He sent the owner back to Old King's Highway. I called Chair Dorothy Stahley and told her that the owners were unaware of the requirements for OKH -they thought that if the footprint wasn't changed, all they had to do was meet Building's requirements. I explained that the house was moved due to a drastic drop-off on the topo —the owner didn't know why it was placed on the site plan the way it originally was in the first place. Dorothy called Ed Molins, Vice-Chair, and together they visited the site. It is very wooded, and it is doubtful that any abutters will be able to see the house at all, let alone the approximately 20-foot difference in its location on the parcel. Together they have agreed to let the change stand with no penalty to the owners. However, the ANR plan was signed by the Planning Board on December 15, 1975 and, under the Town of Barnstable's Zoning Ordinance Section 4-4.5, "Any lot lawfully laid out by a plan or deed duly recorded, or any lot shown on a plan endorsed with the words"approval .......not required"which complies at the time of such recording or such endorsement, whichever is earlier, with the minimum area, frontage, width and depth requirements;if any, of the zoning ordinance in effect at the time of such recording or endorsement may thereafter be built upon for residential use..........if 2)At the time of the adoption of such requirements or increased requirements, such lot wash held in common ownership with that of adjoining land located in the same residential district, but only then for a period of five (5) years from the date of such recording or such endorsement, whichever is earlier; As to the further provisions regarding bulk, frontage, sidelines etc., the lot is over 7,500 s.£ and has frontage of at least.100.00 ft., is zoned for residential use and conforms in other regards with the applicable provisions of the zoning ordinance in effect and a proposed structure would be able to conform with the minimum requirements of front, side and rear setbacks since they were not changed by the zoning change of 1974.
