Dear Tom,
I would appreciate your opinion on Lot 5-West-Bay-Roane(AKA Carriage
Road), Oyster-Harbors.
The Harringtons presently own Lots 5 & 6 as shown on Land Court Plan
15354-38 dated Oct. 11, 1951 (plan and deed attached). An on the ground
survey computed 96,670 sf of upland for Lot 5. We have not done an on the
ground survey of Lot 6, however we estimated approximately 72,000 sf of
upland. The Harringtons home is on Lot 6. Lot 5 has a small shed and a
gazebo as can be seen on the attached Existing Conditions Plan. They would
like to sell Lot 5. However, I need an opinion on the RPOD zoning and how it
impacts the property.
My read of Zoning By-law 4-4-2:6 is these properties are exempt from RPOD.
Please confirm. Thank you in advance for your efforts.

That certain parcel of land with the buildings
located thereon situate in Barnstable (Oyster Harbors) in the
County of Barnstable and Commonwealth of Massachusetts, bounded
and described as follows:
Westerly by the easterly line of Feat Say Road, two
hundred forty (240) feet;
Northerly by land now or formerly of Oyster Harbors
Incorporated, by the southerly end of a
Way and by land now or formerly of
Elizabeth F. Williams, five hundred eleven
and 45./100 (511.45) feet;
Easterly by West Bay; and
Southerly by Lot 6, about four hundred twelve and
33/100 (412.33) feet.
Said .land is shown as LOT S on plan hereinafter
mentioned.

at Boston, a copy of which is filed in Barnstable County
Registry of Deeds In Land Registration Book 95 Page 95 with
Certificate of Title No.. 13555 and said land is shown thereon
as LOTS 5_annd f.
Together with all of the right, title and
interest, if any, of Oyster Harbors Incorporated in and to the
thatch, beach and flats to mean low water of West Bay between
the sidelines of said. lots extended in a general easterly
direction.
There is appurtenant to said lots a right of
way, which shall 'be exercised in common with all others
entitled thereto, over such of the roads from time to time laid
out and constructed in Oyster Harbors as may be reasonably
necessary to reach the Town Road leading to Osterville.
Lot S may not be subdivided but Bertram S.
Hawkins, his heirs, e'xecutors, 'administrators and assigns,
shall have the right and option to subdivide Lot 5 into two
lots by establishing a boundary line between them starting at a
point in the northerly boundary line of Lot 5, 240.45 .feet
distant from the easterly sideline of West Bay Road and running
a distance of about 2.30 feet to a point in the southerly
boundary line of said Lot 5 as being 195.33 feet distant from
' said easterly sideline of West Bay Road.
