The lot abuts the Skunknet River to the east and Route 28 on the south. The lot has a total upland area of 19,940 sq.ft. (0.45-acre). According to the Assessor's record, ffie existing dwelling is a three= bedroom, 1.5-story, 1,152 sq.ft. living area structure. The applicant is proposing an 18 by 22 foot, 1.5-story add tion to the south of the dwelling. The addition, estimated at approximately 600 sq.ft., is to be used as a 396 sq.ft. family room opened to the existing kitchen and dining area on the first floor. The se and•floor of the addition is connected to an existing bedroom and is to be used for storage and added Ioset/dressing room. The existing building is situated 38.3-feet off Route 28. The proposed addition is to be located 20.4- feet off Route 28. Procedural & Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on March 12, 2009_ A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance-with MGL Chapte 40A. The hearing was opened'April 15, 2009, at which time the Board found to grant the Special Fermit subject to conditions. Newton, Michael P. Hersey, Craig G. Larson, Alex M. .Rodolakis, and Board Chair, Laura F. Shufelt. Barbara Bengen-Seltzer was present at the hearing along with Mr. Robert Gremo, the general contactor for the proposed addition to the home. Ms. Sel er explained the proposed addition noting that the addition is to be opened on the first floor with the existing kitchen and dining area to create an enlarged area for entertaining. She noted that the intent of the addition is not to increase the number of bedrooms in the home. Ms. Seltzer stated that the only location for an expansion of the dwelling is in this location. The lot was created and developed prior to the regulation that no imposes a 100-foot building setback onto Route 28. It was noted that under this regulation most of tie lot would be unbuildable. The Board discussed the nature of the relief requested and it was noted that access to the rear of the dwelling would be maintained as there would still be some 20 feet between the addition and the existing fence. It was noted that the deck would be exten ed. However, the extension of the deck would not intrude any further into the setback that the proposed addition which is to be located no closer than 20.4-feet off Route 28. Public comment was requested and no one spoke in favor or in opposition to the request. Findings of Fact: At the hearing of April 15, 2009, the Board unanimously n i ade the following findings of fact: 1. Appeal No. 2009-028 is that of Mark W: Seltzer and B rbara Bengen-Seltzer seeking to expand a nonconforming single family dwelling with an addition into the required 100-foot yard setback off Route 28. 2. The applicants are proposing to expand the existing nonconforming single-family dwelling further into the required setback off Route 28. The property i addressed, 1 Vermeer Court, Ostervilte, MA and is shown as parcel 82 on Assessor's Map 145. The lend is in the Residence C Zoning District. 3. The applicant is proposing an 18 by 22 foot, 1.5-story ddi(ion to the south of the dwelling located at 1 Vermeer Court, Osterville,.MA. The addition, is approximately proximately 600 sq.ft., with 396 sq.ft. on the first floor that is to be used as a family room opened to the existing kitchen and dining area. The second floor of the addition is connected to an existing bedroom and is to be used for storage and added closet area and dressing room. 4. The existing building now sits 38.3-feet off Route 28 arid was legally built in accordance with zoning in 1983. The setback off Route 28 is now 1 00-eet and the dwelling intrudes into that setback. It is a legally created nonconforming structure. There are few options to expand this structure as the lot is very narrow and runs parallel to Route'' 28. It is also encumbered with wetlands. 5. The existing dwelling is a three bedroom home as app oved by the Board of Health. There is no expansion in the number of bedrooms being proposed by the addition.
