February 23, 2001. On February 28, 2001, the DCPC was nominated. Our agreement never anticipated the DCPC or the problems it would create for my family. At this time, our failure to obtain a building permit could result in the forfeiture of our deposit because my wife and I will not be able to perform on the contract without financing, which is contingent on receiving a permit. The subject property is difficult to permit. We had to get an Order of Conditions from Conscom, a certificate of appropriateness from OKH, install a well and have the water tested, and have a custom home designed to meet the unique requirements of this lot and neighborhood. Our costs and fees excluding our deposit are $11,908. A breakdown of these costs is enclosed. We anticipated the ordinary permitting process would take time and allowed for it by contract. We could not have reasonably anticipated the intervening DCPC.
