She noticed her neighbors the Dubins were flatting their back yard and had cut away several trees. The next day Marie noticed that they were using an excavator to cut into the open space. ' Marie Robinson spoke with Mrs. Dubin and her landscaper at 9 AM on August 11, 2005. Mrs. Robinson expressed concern and requested the landscaping company stop their work, because of the following: 1- Violation of the Conveyances of Hunter Hill Estates Zoning concerning open space and it's use as a property buffer. 2- Concern with the French Drain System and Dry well that you were installing that was being put in 15 feet setback of your boundary and in the open space and that this might compromise the 157 Saddler Lane Property septic system. 3- Concern at the removal of all the trees and vegetation on the open space. 4- Concern at the deep 5-7 pits that were being dug next to the 157 Saddler Lane fence which was constructed 17 years ago. 5- Concern that the hill,which was open space was completely removed next to the 157 Saddler Lane fence, compromising the fence structure and safety. 6- That the buffer of privacy that the trees on the open space provided 157 Saddler Lane property had now been devalued. a 2 7- Concern that a survey was not done prior to work being done, nor were we as an abutter contacted or notified in any way. Mrs. Dubin produced a note from the Hunter Hill Board which had approved any landscaping. She informed Mrs. Robinson that 1- Her husband was a Treasurer of the Board 2- That the open space was owned by Hunter Hill and that it could be given to anyone the Board Approved of. 3- Any structure built on open space was subject only to the approval of the board members, and not the other Hunter Hill owners, nor the Town of Barnstable had any right to take action or complain. 4- Sited Richard and Marlene Falvey's appropriation of the open space for their pond,gazebo and landscaping and grass in the open space as a precedence for being able to use the open space in any way they as homeowners chose. (Marlene Falvey is the Hunter Hill Association President.) When Mrs. Robinson spoke to the landscaper,he said as a professional that: 1- All work had been approved by the home owner and that he didn't need a plot plan or survey to excavate up to the fence line. 2- As a professional he assured her that the dry well was 4 feet below the new grade and next to the fence and all the dirt that was removed would not compromise the fence or the septic system 'many way possible. However, he would not give her a business card or his name. 3- His Truck is Sierra GMC License L14-563 (note there are pictures of his trucks taken the following day and that his business is Miller Landscaping.) Mrs. Robinson called her husband and Paul called the Association President Stephen Helman, 508-775-9449. The number we got from the HunterHill.org website as the contact number,but got no response. At 3 PM,Mrs. Robinson spoke to the landscaper again and expressed concern that several large oaks on open space backing up to the fence were being removed and the fact that there was almost a 15 feet of dirt and tree roots removed below the fence in the open space. Several holes where they had excavated deep tree roots were at least 10 feet deep below the current flat grade . The landscaper told Mrs. Robinson he would tell the homeowner, however as a professional that he could assure Mrs. Robinson that there would be no erosion and no problems with the fence, septic and open space. He didn't talk to the home owner, but got back in his excavator and continued filling the dump truck. They removed approximately 15 trees from 5-10 inches in diameter and all the root systems. They put in a dry well,which the Landscape Contractor said was to be 4 feet below.the current grade on the property and open space just behind the Dubin house and deck. They then filled the entire area behind the house up to the fence with French Drains and crushed rocks approximately 4 feet deep. And they put crushed rock in under all the newly 3 I excavated dirt. Thus creating an un-engineered lateral field,which is adjacent to the Robinson's septic field. Mrs. Robinson counted at least 5 dump truck runs filled with dirt and tree debris leaving that day. August 12, 2005. Mrs. Robinson watched 4 more dump loads of dirt being removed. At 1 pm through the Fence Mrs. Robinson expressed concern that they were digging to close to'the fence but the contractor ignored her, turning his back when he got out of his machine. At 2 pm Mrs. Robinson went to the Town All to get a plot plan and ask what she could do, and filed a formal complaint. At 3 PM Mrs. Robinson noticed 3 more loads of dirt leave the property and that all the trees and underbrush, except for one small pine had been removed. (Note: The Robinsons left the original trees that abutted their fence intact. There were a little more than twice that number in size and diameter ON the open space between the 157 Saddler Lane property and the 27 CurryComb Circle Property. At 4 pm Paul Robinson called the Association President again,but could only leave a message. There was no response. August 13, 2005 At 10 AM, Paul Robinson walked around his fence, and took some pictures of the end of excavation. (see attached) a Michael Dubin told Paul to get off his property and Paul produced a plot plan, showing this area of the subdivision and the open space. Michael Dubin explained that he had permission from the board and didn't put anything on or take anything from open space that he didn't have permission to do. He also stated that Richard and Marlene Falvey owned all the property to Saddler Lane. (see additional complaint) Paul Robinson called the Association President again and no phone call was returned. Later that day,it was noted that most of the land had been flattened to the new and lower grade and that loam had been put on surface. I r. 4 Monday August 15, 2005 The landscaper returned to bring in several loads of loam and dirt. We feel these actions are wrong. 1-It isn't the authority of the Hunter Hill Association Board to give whatever open space they feel to whomever is within their favor. Such favoritism is unfair and unjust. 2 - It violates City Zoning ordinances concern Zoning 3-These action may compromise our fence and our septic system. 4-The Dubins have no right, especially without a certified plot plan, survey or engineering plan 5- 5 days of excavating and landscaping are not simple work and not just removing a few dead branches from trees. 4-These actions have devalued our privacy. We respectfully request that the Zoning Board investigate and require the homeowner to replace the trees with comparable trees and return the integrity of the open space and that the un-engineered lateral field be investigated for possible degradation of the septic system and fencing on 157 Saddler Lane. It was our mistake to encroach and we have a plan in place to restore the open space area. The issue arose when dead trees on the open space began to deteriorate and threaten our home and property. I had a couple of these trees removed. I will replant them as necessary. Our project included putting in a lawn behind our home, regrading and leveling a portion of the area. We have had flooding problems ever since arriving in 1998. We installed two dry wells within two feet of our foundation in two separate areas to alleviate water issues in our basement. We can restore the grade on the open space by putting up a stonewall on our rear property line. I have already discussed this with our landscaper. We have already taken steps to get the property surveyed as quickly as possible. Be advised that this was accidental due to some poor information concerning lot lines. We would like to avoid fines and keep the issue as simple as possible. Please be advised that our neighbor's complaint, to which we received a copy, contains some blatant errors. Not all work had been done on this open space area, and I take issue with the language and speculation used in the complaint. The Hunter Hill Association Board has already been contacted concerning the complaint and will make sure we are in compliance. It was never our intention to cause any trouble with this project.
