ADDITIONAL INFORMATION FOR MAKING AND FILING AN APPLICATION
FOR A CERTIFICATE OF APPROPRIATENESS
The four categories for which a Certificate of Appropriateness is required are: (application for demolition or removal is a
separate form).
1. EXTERIOR BUILDING CONSTRUCTION (new or existing buildings): An application is required for any exterior of a
building to be erected or altered including windows, doors, siding, roof, light etc., that will be visible from any public street,
way or public place. The following scale drawings are required in duplicate with application: plot plan (if addition — show
existing buildings in outline), floor plan and elevations. Also required are snap shots of existing buildings, where additions or
alterations are to be made. No plot plan is required for addition or alteration which does not touch the ground.
2. EXTERIOR PAINTING: An application is required for any portion .of a building, structure or sign to be painted that is
visible from a public street, way or public place. Color samples must be attached to these applications. An application is not
required when repainting existing colors, changing to white, or using colors approved by the Town Historic District Committee.
3. SIGNS OR BILLBOARDS: An application is required for any sign or billboard to be erected within the District, with the
following exceptions:
a. Existing signs or billboards on November 27, 1974 shall have until November 27, 1977 to secure an.approved Certificate
of Appropriateness.
b. Temporary signs for use in connection with any official celebration or parade or any charitable drive as long as they are' .
removed within three days of the event. Certain other temporary signs that the Committee feels does not detract from
the Act may be allowed with the prior permission of the Committee.
c. Real Estate signs of not more than 3 square feet in area advertising the sale or rental of the premises on which they are
erected or displayed.
d. A single sign of not more than 1 square foot in area showing the name, occupation or address of the occupant of the
premises on which they are erected or displayed in a residential zone.
4. STRUCTURE:. An application is required to build or alter any structure within the District which is defined by the Act as a
combination of materials other than a building, sign or billboard, but including stone walls, flagpoles, hedges, gates, fences, etc.
GENERAL REQUIREMENTS
5. Work on projects requiring approval shall not be started until the Certificate of Appropriateness has been filed with the Town
Clerk by the Committee. Approval is subject to the 10 day appeal period provided in the Act.
6. No changes shall be made from the original approved specifications without advance approval of the Commission on an
amended application filed with the Committee.
7. A separate application must be filed with each project requiring a Certificate of Appropriateness.
8. Under heading of "Detailed Description of Proposed Work" give detailed data on such architectural features as: foundation,
chimney, siding, roofing, roof pitch, sash and doors, window and door frames, trim, gutters —leaders, roofing and paint color.
9. Unless application is complete and legible and all material required is supplied, application will not be accepted or acted upon.
Copies of the Act establishing the Regional Historic District may be obtained at the Town Hall.

The Old King's Highway Historic District Committee had a complaint. The abutters
say they were not notified of any attempts by the applicant to build any homes on

Committee has found that there may be possible violations. The committee
therefore voted, that subject to Section A. 4 of the Guidelines, that Champion

In accordance with Chapter 470 "Old King's Highway Regional Historic District" Section 12, Violations Section
III - Proof of Violations, the committee found that a recently approved Old King's Highway application had an
error. The application No. 1996-006 (copy attached) by Champion Builders, Inc. for a single family dwelling at
Lot 6 Cape Trails (Assessors map Parcel No. 88/006-007) incorrectly listed the abutters to the locus. The
direct abutter, Richard M. and Kimberly H. Caston (Assessors Map/Parcel No. 88/006-002)was not listed on
the Application submitted by the Champion Builders, Inc.
The error in the abutter notification is a violation of the Old King's Highway Regional Historic District
Committee Guidelines, A-4) Areas of Responsibility, which specifically reads; "It shall be the duty and
responsibility of the applicant to file a fully completed application including an accurate list of all abutters with
their addresses...' Further state law requires the applicant to utilize the most recent assessors information
when filling out the abutters lists.
The Caston's have been living in the home for more than two years and have been listed on the Assessor's
Records as the owners for the last two years.
According to the information supplied in the Old King's Highway Application, the owner and contractor is
Champion Builders, Inc. with an address of 300 Oak Street, #155, Pembroke, MA 02359 (Telephone No.
(617) 826-3800). Matthew J. Dacey, President of Champion Builders signed the application.
The violation was initially brought to the attention of the Old King's Highway Historic District Committee on
April 11, 1996 by a direct abutter, Kimberly H. Caston, 140 Capes Trail, West Barnstable, MA 02668. This
request for enforcement is being made by the Old Kings Highway Historic District Committee which duly
made a motion, seconded and voted to request the enforcement on in accordance with Chapter 470, Section
12 and.Violation, Section 11 - Enforcement, April 17, 1996. The vote to request the enforcement was as
follows.

Mr. Crossen,
At our last OKH Public Hearing on April 3, 1996, the committee was approached by
three couples who are direct abutters of newly developed lots on Berkshire Trail in West
Barnstable. They claimed to have not been notified of the of the OKH hearings
concerning these developed lots. Our OKH Guideline states that the responsibility of
submitting abutter lists belongs to the"Applicant"for OKH Review.
(Proper"Abutter List", means updated as of January 1, 1996,according to our OKH
Commission Counsel.)
The applicant,Highview Realty,did not submit a complete abutters list to the OKH
Secretary.And double checking the lists are not a responsibility of the OKH Secretary.
The OKH Committee Voted 3-0 to Recommend to the Building Officer to investigate
a possible enforcement action,which would allow delay of construction on unfinished
abutting lots until the aggrieved abutters were given a chance to air their concerns at an
OKH Hearing.

OLD KING'S HIGHWAY REGIONAL HISTORIC DISTRICT
GUIDELINES
INTRODUCTION
These guidelines are adopted by the Commission in an effort to aid
applicants in appearing before the Old King's Highway Regional Historic District
Commission.
The more information provided to the Committee with an application the
easier it will be for the Committee to render a prompt decision.
All plans submitted for approval should be prepared to scale and clear-
ly drawn so the Committee can know from looking at such plans exactly what the
applicant intends to do.
Preliminary informal discussions with the Committee regarding a pro- .
posed project are encouraged prior to the filing of a formal application.
A. AREAS OF RESPONSIBILITY
1 . - It shall be the duty and responsibility of the local building in-
spector to enforce the. provisions of the Historic Act.
2. It shall be the duty and responsibility of the Town Historic
District Committee to locally administer the Act.
3: It shall be the duty and responsibil.ity of the Commission to in-
terpret the Act, to hear appeals, and to coordinate the overall efficient oper-
ation of. the District. -

B. APPLICANT RESPONSIBILITIES
1. All applications shall be filed on Commission approved forms avail-
able in the local Town Hall. (See Appendix Forms A-D). '
2. All plans submitted for approval should be prepared to scale and
clearly drawn so as to indicate the exact nature and extent of the proposed
project.
3. All applications should be accompanied with the following informa-
tion:
a. A plot plan showing the exact location of a proposed building
or structure and identifying existing relevant buildings and structures. In-
dicate what landscaping or planting, if any, is to be done.
b. Complete preliminary plans with four elevations of the pro-
nosed building or structure.

c. A specification sheet describing materials and colors to be
used in the proposed project. (See Sample Form A-1)
i. Materials: detailed description of size, type and
VIOLATIONS4,
SECTION 1 - General
While violations of the Historic District Act are usually minor in
nature and few in number, the law provides the fullest opportunity for com-
plete judicial redress against any violator. Violations should be prosecuted
in the local District Court and may be brought either by a civil action or
criminal complaint. Often times the violation of the Historic District law will
also include violations of other statutes and By-Laws which may provide for
more severe penalties.
SECTION 11 - Enforcement ,
The local building inspectors are the watch-dogs of the District and
will not issue building permits without a demonstration of compliance with the
Act. The law states that. "no permit shall be issued by the local building in-
spector for any building or structure to be erected" removed or demolished
"within the District unless the application for said permit shall be accompa-
nied. . .by a Certificate of Appropriateness" Certificate for removal or demoli-
tion, or certificate pf exemption. (See Section 6 of the. Act) . The la%a goes
on to state that the building inspector of the affected town shall have the
"power and duty" to enforce the provisions of this law. For these reasons
all violations should be promptly reported to the local building inspector's
office for proper enforcement action.
While .the local building "inspectors are specifically charged with the
responsibility for enforcing the Act, any person who observes a violation may
seek a criminal complaint against the violator(s) . Any person who violates any
provision of the Historic District Act is guilty of a mis emeanor and in 1974
the Massachusetts Supreme Judicial Court ruled that even though the Legislature
may have imposed the duty to prosecute violations on a particular public
official--in that case a health agent--anyone who is competent to give oath
may seek a criminal complaint in the. local District Court (See: Commo wealt;i
v. Haddad (1974) 364 Mass. 795; 308 NE 2d 899) . Therefore, if a citiz n feels
strong about a violation, he may seek direct action against the violator(s)
by going to the Magistrate's office of the local District Court.
The Commission recommends that all violations be brought to the local
-building inspector's office for enforcement. If criminal action is to be
initiated, the complainant should obtain competent legal advice and discuss the
matter with members of the local District Attorneys' office.
SECTION III - Proof of Violations
Any person suspecting a violation of the Historic District Act should
take steps to properly document the violation and be prepared to testify as a
witness. The following information and material will be helpful in supporting
any enforcement action:
A. Statement of facts - A brief written statement outlining the
alleged violation should be submitted to the local building inspector's office
and a copy retained by the complainant. The statement should include the
following information:
•(i) Location of the violation including street address and
assessors' map number.
(ii) Type of violation-set forth the specific section of the Act
that is being violated and indicate whether the violation involves construction
or demolition.
