David Munsell, a member of the Planning Board reported to the BPD on 10/26/07 that Patrick Page became enraged during a conversation on 10/25/07 and threatened to kill Rob Gatewood and then himself. Carl Syriala was also present and later submitted a written statement to the BPD. The same threat was repeated in the presence of Local Inspector Jack LeBoeuf on 10/26/06. He provided a statement to BPD on the same date. OKH ordered compliance. 07/25—07/27/07 Three citations issued for pennants. 1 10/01/07— 10/05/07 Flags removed from 21 Buttonwood. 10/9/07 Scheduled perc test. 10/11/07 Second scheduled perc test. 2 i Barnstable County 1st District Court 11/9/07 9AM- First Call • Local Inspector Jack LeBoeuf& Zoning Officer Robin Giangregorio reported at 8:50 AM for first call. • At no time did any party representing legal/prosecution contact us on or before this session commenced. • We entered the court room and occupied the first bench. • At 9:45 Christine Palkoski was noted to be seated with the other attorneys. • She did not have a file with her. • Patrick Page was called and advised the judge that he wanted to resolve the issue on this date. •, The case was held over for second call in order to afford the parties a chance to discuss the pending issues and come to resolution. • Patrick Page exited the court room with his wife and David Munsell, a member of the Planning Board. • Christine sat down again and made no attempt to contact either JL or myself. • After a few moments Christine exited through a side door into a hallway. • Christine was found talking to an unknown man in the hallway. • We waited for a few minutes expecting that she would address us. • Finally, I interrupted her and suggested that she get Patrick in order that we may discuss the matter before us. • We assembled in an empty jury room. • Christine stated that she understands the case to be "...about a flag or something". • JL questioned David Munsell's right to be included and whether or not his position as a Planning Board member presented a conflict of interest • David Munsell asked Christine her opinion. • She replied that she did not know. • PP attempted to review the history of the events again including the review of plot plans. • RG advised him that we are all familiar with the issues and the purpose of this session is to see if we can negotiate a settlement. • Subsequently, PP placed an orange ribbon on the table. • He stated that that everything was removed per the letter from the Building Commissioner. • The subject letter actually referred to a structure (wishing well) and not the pennants. • PP further stated the flags were removed within 24 hours of receipt of the letter- but only the wishing well was removed. • David Munsell questioned RG about the pennants and the citation dates. • Mr. Munsell stated that he"...is very disappointed..." (in reference to my response) as he believes the pennants were not there on those dates. • RG asked PP what his intentions were with regards to this meeting. 3 • PP responded that he wanted me to tell the judge that we came to an understanding and should request that the matter be dismissed. • I advised PP that was not going to happen. • PP became agitated. He told me I would not win, that I perjured myself and I am wasting taxpayer's money. • PP also accused JL of"making trouble" for him—a reference to PP's death threat against Rob Gatewood which resulted in his arrest. • During a heated exchange, PP admitted he removed the stop work order from the wishing well in defiance, that he subsequently removed the wishing well itself and that he installed the pennants/flags. • PP became increasingly enraged, flailing his arms and abruptly standing up —pointing his finger in JL's face. • JL asked PP if he denied the Rob Gatewood incident. • PP did in fact deny the event during this altercation. • JL called pp "... a piece of shit". • PP responded in like. • RG announced the meeting was over and escorted JL to the door. • PP followed bellowing about his constitutional rights. • Christine remained in the jury room with PP, Mrs. Page & David Munsell. • RG & JL waited for second call in the lobby. • Subsequently, the Pages, D Munsell & Christine appeared in the lobby. • PP was boisterous. He kept looking over at JL and continued to make remarks. • PP walked over to JL and began an animated and agitated one-side conversation before he returned to his party. • A short time later, PP again approached JL but this time he clearly violated the standards of personal space. • All of PP's mannerisms appeared to be deliberately threatening and intimidating in nature. • RG separated JL & PP. • A witness approached RG and stated that she saw the entire episode. • She identified herself as Lisa Sisson Whiting (364-5472 & 420-1434). • Ms Whiting stated that PP accosted JL and was very volatile. • Later, Ms. Whiting's mother pleaded with RG to make sure her daughter's information is not released to anyone because "...it is obvious that he (PP) is unbalanced". • Both mother and daughter expressed fear with regards to PP. • RG approached Christine and advised that JL & RG would be outside. • Christine advised that we could just leave that she would obtain a court date on our behalf. • RG responded that we are not leaving before PP. • After sometime outside, JL & RG retuned to the court room for second call. • PP was called. 4 • Christine advised the judge that a mutual date was agreed upon (although this information was not revealed nor discussed with the two inspectors present). • Christine also informed the judge that a meeting was being arranged at town hall with the intention of resolving the matter prior to the 12/11/07 court date. This information was not shared with either JL or RG. • It should be noted that if JL & RG left earlier as instructed by Christine,we would not be aware of the meeting at town hall. • Christine did not debrief with us. • As we drove out of the parking lot, Christine was chatting amiably with the Pages and David Munsell. 5 240-60 Definitions SIGN—Any permanent or temporary structure, light, letter, word, model, banner, pennant, insignia, trade flag, representation or any other device which is used to advertise, inform or attract the attention Of the public and which is designed to be seen from outside a building, including all signs in windows or doors but not including window displays of merchandise. 0-G1. Prohibited signs. The following signs shall be expressly prohibited in all zoning districts, contrary provisions of this chapter notwithstanding: A. Any sign, all or any portion of which is set in motion by movement, including pennants, banners or flags, except official flags of nations or administrative or political subdivisions thereof. B. Any sign which incorporates any flashing, moving or intermittent lighting. C. Any display lighting by strings or tubes of lights, including lights which outline any part of a building or which are affixed to any ornamental portion thereof, except that temporary traditional holiday decorations of strings of small lights shall be permitted between November 15 and January 15 of the following year. Such temporary holiday lighting shall be removed by January 15. D. Any sign which contains the words "Danger"or"Stop" or otherwise presents or implies the need or requirement of stopping or caution, or which is an imitation of, or is likely to be confused with any sign customarily displayed by a public authority. E. Any sign which infringes upon the area necessary for visibility on corner lots. F. Any sign which obstructs any window, door, fire escape, stairway, ladder or other opening intended to provide light, air or egress from any building. G. Any sign or lighting which casts direct light or glare upon any property in a residential or professional residential district. H. Any portable sign, including any sign displayed on a stored vehicle, except for temporary political signs. I. Any sign which obstructs the reasonable visibility of or otherwise distracts attention from a sign maintained by a public authority. J. Any sign or sign structure involving the use of motion pictures or projected photographic scenes or images. K. Any sign attached to public or private utility poles, trees, signs or other appurtenances located within the right-of-way of a public way. L. [Amended 2-20-1997] In residential districts, only the following signs are permitted: A. One sign displaying the street number and identifying the premises not to exceed two square feet in area. The street number must be approved by the Engineering Department in conformance with the Town's regulations governing numbering of buildings. Editors Note:see Ch. 51,Buildings,Numbering of. B. One sign no larger than four square feet in area shall be allowed which displays the name of the house or the name of the family residing therein. C. One sign not to exceed two square feet in area shall be permitted for a professional office or home occupation for which a special permit or variance has been granted by the Board of Appeals. D. One temporary sign not to exceed four square feet in area advertising property for sale, lease or rent. Such signs must be removed within 10 days of transfer of title or signing of lease or rental agreement. E. Where a legal nonconforming business exists within a residential district, one sign may be permitted by the Building Commissioner if it is determined that the appearance, placement, size and lighting of the proposed sign will not be detrimental to the residential character or visual quality of the area. In no instance shall such signs exceed eight feet in height or eight square feet in area. F. Permits may be posted at construction sites as required by state or Town regulations, except that in no instance shall they be attached to trees or utility poles. G. One identification sign not to exceed 12 square feet in area may be permitted at any public entrance to a subdivision or multifamily development. H. Illuminated signs]R n r'esl� ,r tial zones require the approval of the Building Commissioner, and may be permitted if the applicant can demonstrate that the proposed illumination will not intrude upon adjacent residential areas, will not be illuminated except during actual hours of business, and will not cause traffic hazards. I. One identifying sign for lodging houses, bed-and-breakfast or similar identification not to exceed four square feet in area. 3 ARGUMENT 1. Chapter 240-61 (b) expressly prohibits pennants. 2. Chapter 240-63 Signs in a Residential District fails to identify pennants or the like as an allowed sign—temporary or otherwise. 3. The definition under Chapter 240-60 does not state that a sign is necessarily limited to or associated with the sale of an item. In my opinion, the pennants have been installed to attract the attention of the public to Mr. Page's self-inflicted misfortune and his claim that local government has impeded his property rights. It should be noted that Mr. Page has threatened another government official (Rob Gatewood, Conservation Director). He has a history of badgering and imposing his will on others including religious rituals. I, respectfully request that his non-compliance and defiant behavior not be rewarded. Law abiding citizens and neighbors should not be penalized. Violations consist of numerous florescent orange flags/pennants, placed close to the ground marking the outline of a house, in a highly visible location on Rt. 6A. and erection of a wishing well close to the roadway. . Mr. Page has not filed an application for the flags/pennants on his property, or the wishing well that was erected close to the roadway. The wishing well has since been removed; the florescent orange flags/pennants have subsequently been removed. Chronology of Requests for Enforcement Action. Meeting July 11, 2007, enforcement.issues regarding the above referenced property were discussed. The minutes state that Patrick Page had been notified that he needed to submit a Certificate of Appropriateness Application for the wishing well. On August 8, 2007, a Building Division complaint form was completed requesting. enforcement of the Act and Regulations because of;the illegal signs on the property. On August 8, 2007, the Old Kings Highway voted unanimously at their meeting to request enforcement of the Act and Regulations, ratifying the original request made by the Chairman. Please see the attached minutes. Please note that numerous calls had been received from the public at the Historic Office - for three months while flags/banners were on the property. The public inquired why the flags/banners were allowed on the property without approval of the Old Kings Highway Committee. THOMAS J BIRD Ref: 06-3114-OF Entered: 10/26/2006 @ 1347 Entry ID: 188 Modified: 10/26/2006 @ 1451 Modified ID: 188 On 10/26/06 at approx 13011 was dispatched to the front lobby of the police station to take a report of a threat to commit a crime, to wit: murder. Upon arrival I spoke with David Munsell who stated he is acquainted with a Patrick Page of 1780 Main St. Rte 6A and stops and talks with him periodically. Munsell stated he is aware that Page is in a legal battle with the Barnstable Conservation Commission over a land/residential issue concerning his property and a nearby house. Page has been trying to get approval from the Commission for the past year and a half in regards to moving-a nearby building and has even disrupted a public town meeting on.the subject on 7/19/05 (See report#05-1811-OF)...._On 10/25/06 at approx 1500 Munsell stopped at Page's residence as he saw him outside and wanted to see how things were going. During the conversation the property issue dame up and Page became "enraged" and stated, "I'm going to kill Rob'Gatewood (Conservation Officer), they'll never find the pieces of him and then I'll kill myself'. Page then placed one of his index fingers in his mouth in a gesture that Munsell interpreted as Page shooting himself in the head with a gun. Munsell stated that there was also another subject present during this incident, a Carl Syriala. Munsell gave a written statement as to the facts of what had happened. I was able to contact Syriala via phone and asked about the incident and he stated he was present and Page did begin "ranting and raving" and he did state something to the effect of"I'll shoot myself'. I asked Syriala if Page made any statements toward Rob Gatewood and he stated that Page said he definitely didn'tlike him. Syriala stated that Page's wife came out during the incident and Page calmed down and when Syriala returned approx. 45 min later Page was completely calm and made no mention of the incident. Munsell stated he did speak with Page later and Page apologized. An application for complaint was completed seeking a warrant for Page's arrest for Threat to commit a crime to wit: Murder. Note: A Notice of threat and/or attempted suicide form was completed as well. Note: I also spoke with Rob Gatewood on this date and he stated he has not had any contact with Page in the last two months,however the last time he had conversation with Page he expressed that he did not feel he was being treated fairly by the commission. Page also stated to some of the commission employees that he would go over to town hall and "hang himself'. I At approx. 1430 this date I had conversation with Jack LeBeouf, Town Building Inspector, who stated at approx. 1345 he was at the intersection of Buttonwood and Route 6A taking a picture of a structure that Page was erecting on his property. LeBeouf took one photo and returned to his truck and observed Page standing near his truck. Page was very agitated and demanded to know who LeBeouf was and who he worked for. Page then stated, "You don't have the balls to get out of your truck" at which LeBeouf identified himself as a town building inspector. Page then began explaining the problems he has been having recently over the property and he stated, "I'm going to kill Rob Gatewood and I then I'm going to kill myself'. Page also stated, "I'm coming to the end and I'm going to do something crazy". At this point LeBeouf drove away and than,phoned the police. Violations consist of numerous florescent orange flags/pennants, placed close to the ground marking the outline of a house, in a highly visible location on Rt. 6A, and erection of a wishing well close to the roadway. Mr. Page has not filed an application for the flags/pennants on his property, or the wishing well that was erected close to the roadway. The wishing well has since been removed; the florescent orange flags/pennants have subsequently been removed. Chronology of Requests for Enforcement Action. Meeting July 11, 2007, enforcement issues regarding the above referenced property were discussed. The minutes state that Patrick Page had been notified that he needed to submit a Certificate of Appropriateness Application for the wishing well. On August 8, 2007, a Building Division complaint form was completed requesting enforcement of the Act and Regulations because of the illegal signs on the property. On August 8, 2007, the Old Kings Highway voted unanimously at their meeting to request enforcement of the Act and Regulations, ratifying the original request made by the Chairman. Please see the attached minutes. Please note that numerous calls had been received from the public at the Historic Office for three months while flags/banners were on the property. Chair Anderson stated the problem is the roof is so long and suggested a false chimney or cupola. Bearse feels that the chimney needs to stay. (in reference to my response) as he believes the pennants were not there on those dates. • RG asked PP what his intentions were with regards to this meeting. 3 "1 • PP responded that he wanted me to tell the judge that we came to an understanding and should request that the matter be dismissed. • I advised PP that was not going to happen. • PP became agitated. He told me I would not win, that I perjured myself and I am wasting taxpayer's money. • PP also accused JL of"making trouble" for him— a reference to PP's death threat against Rob Gatewood which resulted in his arrest. • During a heated exchange, PP admitted he removed the stop work order from the wishing well in defiance, that he subsequently removed the wishing well itself and that he installed the pennants/flags. • PP became increasingly enraged, flailing his arms and abruptly standing up —pointing his finger in JL's face. • JL asked PP if he denied the Rob Gatewood incident. • PP did in fact deny the event during this altercation. • JL called pp "... a piece of shit". • PP responded in like. • RG announced the meeting was over and escorted JL to the door. • PP followed bellowing about his constitutional rights. • Christine remained in the jury room with PP, Mrs. Page & David Munsell. • RG & JL waited for second call in the lobby. • Subsequently, the Pages,D Munsell & Christine appeared in the lobby. • PP was boisterous. He kept looking over at JL and continued to make remarks. • PP walked over to JL and began an animated and agitated one-side conversation before he returned to his party. • A short time later, PP again approached JL but this time he clearly violated the standards of personal space. • All of PP's mannerisms appeared to be deliberately threatening and intimidating in nature. • RG separated JL & PP. • A witness approached RG and stated that she saw the entire episode. • She identified herself as Lisa Sisson Whiting (364-5472 & 420-1434). • Ms Whiting stated that PP accosted JL and was very volatile. • Later, Ms. Whiting's mother pleaded with RG to make sure her daughter's information is not released to anyone because "...it is obvious that he (PP) is unbalanced". • Both mother and daughter expressed fear with regards to PP. • RG approached Christine and advised that JL & RG would be outside. • Christine advised that we could just leave that she would obtain a court date on our behalf. • RG responded that we are not leaving before PP. • After sometime outside, JL & RG retuned to the court room for second call. • PP was called. 4 r N a• , • Christine advised the judge that a mutual date was agreed upon (although this information was not revealed nor discussed with the two inspectors present). • Christine also informed the judge that a meeting was being arranged at town hall with the intention of resolving the matter prior to the 12/11/07 court date. He told me I would not win, that I perjured myself and I am wasting taxpayer's money. • PP also accused JL of"making trouble" for him—a reference to PP's death threat against Rob Gatewood which resulted in his arrest. • During a heated exchange, PP admitted he removed the stop work order from the wishing well in defiance, that he subsequently removed the wishing well itself and that he installed the pennants/flags. i • PP became increasingly enraged, flailing his arms and abruptly standing up —pointing his finger in JL's face. • JL asked PP if he denied the Rob Gatewood incident. • PP did in fact deny the event during this altercation. • JL called pp "... a piece of shit". • PP responded in like. • RG announced the meeting was over and escorted JL to the door. • PP followed bellowing about his constitutional rights. • Christine remained in the jury room with PP, Mrs. Page & David Munsell. • RG & JL waited for second call in the lobby. • Subsequently, the Pages, D Munsell & Christine appeared in the lobby. • PP was boisterous. He kept looking over at JL and continued to make remarks. • PP walked over to JL and began an animated and agitated one-side conversation before he returned to his party. • A short time later, PP again approached LJ but this time he clearly violated the standards of personal space. • All of PP's mannerisms appeared to be deliberately threatening and intimidating in nature. • RG separated JL & PP. • A witness approached RG and stated that she saw the entire episode. • She identified herself as Lisa Sisson Whiting (364-5472 & 420-1434). • Ms Whiting stated that PP accosted JL and was very volatile. • Later,Ms. Whiting's mother pleaded with RG to make sure her daughter's information is not released to anyone because "...it is obvious that he (PP) is unbalanced". • Both mother and daughter expressed fear with regards to PP. • RG approached Christine and advised that JL & RG would be outside. • Christine advised that we could just leave that she would obtain a court date on our behalf. • RG responded that we are not leaving before PP. • After sometime outside,JL & RG retuned to the court room for second call. • PP was called. • Christine advised the judge that a mutual date was agreed upon (although this information was not revealed nor discussed with the two inspectors present). • Christine also informed the judge that a meeting was being arranged at town hall with the intention of resolving the matter prior to the 12/11/07 court date. This information was not shared with either JL or RG. • It should be noted that if JL & RG left earlier as instructed by Christine, we would not be aware of the meeting at town hall. • Christine did not debrief with us. • As we drove out of the parking lot, Christine was chatting amiably with the Pages and David Munsell.
