As quoted from the"law",an employee is defined as every person in the service of another under any contract of hire,express or implied,oral or written. An employer is defined as an individual,partnership, association,corporation or other legal entity,or any two or more of the foregoing engaged in a joint enterprise,and including the legal representatives of a deceased employer,or the receiver or trustee of an individual,partnership,association or other legal entity, employing employees. However the owner of a dwelling house having not more than three apartments and who resides therein,or the occupant of the dwelling house of another who employs persons to do maintenance,construction or repair work on such dwelling house or on the grounds or building appurtenant thereto shall not because of such employment be deemed to be an employer. MGL chapter 152 section 25 also states that every state or local licensing agency shall withhold the issuance or renewal of a license or permit to operate a business or to construct buildings in the commonwealth for any applicant who has not produced acceptable evidence of compliance with the insurance coverage required. Additionally,neither the commonwealth nor any of its political subdivisions shall enter into any contract for the performance of public work until acceptable evidence of compliance with the insurance requirements of this chapter have been presented to the contracting authority. Petitioner: Alice A.McCarthy Property Address: 142 Cedar Street,West Barnstable,MA Map/Parcel: Map 131,Parcel 030 Zoning: Residential F Zoning District Relief Requested & Background: The subject property is addressed 142 Cedar Street,West Barnstable, accessed through an undeveloped way called Water Hole Lane, The lot is situated approximately 450 feet off of Cedar Street. According to the Assessor's record the lot is a 0.42-acre parcel developed with a one-story, two-bedroom, single- family dwelling built in 1955. The dwelling has a living area of 833 sq. ft., and an enclosed porch of 98 sq.ft. Today the Residential F District and Resource Protection Overlay Zoning District would require two- acres of upland and 150 feet of frontage. The building setbacks are 30 feet front yard and 15 feet for the side and rear yards. The existing lot is deficient in area and frontage. The applicant is proposing to completely demolish and remove the existing house and reconstruct a new single-family dwelling in conformance with the required setbacks. Procedural & Hearing Summary: This appeal was.filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on October 01, 2003. A public hearing before the Zoning Board of Appeals was"duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened November 19, 2003 and continued to December 10, 2003, at which time the Board found to grant the appeal. Board Members deciding this appeal were Ralph Copeland, Sheila Geiler, Gail Nightingale, Ron S. Jansson and Chairman, Daniel M. Creedon III. Attorney Mark H. Boudreau represented the applicant before the Board. Also present was Ms.Alice.A. McCarthy, the applicant. A memorandum in support of the application was submitted, as were photos of the existing structure. Mr. Boudreau noted that the existing structure is in deteriorated condition and that it is the desire of the applicant to demolish that dwelling and build a new single-family dwelling. He described the proposed home and noted that the property is served by a private well and that the on-site septic system that was upgraded in 1993 would be reused. He stated that the system meets Title 5 regulations without variance. The plans for the dwelling were approved by the Old Kings Highway Historic District Committee in the spring of 2003. The home would not be visible form the street and to permit the new modest home would not be substantially more detrimental to the neighborhood than the existing dwelling. Public comment was requested and Ms. Vicky Eldrige the abutting neighbor stated that she has no • objection to the proposal. The Board questioned the creation of the lot and the access. It was determined that the appeal would be continued to permit the history of the lot creation to be presented and to verify the nature of the access. The hearing was continued to December 03, 2003. At the continuance, Chairman Creedon noted that Board Member Ron Jansson was absent and that there were only four members present. Mr. Boudreau stated that he would go forward with the four- member board. Mr. Boudreau stated that a November 26, 2003 Supplemental Memorandum has been submitted to the Board files documenting the creation of the Lot. He summarized that the lot was created by a 1954 deed recorded at the Registry of Deeds in Book 881, at page 468. The lot was carved from a larger 10-acre parcel. Access to the lot was granted over an existing traveled way through the 10-acre parcel from Cedar Street. The deed created the boundaries of the lot as they now exist. The plan for the lot was prepared and recorded in 1996 and recorded in Plan Book 525 page 78. There is an easement over the neighboring lot that meets with a 33-foot way—Water Hole Lane—out to Cedar Street. Findings of Fact: At the hearing of December 10, 2003, the Board unanimously made the following findings of fact: 1. The applicant is Alice A. McCarthy who is seeking a Special Permit in accordance with Section 4- 4.3 Non-conforming Buildings or Structures Used as Single and two-family Residences and findings under MGL Chapter 40A, Section 6 for the demolition and reconstruction of a single-family dwelling on a non-conforming lot. The property is shown on Assessor's Map 131 as Parcel 030 addressed 142 Cedar Street,West Barnstable,MA in a Residence F Zoning District. 2. Today the Residential F Zoning District would require two-acres of upland and 150 feet of frontage. The building setbacks are 30 feet front yard and 15 feet for the side and rear yards. It was not until the comprehensive new zoning for the Town—Article 42 Annual Town Meeting March 1956—that this area of the Town was zoned Residential C-1. The applicant is proposing to completely demolish and remove the existing house and reconstruct a new single-family dwelling in conformance with the required setbacks. The new dwelling, although larger than the existing dwelling,is a"reconstruction" as that term is used in MGL Ch. 40A, Section 6. As such, the proposed new dwelling does intensify the alleged nonconformity in terms of the size of the building on the non-conforming lot.
