Dear Mr. Crossen:
Please be advised that I represent Charles Tardanico, Trustee and Applicant. Mr.
Tardanico has entered into a Purchase and Sale Agreement with the current owners and
has requested a letter of determination of buildability. I have prepared this opinion letter
and various materials in support of the opinion for your consideration.
History of Zoning District
On March 5, 1956 the zoning district, in which the subject lots are located, was RD and was
increased to permit a single family detached residence on a lot 125 foot wide and
containing no less than 20,000 square foot of acreage. On March 6, 1969, the zoning was
changed a final time, when the district was rezoned RF-1 with one acre minimum lot area,
20 foot of frontage. The Ground Water Protection Overlay District Map dated 7/10/1996
shows that the subject lots do not in a Ground Water or Well Protection districts.
The Building►Lots
The three subject lots had been merged into 3 separate building lots prior to 1969, and
satisfied the then existing zoning prior to that date. Since 1967, two years prior to the final
zoning change, the lots have been continuously held to the current date in separate
ownership. Enclosed you will find copies of the deeds for the chains of title to the three
subject lots along with a flow sheet sketch of title for the three subject lots.
The Contiguous Lots
Also enclosed you will find the title to,all of the contiguous lots, which abut the three subject
lots. The contiguous abutting lots are color coded on the town Assessors Map iin orange.
The three lots which are the subject for the requested building permits are separately color
coded yellow. None of the abutting lots were held in common since the date of the zoning
change.
The Private Ways
With respect'to the private ways, these were created by a subdivision plan which was filed
for the Osterville Lane Company in 1873. As such, the roads being shown as Washington
Ave. and Lake Ave, and thereafter variously as First Ave. and Second Ave, respectively,
were lawfully created and predated the subdivision control law and zoning. The plan filed
for record dated April 1891 and recorded on May 12, 1916, also recognized the current
private roads and similarly pre-dated the subdivision and zoning by laws. The deeds out
from the common developer, which make up the chains of title for the surrounding lots,
recognize the roads as bounds. Edgy
Opinion
I am of the opinion that the three subject lots, although undersized, are non-conforming with
the current zoning but are protected under the Town By Law and pursuant to MGL Chapter
40A Section 6. As such, I believe a building permit for a single family residence should
issue as proposed by the applicant.

Dear Mr. Tardanico:
You have asked us to respond to your request to build on 3 lots off of West Street in
Osterville. After reviewing your lawyer's letter of 11/16/99 as to the grandfathered status
of each of the lots,we agree that the lots (Map 138 Parcels 030 and Map 139 Parcels 080
and 079)were held in separate ownership and, therefore, are buildable subject to required
road upgrades. Your engineer must inspect all construction as it is underway to assure
compliance with the roadway plan. He must submit a letter at the time of the as built
certifying compliance with this plan. A 24-hour notice to Steve Seymour is required
prior to roadway work.
1. From the paved surface of West Street you must clear and stump an 18' wide
roadway within the 40' layout of East Avenue.
2. The length of this roadway must pass by Parcel 080 to a point 50' beyond Parcel 079,
approximately 85' long.
3. A"T"or"Hammerhead"turn around easement must be constructed on Parcel 079, or
in the alternative you may simply continue the road on to the East Avenue paved
surface.

5. Extensions of the water main, electric, and gas lines must be provided and a plan of
such must be submitted for our files.
6. A final as built of everything must be submitted upon completion.
Building permit applications will be taken and, subject to all other requirements, issued
provided that the rough pre-asphalt work is done right away. Final certificates of
acceptances will not be issued,however, unless all the work is completed and inspected
by Steve Seymour and myself.

780 CMR 111.8 states that permits are deemed abandoned and invalid unless work has commenced within
six months of issuance.
The above permits were issued December 20, 1999 and I found no request for extension was received until
the above date.
Your permits officially expired on June 20, 1999 unless you can prove that some work(construction)has
taken place on each of the lots. Absent any indication of construction,your request must be denied.
