Sullivan et al,Trustees of Tamarack Trust,lot 2 by Tamarack Associates, Inc.,lot 3 by the trust,lot 4 by the corporation,lot 5 by the trust,lot 7 by the trust,and lot 8 by the corporation. I believe that only lots 3 and 7 had buildings on them. Lot 1 and lot 2 were sold to T. A.Nelson on August 29, 1986. Lot 3 was sold to Jane Powers in December of 1986,lot 4 to Kevin McCafferty in May of 1987,lot 5 with building thereon,to Kevin McCafferty and his wife in May of 1986. Lot 7 was conveyed to Sentry Federal Savings Bank in September of 1989 and lot 8 was deeded to Huntingest Men in June of 1986. The current status shows that lot 1 now belongs to Mary Ellen O'Hara since 1991 with land and buildings; lot 2,M. Patricia Finnegan,Trustee,with buildings,since 1994; lot 3,Grace S. Adair,Trustee,land and buildings since 1994; iot 4,Kevin McCafferty,land only since 1987; lot 5, Harriet P. Kavanagh,land and buildings owned since November of 1993;lot 7,Stephen Susdko,land and buildings,I don't know how long; lot 8,Huntingest Men,Inc.,land and buildings since 1986. In other words,if Tamarack Trust and Tamarack Associates,Inc. are treated as one and the same,then it would appear that all of the lots merged in 1986 when the law changed. This provides that if the zoning bylaw changes, then for a period of five years from the effective date of the change,any increase in area shall not apply to a lot for single family residence use that complies with subsections A,B,C and D,is common ownership with not more than two adjoinin held in g lots,had 7;500 square feet in area,was on a plan that conforms to zoning when created and conformed to zoning as to January 1, 1976. The protection afforded by this paragraph shall become vested upon the sale or transfer of the lot,so protected,into ownership separate from that of adjoining lots or the building thereon of a residence. I am,only referring to lot 4. The zoning law changed,I believe,in 1986. In that year lot 1 and 2 were sold to T. A.Nelson and later built upon. Lot 3 already had building on it and was conveyed in December of 1986 to Jane Powers. Lot 5 was also built upon and in May of 1986 was conveyed to Kevin McCafferty and his wife. Lot 4,a vacant lot,was conveyed to Kevin McCafferty in May of 1987. It is,therefore,my opinion that we comply with this section and that our rights became vested upon the transfer of a lot into Kevin McCafferty in May of 1986.
