The Harringtons presently own Lots 5 & 6 as shown on Land Court Plan 15354-38 dated Oct. 11, 1951 (plan and deed attached). An on the ground survey computed 96,670 sf of upland for Lot 5. We have not done an on the ground survey of Lot 6, however we estimated approximately 72,000 sf of upland. The Harringtons home is on Lot 6. Lot 5 has a small shed and a gazebo as can be seen on the attached Existing Conditions Plan. They would like to sell Lot 5. However, I need an opinion on the RPOD zoning and how it impacts the property. My read of Zoning By-law 4-4-2:6 is these properties are exempt from RPOD. Please confirm.
