In Appeal 2006-101, the applicant seeks to convert an existing nonconforming use from that of medical offices to a bank and expand the use by adding a drive-through banking facility. The existing property is a 15,478 sq.ft. corner lot fronting on West Bay and Lovell Roads in Osterville. The lot was created in 1967 and according to the Assessor's record, developed that same year. The one-story, 1,974 sq.ft. structure is currently used for medical office. The subject property was purchased by T.D. Realty Trust, Priscilla M. Hostetter, Trustee. This special permit is sought to permit the use of the site for banking inclusive of a drive-through window/ATM when the medical offices are vacated. Procedural &Procedural & Hearing This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on September 29, 2006. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened November 15, 2006, continued to January 17, 2007 and again to February 15, 2007, at which time the Board found to grant the special permit subject to conditions herein. Board Members deciding this appeal were, Daniel M. Creedon, Sheila Geiler, Kelly Kevin Lydon,John T. Norman, and Vice Chairman, Ron S. Jansson, who was also Acting Chairman for this appeal. Attorneys Patrick M. Butler and Eliza Cox represented both the applicant/property owner, T.D. Realty Trust/Priscilla M. Hostetter-Trustee, and the future occupant: Bank of Cape Cod. During the hearing. r Town of Barnstable-Zoning Board of Appeals Special Permit 2006-101-TD Realty Mr. Butler noted that Timothy T. Telman — President and Chief Executive Officer for the Bank of Cape Cod and Adam Hostetter- on behalf of T.D. Realty Trust, were present. He submitted a copy of a November 13, 2006 letter from Charles Sabatt- President of the Osterville Village Association, citing .that the association supports the granting of the appeal. Ms. Cox noted that the special permit is being sought pursuant to Sections 240-93.13 and 240-94.A for. the buildings and structural alterations and in order to change one nonconforming use to another nonconforming use. She noted that the alteration consists of adding a drive-through window to the property as well as changing it from medical offices to a bank. She addressed the criteria of Section 240-94.A(2) 'a' to 'g' noting that all seven requirements have been met. Details of this information are contained within the November 7, 2006 Memorandum submitted to the Board. A lengthy discussion on the issue of the zoning line and past and present zoning maps pursued. At the conclusion, the Board decided it would proceed with hearing the case as a legal pre-existing nonconforming use. The site plan was presented and improvements noted. The Board acknowledged receipt of the Site Plan Review Committee's approval letter. Public comment was requested and no-one spoke in favor or in opposition to the request. Findings of Fact: At the hearing of February 14, 2007 the Board unanimously made the following findings of fact: 1. Appeal 2006-101 is that of TD Realty Trust, for property addressed as 57 West Bay Road, Osterville, MA. The locus is shown on Assessor's Map 117 as parcel 117. It is located in both a Residence C and a Business A Zoning District. The property is a 15,478 sq.ft. corner lot fronting on West Bay and Lovell Roads in Osterville. Itwas created in 1967 and according to the Assessor's record, developed that same year. It now supports a one-story, 1,974 sq.ft. structure in use for medical offices by Dr. Benoit. 2. The applicant seeks a special permit pursuant to Sections 240-93.13 and 240-94.A for alterations to the building and for a change in the nonconforming use. The proposed change in use is from medical offices to a bank. The proposed alteration to the structure is the addition of a banking drive-through window. 3. The existing use of the site for a medical office practice apparently dates back to 1973/74. Although there is confusion as to the actual zoning line, it appears it was legally established at that time and in conformity to the delineated business area in Osterville as shown on the zoning map in use at that time. Based on that, this request for a special permit for a change in the use and alteration/expansion of the pre-existing nonconforming use is properly before the Board. This change in use is from that of a medical office to a bank. The alteration/expansion proposed is that of a drive-through window/ATM and related site improvements. 4. Testimony has been given and evidence submitted that the proposal meets with all requirements of Section 240-94(A) 'a'through 'g' for the change of a nonconforming use to another nonconforming use. 2 a ' Town of Barnstable-Zoning Board of Appeals Special Permit 2006-101-TD Realty 5. Mr. Charles Sabatt, as President of the Osterville Village Association has submitted a November 13, 2006 letter indicating that the Village Association supports the granting of the appeal. 6. A letter from the Site Plan Review Coordinator, Ms. Ellen M. Swiniarski has been submitted citing that the site plan for the improvements has been reviewed and found approvable by that committee. 7. The additional benefits of granting this is that the requested change in the use includes the reuse and preservation of the existing structure located on the property. The proposed drive-through window/ATM respects both the building architecture and neighborhood in terms of its location. On-site wastewater disposal would be reduced. Elimination of perpendicular parking on Lovell Road is a safer condition. 8. The application before the Board falls within a category specifically excepted in the ordinance for a grant of a special permit and after evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the zoning ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. a Decision: Based on the findings of fact, a motion was duly made and seconded to grant the permit to allow for a change in the use of the property from that of medical offices to banking and to authorize the expansion of the use by granting a drive-through, subject to the following conditions: 1. Development of the site shall be as proposed in plans submitted to the Board and entitled "Site Plan Proposed Layout and Parking at 57 West Bay Road, Barnstable (Osterville) Mass., "Site Plan Proposed Grading and Drainage at 57 West Bay Road, Barnstable (Osterville) Mass., both of which are dated January 25, 2007, Sheet No 2 and 3, as prepared by Cape Sury and to be initialed by the Chairman. 2. Exterior alterations to the existing structure shall be substantially in conformity to the plan submitted to the Board and entitled "Bank of Cape Cod Drive-up Canopy Addition for CCCB, LLC 57 West Bay Road Osterville, MA as drawn by DRL Associates, Inc. last dated 10/17/06 and to be initialed by the Chairman. 3. All improvements within the public rights-of ways shall be to Town standards and plans for the improvements shall p be reviewed and approved by the Town Engineer prior to the Implementation of those improvements. Those improvements shall conform to applicable requirements of CMR 521 Section 21.00 and 22.00. 4. The on-site pavement that is now part of the existing perpendicular parking off Lovell Road shall be removed as shown on the approved plan and the area appropriately I and scaped./—A landscape plan shall be prepared for that area and submitted for review and approved-by—the-staff prior to the) issuance of a building permit. 5. Site lighting shall be of residential character and shall not exceed 18 feet in height. He submitted a copy of a November 13, 2006 letter from Charles Sabatt-President of the Osterville Village Association, citing that the association supports the granting of the appeal. Ms. Cox noted that the special permit is being sought pursuant to Sections 240-93.B and 240-94.A for. the buildings and structural alterations and in order to change one nonconforming use to another nonconforming use. She noted that the alteration consists of adding a drive-through window to the property as well as changing it from medical offices to a bank. She addressed the criteria of Section 240-94.A(2) 'a'to'g' noting that all seven requirements have been met. Details of this information are, contained within the November 7, 2006 Memorandum submitted to the Board. A lengthy discussion on the issue of the zoning line and past and present zoning maps pursued. At the conclusion, the Board decided it would proceed with hearing the case as a legal pre-existing nonconforming use. The site plan was presented and improvements noted. The Board acknowledged receipt of the Site Plan Review Committee's approval letter. Public comment was requested and no-one spoke in favor or in opposition to the request. Findings of Fact: At the hearing of February 14, 2007 the Board unanimously made the following findings of fact: 1. Appeal 2006-101 is that of TD Realty Trust, for property addressed as 57 West Bay Road, Osterville, MA. The locus is shown on Assessor's Map 117 as parcel 117. It is located in both a Residence C and a Business A Zoning District. The property is a 15,478 sq.ft. corner lot fronting on West Bay and Lovell Roads in Osterville. It was created in 1967 and according to the Assessor's record, developed that same year. It now supports a one-story, 1,974 sq.ft. structure in use for medical offices by Dr. Benoit. 2. The applicant seeks a special permit pursuant to Sections 240-93.6 and 240-94.A for alterations to ! the building and for a change in the nonconforming use. The proposed change in use is from medical offices to a bank. The proposed alteration to the structure is the addition of a banking drive-through window. 3. The existing use of the site for a medical office practice apparently dates back to 1973/74. Although there is confusion as to the actual zoning line, it appears it was legally established at that time and in conformity to the delineated business area in Osterville as shown on the zoning map in use at that time. Based on that, this request for a special permit for a change in the use and alteration/expansion of the pre-existing nonconforming use is properly before the Board. This change in use is from that of a medical office to a bank. The alteration/expansion proposed is that of a drive-through window/ATM and related site improvements. 4. Mr. Charles Sabatt, as President of the Osterville Village Association has submitted a November 13, 2006 letter indicating that the Village Association supports the granting of the appeal. 6. A letter from the Site Plan Review Coordinator, Ms. Ellen M. Swiniarski has been submitted citing that the site plan for the improvements has been reviewed and found approvable by that committee. 7. The additional benefits of granting this is that the requested change in the use includes the reuse and preservation of the existing structure located on the property. The proposed drive-through window/ATM respects both the building architecture and neighborhood in terms of its location. On-site wastewater disposal would be reduced. Elimination of perpendicular parking on Lovell Road is a safer condition. 8. The application before the Board falls within a category specifically excepted in the ordinance for a grant of a special permit and after evaluation of all the evidence presented,the proposal fulfills the spirit and intent of the zoning ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. Decision: Based on the findings of fact, a motion was duly made and seconded to grant the permit to allow for a change in the use of the property from that of medical offices to banking and to authorize the expansion of the use by granting a drive-through, subject to the following conditions: 1. Development of the site shall be as proposed in plans submitted to the Board and entitled 'Site Plan Proposed Layout and Parking at 57 West Bay Road, Barnstable (Osterville) Mass., 'Site Plan Proposed Grading and Drainage at 57 West Bay Road, Barnstable (Osterville) Mass., both of which are dated January 25, 2007, Sheet No 2 and 3, as prepared by Cape Sury and to be initialed by the Chairman. 2. Site lighting shall be of residential character and shall not exceed 18 feet in height. As a result of our discussions we offer the following: SPR Comment Due to the proposed change of traffic flow through the site, trucks will need to exclusively use the westerly egress when entering the property. Response It was jointly agreed that the following suggested condition is reasonable to address this issue. "The applicant shall coordinate with the landlord of the shopping center to take what actions needed to direct deliveries that are made to the rear of the mall building to use the westerly most curb-cut to access the rear delivery area." SPR Comment: The question was raised as to whether there is a standard for the design of ATM lanes. The proposed 8.S ft width of the ATM lanes.may not be adequate. Response The project architect DRL Associates Inc. has stated that an 8.5 to 9.0 foot width is the norm. In the architect's experience if you open up the lane width then vehicles tend to drift out and are too far from the window and then have to back up and realign. The existing property is a 15,478 sq.ft. corner lot fronting on West Bay and Lovell Roads in Osterville. The lot was created in 1967 and according to the Assessor's record, developed that same year. The one-story, 1,974 sq.ft. structure is currently used for medical office. The subject property was purchased by T.D. Realty Trust, Priscilla M. Hostetter, Trustee. This special permit is sought to permit the use of the site for banking inclusive of a drive-through window/ATM when the medical offices are vacated. Procedural & Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on September 29, 2006. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened November.. 15, 2006, continued to January 17, 2007 and again to February 15, 2007, at which time the Board found to grant the special permit subject to conditions herein. Board Members deciding this appeal were, Daniel M. Creedon, Sheila Geiler, Kelly Kevin Lydon, John T. Norman, and Vice Chairman, Ron S. Jansson, who was also Acting Chairman for this appeal. Attorneys Patrick M. Butler and Eliza Cox represented both the applicant/ property owner, T.D. Realty Trust/Priscilla M. Hostetter-Trustee, and the future occupant: Bank of Cape Cod. During the hearing. I Town of Barnstable-Zoning Board of Appeals Special Permit 2006 101 -TD Realty Mr. Butler noted that Timothy T. Telman — President and Chief Executive Officer for the Bank of Cape Cod and Adam Hostetter-on behalf of T.D. Realty Trust, were present. He submitted a copy of a November 13, 2006 letter from Charles Sabatt- President of the Osterville Village Association, citing that the association supports the granting of the appeal. Ms. Cox noted that the special permit is being sought pursuant to Sections 240-93.13 and 240-94.A for the buildings and structural alterations and in order to change one nonconforming use to another nonconforming use. She noted that the alteration consists of adding a drive-through window to the property as well as changing it from medical offices to a bank. She addressed the criteria of Section 240-94.A(2) 'a' to 'g' noting that all seven requirements have been met. Details of this information are contained within the November 7, 2006 Memorandum submitted to the Board. A lengthy discussion on the issue of the zoning line and past and present zoning maps pursued. At the conclusion, the Board decided it would proceed with hearing the case as a legal pre-existing nonconforming use. The site plan was presented and improvements noted. The Board acknowledged receipt of the Site Plan Review Committee's approval letter. Public comment was requested and no-one spoke in favor or in opposition to the request. Findings of Fact: At the hearing of February 14, 2007 the Board unanimously made the following findings of fact: 1. Appeal 2006-101 is that of TD Realty Trust, for property addressed as 57 West Bay Road, Osterville, MA. The locus is shown on Assessor's Map 117 as parcel 117. It is located in both a Residence C and a Business A Zoning District. The property is a 15,478 sq.ft. corner lot fronting on West Bay and Lovell Roads in Osterville. It was created in 1967 and according to the Assessor's record, developed that same year. It now supports a one-story, 1,974 sq.ft. structure in use for medical offices by Dr. Benoit. 2. The applicant seeks a special permit pursuant to Sections 240-93.13 and 240-94.A for alterations to the building and for a change in the nonconforming use. The proposed change in use is from medical offices to a•bank. The proposed alteration to the structure is the addition of a banking drive-through window. 3. The existing use of the site for a medical office practice apparently dates back to 1973/74. Although there is confusion as to the actual zoning line, it appears it was legally established at that time and in conformity to the delineated business area in Osterville as shown on the zoning map in use at that time. Based on that, this request for a special permit for a change in the use and alteration/expansion of the pre-existing nonconforming use is properly before the Board. This change in use is from that of a medical office to a bank. The alteration/expansion proposed is that of a drive-through window/ATM and related site improvements. 4. Testimony has been given and evidence submitted that the proposal meets with all requirements of Section 240-94(A) 'a' through 'g' for the change of a nonconforming use to another nonconforming use. 2 'M Town of Barnstable-Zoning Board of Appeals Special Permit 2006-101-TD Realty 5. Mr. Charles Sabatt, as President of the Osterville Village Association has submitted a November 13, 2006 letter indicating that the Village Association supports the granting of the appeal. 6. A letter from the Site Plan Review Coordinator, Ms. Ellen M. Swiniarski has been submitted citing that the site plan for the improvements has been reviewed and found approvable by that committee. 7. The additional benefits of granting this is that the requested change in the use includes the reuse and preservation of the existing structure located on the property. The proposed drive-through window/ATM respects both the building architecture and neighborhood in terms of its location. On-site wastewater disposal would be reduced. Elimination of perpendicular parking on Lovell Road is a safer condition. 8. The application before the Board falls within a category specifically excepted in the ordinance for a grant of a special permit and after evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the zoning ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. Decision: Based on the findings of fact, a motion was duly made and seconded to grant the permit to allow for a change in the use of the property from that of medical offices to banking and to authorize the expansion of the use by granting a drive-through, subject to the following conditions: 1. Development of the site shall be as proposed in plans submitted to the Board and entitled "Site Plan Proposed Layout and Parking at 57 West Bay Road, Barnstable (Osterville) Mass., "Site Plan Proposed Grading and Drainage at 57 West Bay Road, Barnstable (Osterville) Mass., both of which are dated January 25, 2007, Sheet No 2 and 3, as prepared by Cape Sury and to be initialed by the Chairman. 2. Exterior alterations to the existing structure shall be substantially in conformity to the plan submitted to the Board and entitled "Bank of Cape Cod Drive-up Canopy Addition for CCCB, LLC 57 West Bay Road Osterville, MA as drawn by DRL Associates, Inc. last dated 10/17/06 and to be initialed by the Chairman. 3. All improvements within the public rights-of ways shall be to Town standards and plans for the improvements shall be reviewed and approved by the Town Engineer prior to the implementation of those improvements. Those improvements shall conform to applicable requirements of CMR 521 Section 21.00 and 22.00. 4. The on-site pavement that is now part of the existing perpendicular parking off Lovell Road shall be removed as shown on the approved plan and the area appropriately landscaped. A landscape plan shall be prepared for that area and submitted for review and approved by the staff prior to the issuance of a building permit. 5. Site lighting shall be of residential character and shall not exceed 18 feet in height.
