INTENT: It is the intent of this section to allow the residents of the Town of Barnstable to operate a home occupation
within single family dwellings,subject to the provisions of Section 4-1.4 of the Zoning ordinance,provided that the activity
shall not be discernible from outside the dwelling. there shall be no increase in noise or odor,no visual.alteration to the
premises which would suggest anything other than a residential use;no increase in traffic above normal residential volumes;
and no increase in air or groundwater pollution.
After registration with the Building Inspector,a customary home occupation shall be permitted as of right subject to the
following conditions:
• The activity is carved on by the permanent resident of a single family residential dwelling unit,located within
that dwelling unit
• Such use occupies no more than 400 square feet of space.
• There are no external alterations to the dwelling which are not customary in residential buildings,and there is
no outside evidence of such use.
• No traffic will be generated in excess of normal residential volumes.
• The use does not involve the production of offensive noise,vibration,smoke,dust or other particular matter,
odors,electrical disturbance,heat,glare,humidity or other objectionable effects.
• There is no storage or use of toxic or hazardous materials,or flammable or explosive materials,in excess of
normal household quantities.
• Any need for parking generated by such use shall be met on the same lot containing the Customary Home
Occupation,and not within the required front yard.
• There is no exterior storage or display of materials or equipment
• There are no commercial vehicles related to the Customary Home Occupation,other than one van or one
pick-up truck not to exceed one ton capacity,and one trailer not to exceed 20 feet in length and not to
exceed 4 tires,parked on the same lot containing the Customary Home Occupation.
• No sign shall be displayed indicating the Customary Home Occupation.
• If the Customary Home Occupation is listed or advertised as a business,the street address shall not be
included.
• No person shall be employed in the Customary Home Occupation who is not a permanent resident of the
dwelling unit

Activity Request: The applicant is seeking a Special Permit for a home office related to the
family's exterminating business licensed as Bay State Termite&Pest Control
in Harwich.
Procedural Provisions: Section 5-3.3 Special Permit Provisions.
Background:
The locus of this appeal is a 1.05 acre lot located adjacent to the Mid Cape Highway and accessed form
Cape Trail,off Cedar Street in West Barnstable. The lot has recently been developed with a single-family
home with attached garage,estimated to be 1,685 gross sq.ft. All of the homes in this area of town are on
private wells.
According to the application submitted,to the Board and representations made at Site Plan Review,the
applicant is seeking to utilize a 12'by 12' (144 sq.ft)room within the home as a home office for the
business. No equipment or materials will be stored on the premises.

The proposal was reviewed by Site Plan Review Committee at its August 11, 1994 meeting and the plans
were forwarded to the Board with concerns expressed that;
1. no work trucks are to be parked on the site,and
2. a list of chemicals utilized in the activity(if any)is to be submitted to the Health Department for
determination of toxicity.
Procedural Summary:
Sitting on this appeal are T.DeReimer,Robert Thorne,Ron Janson,R.Boy and Chairman G.
Nightingale.
Mr.Peter J.Halliday spoke to inform this Board that he would like to operate a business out of his house.
He needs to have a phone for taking orders. There will be no deliveries at the house,no signs,no
customers, no storage of anything,no changes to anything. The concern has been the chemicals and the
vehicle used for his business as an exterminator. It is a part time venture still using his father's
equipment who he works for full time. Mr. Halliday said he wanted to continue to use his father's vehicle
to get back and forth from work but that some neighbors had concerns. Complaints regarding storage of
chemicals on site were unfounded per a site visit by town officials.
Ron Jansson had concerns regarding this being the third straight petition before this Board where I have
some questions as to whether or not they should be before us. He said if you have to drive a truck home at
night and park it in the driveway and have an answering machine in the house that that constitutes a
business? This is getting to the point of being ridiculous.
Mr.Halliday explained that when he moved in he had a drainage problem. He put a fiberglass tank in his
backyard,put holes in it and filled it with rocks to use as a dry well. The neighbors thought he was
storing chemicals in the back yard. The Board of Health has a list of chemicals Mr.Halliday uses:and Mr.
McKean notified the planning office that did not have a problem now that he has a listing of the
chemicals that are use and that might be stored on the truck. The vehicle is unmarked and has no
advertisement on it.
Chairman Nightingale asked for Public Comment: Kim Casten,a neighbor,spoke to say that she is
satisfied after seeing the chemical fact sheet. She additionally would like to have the Permit issued to
insure the conditions of not having a lot of trucks around if his business takes off in the future. Paul
O'Connell,Trustee of the Cedar Street Association Trust said a variance would be in violation of
Association restrictions.
Chairman Nightingale said this is not a Variance. It is a Special Permit request.
Mr.Janson said if it becomes a storage problem for a ten wheeler then that is a commercial vehicle. A
pick up truck is not necessarily commercial. Also if it is a chemical problem,it is a Mass General Laws
21 E problem. Then you would have no right to keep the truck there as it is an aquifer protection area.
Mr.Jansson said a Home Occupation in this district is a matter of right providing you meet all the
qualification. But,he did not construe this as business and he did not think the Board had to grant
anything.

FINDINGS:
Ron Janson made the findings with reference to Appeal;number 1994-78-Halliday. The evidence as
presented by the petitioner is the occasional use of the telephone from his house and the parking of his
vehicle,which is a pick-up truck,which also contain on the back of it a devise for disposing of
chemicals,I would find that those incidences in and of themselves are not sufficient to justify or qualify as
being a business as we would interpret them under our Home Occupation in the Zoning Ordinance.
