of area under the Zoning Ordinance. 2. The property consists of only 0.49 acres of land and is developed with a single family home. 3. The property has an irregular shape fronting on both Pond Street and Tower Hill Road. The configuration of the two streets in conjunction with the existing layout of the dwelling creates an unusual topographical feature which is not customarily found in this area. 4. A good portion of the lot slopes off significantly by more than twenty five feet over a distance of approximately one hundred feet. As a result of this sloping topography, it would be impractical and improbable to build the addition anywhere else on the site. 5. Because of these topographical features the petitioner is unable to expand the 1,200 square foot two bedroom dwelling. 6. Owing to these conditions the relief would represent a significant detriment or hardship to the petitioner if it were denied. 7. In granting the relief sought, it would not be in derogation of the spirit and intent of the Zoning Ordinance of the Town of Barnstable. Decision: Based upon the positive findings a motion was duly made and seconded to grant as requested, a Variance to Section 3-1.3 (5) Bulk Regulations, Minimum Setbacks, Front.and Side Yard, to allow for an addition to a dwelling not in conformance with the required setbacks with the following condition that the proposed addition be constructed pursuant to elevations submitted to this Board and pursuant to the footprint plan submitted to this Board entitled, "Plan of Land In Osterville Mass. as prepared for Damon Getman"by Paul Sweetser and dated February 21,1995. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on March 14, 1995. A public hearing before the Zoning Board of Appeals was duly advertised and notices were sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened on May 17, 1994 at which time the Board granted the appeal with conditions. Board members hearing the appeal were., Ron Jansson, Richard Boy, Emmett Glynn, Robert Thorne and Chairman Gail Nightingale. Paul Sweetser,the Land Surveyor represented the petitioners. He explained the needed variance . was to provide a handicapped access garage and a family room addition to the home. The architectural plans were presented. He noted that there is 140 feet to the edge of the water on Sam's Pond. That distance has an extreme slope from the home to the pond's edge. The garage is needed to accommodate a handicapped designed and equipped van that is very long so the one story garage needs to be 35 feet deep. Brenda Getman said that the van was 21 feet long itself and it is used for overnight trips. It has specialized equipment and is designed for the visually impaired. Mr. Getman is visually,handicapped and is accompanied by his seeing eye dog on trips when lecturing to high school students on motivation. Finding of Facts: Based upon the testimony given during the public hearing on this appeal,the Board unanimously found the following findings of fact: 1. The property is located in an RC Residential Zoning District that currently requires one acre of area under the Zoning Ordinance. 2. The property consists of only 0.49 acres of land and is developed with a single family home. 3. The property has an irregular shape fronting on both Pond Street and Tower Hill Road. The configuration of the two streets in conjunction with the existing layout of the dwelling creates an unusual topographical feature which is not customarily found in this area. 4. A good portion of the lot slopes off significantly by more than twenty five feet over a distance of approximately one hundred feet. As a result of this sloping topography, it would be impractical and improbable to build the addition anywhere else on the site. 5. Because of these topographical features the petitioner is unable to expand the 1,200 square foot two bedroom dwelling. 6. Owing to these conditions the relief would represent a significant detriment or hardship to the petitioner if it were denied. 7. In granting the relief sought, it would not be in derogation of the spirit and intent of the Zoning Ordinance of the Town of Barnstable. The property consists of only 0.49 acres of land and is developed with a single family home. 3. The property has an irregular shape fronting on both Pond Street and Tower Hill Road. The configuration of the two streets in conjunction with the existing layout of the dwelling creates an unusual topographical feature which is not customarily found in this area. 4.
